WILL & APPRAISEMENT OF  MARY TEAYS

In the name of God Amen. I Mary Teays of the County of Kanawha being very low in health but of sound and disposing mind do make this my last will and testament

First, I .. to the three children of my deceased daughter Katy …………………………………………..in Cabell County of my executors are hereby authorized to do one third part of the amount the said tract of land may sell for

Secondly, I give to my daughter Mary Gasserhart for and during her life and afterward to such children as she may have a slave named Mary and her children and their future increase and the part of the tract of land on which I now live a … to her now in possession of her husband as surveyed by William F. Styles to her and her heirs forever.

Thirdly, I give to my son John Trays one third part of the Guyandotte land or the proceeds thereof to the fourth clause of his father’s will

Fourthly I give to my son James T Trays one slave named Solmon and also that part of the tract land on which I have surveyed to him W F … on which he now lives to him and his heirs forever.

Fifthly, I give to my daughter …… Wilson one slave named Lucy and also her child and future increase for and during her life and afterwards to such children as she may have as likewise the part of the tract of land for which her husband now resides where I now live that was surveyed as one portion by the … to her and her her heirs forever.

Sixthly I give to my grand daughter Mary Jane Hansford one slave named Jane, the s….if two given her mother and also one third of the Guyandotte tract of land or the proceeds thereof if sold to her and her heirs forever

Seventhly I give to my daughter Martha Capehart a slave names Marian and her child and future increase for and during her life and afterwards to such child or children as she may have and also that portion of the tract of land on which ……. As was surveyed in the house let by ….. to her and her heirs forever

Eightly I give to my son in law John … a slave named Lewis on condition that he should pay to my executors for the use of my estate the sum of five hundred dollars

Ninthly I give to my son John Teays … to the fourth clause of his father will

Tenthly, I desire that all my just and legal debts be paid out of the residue of my estate and that the reminder of my estate be equally divided among my children and grand children the latter receiving such part as their mothers would receive were they now living.

Finally, I appoint my son James T Teays executor of this my last will and testament published and declared as such this 19th day of December, 1833.

This last will and testament of Mary Teays deceased was this day presented in court and proven my the Oaths of Philip R Thompson and Benjamin Nounan. Subscribing witnesses thereto and ordered to be recorded.

In conformity to an order of the County Court of Kanawha at their March term we the undersigned appointed appraisers of the Estate of the late Mary Teays being first duly sworn have proceeded to view and appraise the personal estate of the said Mary Teays and respectfully report as follows:

1 Negro Woman called Glory 175.00

1 Negro Mullato Boy ..don 200.00
