WILL OF DAVID THAXTON, JR.

Between 1791-1792-1889

In the name of God Amen, I David Thaxton of Kanawha County, State of West Virginia being of sound and disposing mind, do make this to be my last will and testament as follows. First, I give and bequeath unto my daughter Sarah E. Johnson the sum of twenty dollars for her own use and benefit. Secondly, as to all the residue of my personal estate, I hereby give and bequeath it unto my heirs, to wit: Robert C. Thaxton, Sarah E. Johnson, Nancy S. Marsh, John H. Thaxton, Martha F. Edens, F. P. Thaxton, James H. Thaxton, Elizabeth C. Carpenter in equal shares and propositions. As for my real estate, I have disposed of that to my two younger sons, S. S., F. P. Thaxton and James H. Thaxton as appears by deeds, dated August 22nd, 1867. And I do hereby nominate and appoint Robert C. Thaxton to be the executor of this my last will and testament. In witness whereof: I the said testator, David Thaxton have set my hand and seal this 5th day of February 1872.

This paper writing purporting to be the last will and testament of David Thaxton deceased, late of said County was this day presented to me in my office and duly proved by the oath of William Ranson, subscribing witness thereto: and on the 28th day of March 1877, the same was fully proved by the oath of John H. P. Aultz another subscribing witness thereto: and is ordered to be recorded as the Last Will and Testament of David Thaxton, deceased.
