WILL OF PETER BALLIE PHILADELPHIA COUNTY, PENNSYLVANIA WILL 14: 1743 In the Name of GOD Amen. The first Day of February Anno 1742/3 I Peter Ballie of Oley in the County of Philad: Yeomen, being very fick and weack in Body, but of perfect Mind and Memory, Thancks be given unto God therefor, calling unto Mind the Mortality of my Body, and Knowing that it is appointed for all Men once to dye, do make and ordain this my Last Will and Testament: That is to fay, principally and first of all, I give and recomend my Soul into the Hands of GOD that gave it and for my Body, I recomend it to the Earth, to be buried in a Christianlicke and defient Manner, at the Difcretion of my Executors, nothing doubting but at the General Refurrection, I shall receive the fame _________, the ____ Power of GOD. And as touching ____________ Estate, wherewith it hath pleased GOD to blefs my in this Life, I give, devife & difpofe of the fame in the following Manner and form --- In primis It is my Will, and I do order, that in the first Place, all my just Debts & Funeral Charges be paid & fatisfied. Item I give and bequeath unto Sufanna my dearly beloved Wife all my Money fo well in cafh as Bond and Bills; item a free Pofsefsion of the House where I now live in, without any oppofition, the Corn upon the Loaft, item the next Crop to have half, Item My Daughter Who tackes Pofsefsion of My Plantation Shall be oblig'd to give Her, Yearly for Her Subfistence twelve Bufhel of good Wheat, Sixty pound of Beuf and Houndret Pound of Pork and to Sow a half acre of flax for Her Use, Item She is to have the third Part of the Fruits in the Orchard. Item I give Her full Power and Authority to Keep the Deed for the Land in Her Hands and Pofsefsion, to have Power enough to oblige Her Daughter or Son in Law or their Heirs, to mind their Duty towards Her. Item to provide a Cow for her Use. Item I do give unto my Eldest Daughter Dorothea Shar_____ Sum of forty Pounds Current Money of Penfylv: wich Sum She Shall accept in Bonds. Besides what She receiv'd in Former Times. Item I give unto my Daughter Sufanna Beydelman the Sum of tewnty pounds in cafh to be paid after my Will is proved. Pennsylvania Wills, 1682-1834 (Abstract) SHERR, ULRICH, Maxatawny. February 21, 1754 - March 26, 1754. To eldest son Jacob, the land in Richmond Twp., 156 acres and provide for his mother Dorothea. Youngers sons Peter and Henrich shall have the inhabited plantation and pay to their sisters, Elizabeth, Susanna and Maria £100 each. To youngest son Michael £100 when 21. Letters C.T.A. to Dorothea the widow. Wit: Henrich GRUNEWALD and Jacob HOTTENSTEIN. Translation.
Pennsylvania Wills, 1682-1834 WILL OF ULRICH SHERR BERKS COUNTY, PENNSYLVANIA; 1754 Translated from the Old German I Ulrich Sherr being very ill in a dangerous sickness but in good sense and understanding, and I not omitt before I should dye, to make my last Will for my Wife and Children, which I declare to the Subject be hereof. Firft my eldeft Son Johann Jacob Sherr fhall have the Land lying in Richmond Township, which makes one hundred and fifty six acres, and the above menshoned Jacob fhall have further fifteen acres lying next to him, which have his Brothers, Peter Scher and Henrich Scherr, and this fhall he and his Posterity have. Secondly, my two younger Sons Peter and Henrich fhall have the inhabitated Plantation, House and Place for themselves and their Heirs. But Peter fhall help his Brother Henrich to build an Houfe and Barn that he can ufed. My two Sons Peter and Henrich fhall give out of this Plantation to my Daughters, Elifabeth, Sufanna and Maria, to every one of them, one hundred Pounds of Penfylvania Money, and to every one an Ox two Year old, and this they fhall have when they marry or are free. Farther the two Brothers Peter and Henrich fhall give out to my youngeft Son Michel, like one hundred and fifty pounds real money, and this, when he is free, or twenty one years old. Concerning my Wife Dorothea, firft fhe fhall keep her seat in their Houfe fo long as they live in friendship. But if they can not ftay together, they fhall build for her an Houfe next to the Spring, and fhall cut and bring home to her wood for burning, and the two Brothers Peter and Henrich Shall give to their Mother every year fo long as she lives twenty Bufhels Wheat, and fodder for two Cows, and every year, one hundred Pounds of Pork and fifty pounds of Bief, and two Lines of appel Trees; as fhe will chuse, and every year an half acre with Flax, and they fhall clear them, and they fhall give every year to her forty schilling Cafh. But if it happens, that fhe fhould marry again, fhe fhall have the third part of the moveable goods. What concerns the Notes and Bonds and the Wheat in the Houfe, thereof they fhall make free that Land which is not now free. And this I certify with my own hand. Pennsylvania Wills, 1782-1786 SCHEIRY, JON. HEINRICH Courtesy of Clarence Shirey < shiboyalltel.net >. THIERY, HENRY, Windsor. (Transcriber's spelling of the name) October 22, 1783 - February 16, 1784. Translation. Provides for wife Susanna. Land to be sold and estate div among 3 sons and 4 daughters now living and the children of son Henry deceased., viz, Elisabetha and Henry. Sons named are John, Michael and Ludwig, daughters are not named. Exrs: sons in law William BECKER and Michal GEIER. Wit: Henry STERNER and Felix FRAUNFELDER. NOTES ON THIS ENTRY:It seems evident that the extractor of this record copied it incorrectly. The following information was submitted from Clarence Shirey at e-mail address: shiboyalltel.net, a descendant of Henry. (The original Will is written in German, Joh. "Heinrich" Scheür˙ is how the name appears on the Document text. It was written 22 Oct 1783. One witness, Henry Sterner appeared at the Court House on 16 Feb 1864, and the other Felix Frauenfelder not until 24 Dec. The properties adjoined the witnesses farms. The Will itself, has written on the outside of it "Henry Sheiry, deceased, proved Feb. 16, 1784". The man signed with "his mark". The extractor could easily mistaken the "S" for a "T" the way it's written, but be assured it's definitely an "S" when you read the document itself.)

