This indenture made and entered into this 25th day of August in the year of our Lord one thousand eight hundred and fifty four between R. E. C. DAVIS, assignee by AARON GIGSBY, of the County of Marion and State of Tennessee of the one part and THOMAS SMITH, of the same State and County of the other part, witness that for and in consideration of the sum of two hundred and seventy-five dollars in hand paid the payment of which is hereby acknowledged, I, the said R. E. C. DAVIS, have this day sold and conveyed to the said, THOMAS SMITH, his heirs and assigns forever a certain tract of parcel of land containing thirty-three acres more or less lying in the County of Marion on the southeast side of Sequachee River and pounded as follows to wit: Beginning at a Hickory it being the said SMITHs southeast corner near the spur of the mountain; thence north thirty-eight poles to two Black Gums the said, THOMAS SMITH's beginning corner of his two hundred and sixty acre survey on which he now lives; thence west with the line of said survey to a Black Oak; thence south to HARVEY RICHARDS's corner at a branch; thence eastward to the beginning. To have and to hold the above described land with hereditaments and appurtenances there unto belonging, I, the said R. E. C. DAVIS, bind myself my heirs and assigns to warrant and forever defend the title of the same tract of land to the said, THOMAS SMITH, his heirs and assigns forever. In testimony of which I have here unto set my hand and seal this day date above written

Personally appeared before me, JAMES H. CONATSER, Clerk of the County Court of said County, HARVEY RICHARDS and WILLIAM STEWART, subscribing witnesses to the within deed of conveyance with whom I am personally acquainted who after being duly sworn according to law deposes and say that they are acquainted with ROBERT E. C. DAVIS, the within bargainor and that he madE and executed the within deed of conveyance upon the day it bears date for the purposes therein contained and expressed.
