William Bentley

Born 1828 in Alabama married on June 3, 1855 in Yazoo Mississippi, to Eliza A. Brantley Thomason. They had 2 children: Sarah Bentley born March 8, 1857 and Emsley Burns Bentley. He served in the Civil War Company F, 3rd. Calvry Regiment, 1st Brigade Minute Men Company A, Holmes County Minute Men Muster Roll June 14, 1863. William died April 15, 1864 at the residence of Joel Sherrard in Yazoo County Miss. He was disabled by a gun shot wound. He later died. His will was probated May 1864.

William Bentley Will

In the name of God Amen. I, William Bentley, living in the county of Holmes and State of Miss. make this my Will and Testament.

First, I want my honest debts paid. I give to Richard G M Thomasson the following land, to wit the east half of the south east quarter of section three township thirteen range one west and also one third of my stock of hogs and cattle.

I give the reminder of my estate consisting of one quarter section of land known has the west half of the south east quarter and east half of the south west quarter all in section known township thirteen range one est and all of my stock consisting of hogs,cattle and horses with the exception of that section given to Richard G M Thomasson.

It is my wish that the land given to my two children Sarah Bentley and Emsley Burns Bentley shall not be sold or disposed of but be kept for them until they become of age or marry at which time I wish it given up to them.

It is my wish that all notes and moneys that may come into the hands of my administration will be presently managed for their benefit, and also the rent and leasing of the land and management of the stock. I wish him to take charge of.

I appoint my esteem friend E B Stainback my only adminstration.

The State of Mississippi : Holmes County
In the probate Court of said county at the June Term A.D. 1864

Be it (?) that at a term of the Probate Court of the County and State aforesaid, be given and held at the court house on and before said county on the fourth monday in June A D 1864 personally appeared in open court E B Stainback who states on oath, this the last will and testament of William Bentley deceased, here to amexce(?), bearing date, the 4th day of September A D 1862 was depisted with him after safe keeping, and further that said will and there it is who by in the hand writing of the said William Bentley, and that the said Bentley was at the time, of sound mind and memory and over twenty one years of age. (?) to subscribed in open court.

(?) Thomason he gave and willed to his own children as the said (?) Thomasson was now dear, that he desires the said J C Byrd to assist Mr. Stainbeck in the settlement of his estate, the undersigner remained with said (?) until the hear of his death which took place about one oclock next morning in the presence of the undersignee, that said (?) was at the time of said testamentary words and afterwards until his death, of sorrow and disposing mind, memory and understanding.
In Testmoney whereof the understanded here upon set in their hands and seals this May 23rd 1864.

In the matter of new C_____ will of William Bentley Deceased Be it ________at the term of the Probate Court of the county of Holmes in the state afor said begun and held at the court in and for said county on the 4th Monday in May AD 1864 personally appears in open court Thomas H. Redditt and J.C.Byrd_________to the new Cupain will of William Bentley deceased and made oath that _____ ________on the 15th day of April AD 1864, ______in their presence the _______ _____ statement made by them at the time and place afore.