from FRANKLIN COUNTY, PENNSYLVANIA WILL BOOK B (p.277): 1805 WILL OF PETER SHEARER In the name of God amen. I Peter Shearer of the Township of Peters in the County of Franklin and State of Pennsylvania being very sick in body but of sound mind memory and understanding but considering the uncertainty of this transitory life do make and publish this my last Will and Testament in manner and form following to wit. I give and devise to my Dear wife Christina her choise of any one of my horses and her Saddle her choise of a bed and beding and it is my will that she keep the whole of my lands in her hands for the term of eight years from my Deceafe and that my children live with her and be Supported by the products of my farm at her discretion and that the younger ones are also to be schooled by her and I devise that she ask the advice and that it be by their consent of my Executors hereafter named refpecting what Schoolling may be necefsary and at the Expiration of the eight years I allow my lands to be appraised by two difenterested men, chosen by my Executors and the one third of the money to which it is appraised to be put to interest and my said wife to have the same during her natural life for her support, and the above to be considered as her Dowry in full. It is my will and desire that my son Jonathan lives with his mother and the family during the eight years and to be careful and industrious during the same for which I allow him to be paid yearly and every year the sum of one hundred Dollars and at the end of the said term, then my son Jonathan is to take the whole of the farm into his own pofsefsion yet still to keep the younger Children untill they severally arrive to the age of seventeen years when they are to be put to trades such as my Executors may direct, and it is my will that my son Jonathan shall have and Enjoy the whole of my lands in the County afforesaid, to him his heirs and afsigns forever, he paying the two thirds of the appraisement money of my lands in the manner hereafter directed. I give and devise to my Daughter Rebecca at her marriage a horse saddle and bridle worth one hundred Dollars one fether bead beding and bedstead worth forty Dollars and as it cannot be afsertained what the appraisment may amount to, it is my will that the same be it more or lefs, shall be equally divided among my Children hereafter named, and in the manner following. To my daughter Rebecca one sixth share deducting the sum one hundred and forty dollars which was before given to her to my son Benjamin One sixth share then to my son Solomon one sixth share then to my son George one sixth share, then to my son Daniel one sixth share, and then to my son Peter one sixth share, the whole to be paid by my son Jonathan in yearly payments of one hundred pounds and beginning in one year after his taking pofsefsion of the property as before mentioned and paid in the order the other Legatees are named and it is also my will that at my wifes decease the money that will then be at Interest shall be divided in like manner as the other is divided and it is to be understood that on the appraisement of the land my son Jonathan shall have his share included or reserved to him in the appraisement allowing it to be equal with my other Children. And as touching my lands in Knoxvill County in the State of Tennessee, it is my Will that my Executors dispose of the same at this discreation and they are hereby empowered to sell and convey the same and the monies arrising therefrom to be devided as the above Including my son Jonathan to an Equal Share which will make seven shares. - and it is further my will that as soon as convenient after my deceafe my Executors make a vendue and sell so much of my personal property as the may think can be speared and the monies applied to the difcharging of my Just debts which with what money can be made during the eight years that my wife keeps the land will I think be full sufficient for that purpose and whatever of my personal property may remain unsold it is to be appraised and remain for the use of the family and my son Jonathan shall have the previlidge of raising two horses for himeself during the first eight years and at the end of the eight years so much of the property as may then be on the farm shall be sold so as to wise to the sum the unsold property may be appraised to, which money shall also be divided share and share alike. And lastly I nominate and appoint my brother Frederick Shearer and my son Jonathan Shearer to be the Executors of this my last will hereby revoking all other wills Legacies and bequests by me heretofore made and declairring this and no other to be my last will and Testament. The Will of Adam Scheurer/Shirer

The following is the only record listing heirs for the Adam Scheirer residing in Southampton Twp., Somerset County. He died Nov 15, 1875 at almost 5:00 p.m. and his death is recorded in Somerset County under the Registrar of Wills. That record only tells the time and date of death and the fact that his son William Scheirer entered the record. Adam Scheirer is supposed to have died in Fayette County having been hit by a train outside Pennville. He was supposed to have been in Fayette County to help his son William and was walking into town when he was hit by the train. That is family lore from a man who's house sits where it can see the graveyard in Fayette County where Adam is supposed to be buried. (I say supposed because I haven't seen the grave personally.) Adam's wife, Elizabeth, is buried in Comp Cemetery, Somerset Co. but he is not buried with her.

