33. Benjamin HIGGINBOTHAM Jr.^2,61,65 was born about 1757 in Albemarle County, Virginia.¹⁵ He served in the military in 1781 at Amherst Co VA Militia in Revolutionary War. He died in 1810 at the age of 53 in Elbert County, Georgia.^15,19,66

Benjamin was a soldier in the Revolution. He was part of 279 non-commissioned officers and privates ordered into service from Amherst Co by Col. Daniel Gaines of the Militia, 21 Jun 1781. They were "to march to join the Army commanded by the honorable Major General, Marquis de la Fayette". [William & Mary College Library, Cabell Papers, Uncataloged 4, Box 1.]

William Turner from Amherst submitted his application for a Revolutionary pension on 21 Aug 1832 and stated that he served under Capt. Benjamin Higginbotham on the line of march to Yorktown.

In 1782, Benjamin Jr. was listed on a Tax List in Amherst Co - he had 130 acres. of Land. His name does not appear in Amherst after 1783.

Moved to Elbert Co GA about 1784 with his father and siblings.

In Georgia, ordinary citizens received bounty land for not leaving the state during the Revolution; therefore, bounty land is not proof of military service.

20 Oct 1815 Lewis T. Berry sold to Robert L. Tait, 269 acres on the waters of South Broad River, part of an 800 acre survey granted to Higginbotham, warrant dated 7 Feb 1804, surveyed 16 Feb 1804, granted 6 Feb 1805.

Benjamin also had 200 acres in Wilkes Co, probably granted before the formation of Elbert Co. Grant Book LLL, p.335.

In 1790, Benjamin Higginbotham Jr was listed in Col. John Cunningham's Battalion of the Wilkes Co, Georgia Militia.

Feb Court Term, 1803. Benjamin Higginbotham provided security for Larkin Gatewood as Administrator of James Gatewood, deceased. [James was a son of Larkin who predeceased his father.]
1 Oct 1802. Will of Larkin Gatewood, Elbert County. Benjamin Higginbotham was one of three sons-in-law appointed Executors. The will was probated 22 Apr 1805.

Benjamin Higginbotham Jr was listed with two draws in the 1805 Georgia Land Lottery. They were both blanks.

Will dated 20 May 1809; probate on 3 Sep 1810. Dau Sarah - slave Daufney & featherbed which she has; dau Anny - slave Milley & featherbed; dau Elizabeth - slave Letty & featherbed. (note - the bequests to the daughters indicate they already have the beds & livestock, suggesting they are already married) Son Benj Graves - a slave Daniel, cattle, horse & featherbed. Son Peter - a slave Jacob & featherbed, horse. Dau Mary, a slave Rhody, bed, horse. Son Larkin - slave Lindsay, horse, etc. Residue to be equally divided among all children. Executors: Son Benjamin Graves Higginbotham and John Upshaw Jr. Wit: Jacob Higginbotham Sr, John Upshaw, Leroy Upshaw, Francis Satterwhite.
[Mary Gatewood, Benjamin's wife, had a sister Amy who was married to John Upshaw Sr. The Upshaws were another family that came from Amherst to Wilkes/Elbert Co GA.]
3 Sep 1810 Court of Ordinary September Term. Jacob Higginbotham and Francis Satterwhite, swore they saw the testator sign and seal his will. 13 Oct 1810 the Will was recorded.
18 Sep 1810. John Upshaw, Fran. Satterwhite, Thos. S. Carter & Thos. Smith returned the Inventory & appraisement of the estate of Benjamin Higginbotham to the Court. Included 13 Slaves listed by name and value - Joe (no value - probably elderly). A second Joe, Reuben, Jack, Daniel, Jacob, Johnson, Lindsey, Charity, Jude, Humphrey, Rhoda & Milley. Total Value of the estate was $4075

