FRANK BYINGTON TRIED FOR MURDER CIRCUIT COURT RECORD, SATURDAY THE 26TH DAY OF NOVEMBER 1898 ON THE 11TH DAY OF NOVEMBER TERM STATE OF MISSOURI PLFF. VS. FRANK BYINGTON DEFT.
INDICTMENT FOR MURDER:   Now at this day comes the State by her attorney and also comes the defendant in his own proper person as well as by his attorney and the Clerk makes a certified copy of the Indictment in the above entitled cause and delivers a copy of the same to defendants counsel at 2:53 p.m.

CIRCUIT COURT RECORD, WEDNESDAY THE 30TH, NOVEMBER 1898, ON THE 14TH DAY OF NOVEMBER TERM STATE OF MISSOURI PLFF. VS. FRANK BYINGTON DEFT.: INDICTMENT FOR MURDER:  Now at this day comes Frank Byington as principal and James Highly, Jr., John C. Alexander, J. W. Ritter and J. L. Alexander as his securities and now here in open court acknowledge themselves to owe and stand indebted to the State of Missouri in the penal sum of Five Thousand Dollars each to be levied of their respective goods and chattel land and tenements, yet upon this express condition, that is to say if the said Frank Byington shall be and appear before the Circuit Court of St. Francois County at the May Term 1899, of said Court to be begun and held at the Court House in the City of Farmington in said County of St. Francois Missouri, on the 3rd Monday of May next 1899, and from day to day and from Term to Term to which said cause may be determined and then and there to answer to an indictment preferred against him said defendant by the Grand Jury of St. Francois County Missouri for Murder whereof he stands charged and shall not depart the Court without leave thereof, then this recognizance shall be void otherwise to remain in full force and effect with which they acknowledge themselves content.

CIRCUIT COURT RECORD, FRIDAY THE 25TH DAY OF MAY 1899 AND THE 16TH DAY OF THE MAY TERM 1899 STATE OF MISSOURI VS FRANK BYINGTON: INDICTED FOR MURDER:    Now comes the State by her attorney and also the Defendant in his own proper person as well as by his attorney and also covers the following jurors to wit: William Mathius [Mathias ?] (1); L. J. McCorcien (?) (2); Lee Johnson (3); A. W. O’Dell (4); Morenal (?) Corty (5); J. H. Beny (6); A. M. Smith (7); Beu O’Dell (8); George Holter [Halter ?] (9); Giles Hunt (10); George Rauesee (?) (11) O. P. McCovered (?)(12) Good and lawful men of the body of the county of St. Francois who were duly sworn and impounded to try said cause and there not being sufficient time to complete this trial, the same is continued till tomorrow.

CIRCUIT COURT RECORD, SATURDAY THE 26TH DAY OF MAY 1899 AND THE 17TH DAY OF THE MAY TERM 1899 STATE OF MISSOURI VS FRANK BYINGTON: INDICTED FOR MURDER:   Now at this comes the State by her attorney also comes the defendant in his own proper person as well as by his attorney and this cause is resumed. Also, comes the jury as upon yesterday and after hearing all the evidence, argument of counsel and receiving instructions from the Court retire to consider their verdict and after due deliberation return into Court the following verdict to wit: We the jury find the defendant NOT GUILTY, Giles Hunt Foreman actd. (?) It is therefore ordered by the Court that the plaintiff move and recover nothing of the defendant for the said bill of indictment and that he go hence without delay.