Text of the Deed:

This indenture made the fourth (4) day of June eighteen hundred and eighty five Between William Shirer and Elizabeth Freid (or Fried) of Pennville Fayette County Penna, George Shirer and Rebecca Emerick of Bard, Bedford county Penna, and Lydia Lowry (or Lowery) of Londonderry Twp. Bedford Co Penna, heirs of Adam Shirer decd. Of the first part and Jonathan J. Emerick of Londonderry Twp. County of Bedford and State of Penna of the second part Witnesseth that said parties of the first part for and in consideration of the sum of One hundred dollars lawful money of the United States of America unto them well and truly paid by the said party of the second part at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged have granted bargained sold ______ _____ released conveyed and confirmed and by these presents do grant bargain sell alien cutoff release couny and confirm unto the said party of the second part his heirs and assigns forever all the following property viz: All that certain tract of timber land known as the Southern half of the Daniel Green tract situated in Southampton Township Somerset County Penna. Beginning at a post at or near the Southern side of the waters of the Gladdens run thence running due east forty eight (48) perches thence North twenty four deg. East Seventy two (72) perches to the stones thence. North Sixty four deg. West Sixty six perches to stones. Thence South Six deg. West ninety three (93) perches to place of beginning containing about thirty two acres more or less and being a part of the real estate of the late Adam Shirer dec. being designated as -.8 in a plot or draft made by Niram Blackburne in pursuance of his survey of said lands made the 16th 17th and 18th days of Oct. 1877 and adjoining lands of Jacob Tochteners on the line of Somerset and Bedford County and the lands of the Buffalo Mining Co and the lands of Dennis Comp and others.

Together with all and singular the said property improvements way's waters water-courses, rights liberties priviledges hereditaments and appustenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and all the estate right title interest property claim and demand whatsoever of the said parties of the first part in law equity or otherwise heresoever of in and to the same and every part thereof To have and to hold said Southern half of Danl Green tract of timber land and part of the real estate of the late Adam Shirer decd above described with all it's hereditaments and premises hereby granted or mentioned and intended Co to be with the appertenances until the said party of the second part his heirs and assignes to and for the only proper use and behoove of the said party of the second part his heirs and assigns forever. And William Shirer, Elizabeth Fried, George Shirer, Rebecca Emerick and Lydia Lowery heirs of Adam Shirer decd. The said parties of the first part for themselves and their heirs executors and administrators do by these presents covenant grant and agree to and with the said party of the second part his heirs and assigns that they the said parties of the first part and their heirs all and singular the hereditaments and premises herein above described and granted or mentioned or intended so to be with the appertenances unto the said party of the second part his heirs and assigns against there the said parties of the first part and their heirs and against all and every other person or persons whosoever lawfully claiming or to claim the same or any part thereof shall and will warrant and forever defend.

In virtues whereof the said parties of the first part have to these presents set their hands and seals.

KIRBY, THOMAS, Maiden Creek.
April 16, 1761 - October 2, 1765.
Mentions that heirs seized of a tract of 529 acres of land on
Schuylkill in Exeter. Also of tract of 69 acres adjoining said tract.
To oldest son Joseph, the tract of 69 acres and also 131 acres of the
larger tract.
To sons William and Peter the remainder of said tract being 398 acres,
to be evenly divided between them.
To sons Stanley and Michael my tract of 380 acres in Maiden Creek, to
be evenly divided.
Also to son Standly £100 towards maintenace of wife and dau. Mary(as
she is impotent).
To son Thomas, my riding horse, he having been provided for.
To son John £50 having not behaved himself as should have done.
To dau. Elizabeth 5 shillings.
Remainder to Standly.
Whereas I THOMAS KIRBY son of William KIRBY late of Peter Street in
Westminster, City of London and Elizabeth his wife my mother, was by my
uncle Wm. STANDLEY and my mother by indentures dated in or about the
last year of the reign of our late Sovereigh Lady Ann, Queen of Great
Britain, bound as an apprentice to a certain James SPENCER living in
Black Friars, the city aforesaid, whitesmith. Being as I am informed
the only surviving heir and nearest of kin living to the estate of my
grandfather STANDLY (mother's father) who with his son, Thomas my Uncle
are December'd. without issue. [Goes on to devise his right in certain
real estate to his son Joseph.].