Returns 1817: Thos S. Carter, administrator with will annexed on estate of Benjamin Higginbotham Dec'd. Receipts of Benjamin G., Peter, Larkin, William Higginbotham, James Rowsey [obviously in right of one of the daughters] and William Woods (for another daugher) for their distributive shares - $60.68 No doubt all had reached their majority by this year. Daughter Mary, who married Charles Carter was apparently not mentioned in the distribution. Nor have I been able to determine which daughter married Rowey (perhaps Sarah), which daughter married William Woods - daughters Anne, Elizabeth, also unaccounted for so one of them must have been married to Woods. In the actual probate file - I found also a payment for the same amount to William Hightower (another husband for a daughter?) and the receipt for same. When recopied into the Probate book this name seems to have become William Higginbotham.
10 Jul 1816, there is a receipt from Larkin Higginbotham in full for his legacy from his father's estate.
23 Oct 1818, there is a receipt of Peter Higginbotham for his legacy "which I receipted for some years back, which receipt was accidentally burned"

Which dau was married to Rowsey? I have seen the daughter Sarah as his wife but no proof or further data was furnished. It's is also strange that William Higginbotham was receiving a share unless one of the Williams was receiving the share on behalf of one of the daughters. Charles Carter should have been a recipient in right of Mary by 1817 but they were in Mississippi.

Benjamin HIGGINBOTHAM Jr. and Mary GATEWOOD were married on 21 January 1782 in Amherst County, Virginia.^7,61 Mary GATEWOOD, daughter of Larkin GATEWOOD and Catharine PENN, was born circa 1760 in Amherst County, Virginia. She died before 1809 at the age of 49.

Mary Gatewood and her sister Dolly married brothers, sons of Benjamin Higginbotham and Elizabeth Graves. Mary married Benjamin Jr; Dolly married Francis.

He was buried in White Cemetery, Noxubee County, Mississippi.⁶⁷ Benj. G. Higginbotham married Polly Lollis [Mary Foster Lossis/ Lawless] on 2 Jan 1812 in Elbert Co GA. In the 1830 Dallas Co AL census near William Higginbotham; probably cousins. 1850, Noxubee Co, MS: Household 673 B. G. Higgenbottom, age 66, born SC [error]. Mary age 55, b. GA. John L. age 39, Mary 28, and Tabitha 13, all born in GA. Household 757: James L. Higgenbothom, age 22, b. Alabama, Margaritt 20 b. NC and Mary age 1, b. MS. Household 777: Talliffario Higginbotham, age 38, b. GA, Jane 30, b. AL. Mary Anne age 1 and James 7 months, both born in Mississippi. [This accounts for all the children of Benjamin Graves except for the eldest son Benjamin, Harriet who married C. R. Whitehead in 1845 and Sarah Ann who married Richard White in 1847. A FindAGrave memorial has Sarah Ann Higginbotham, dau of Benjamin Graves Higginborham, as having married Thomas Jefferson Smith. Either she married twice or one of the marriages is incorrect. Smith apparently married second to Matilda C. Nabors. Smith is buried Pine Grove Cemetery, Sweet Home, Pulaski Co, AR.
150	v.	Peter HIGGINBOTHAM⁶¹ was born about 1790 in Elbert County, Georgia.⁶¹ Peter Higginbotham married Jinney Howard, 4 Feb 1813, Elbert Co GA. Before 1830 the family moved to Edmondson Co KY.
151	vi.	Larkin HIGGINBOTHAM⁶¹ was born about 1796 in Elbert County, Georgia.⁶¹ He died in 1863 at the age of 67. He was buried in Higginbotham-Buckingham Cemetery, Edmonson County, Kentucky.⁶⁸ Larkin Higginbotham married Polly Howard, 12 Jan 1815, Elbert Co. GA. Polly was born 1794, died in May 1870 and both are buried Higginbotham-Buckingham Cemetery, Edmonson Co, KY. Family moved to Edmondson Co KY before 1830. Also buried Higginbotham-Buckingham Cemetery: Son William Thomas Higginbotham, b. 1 Jun 1833, d. 9 Jul 1921, and his wife Nancy Ann Stallsworth, b. 1839, d. 1872.
