WILL OF TOBIAS RUFFNER

I Tobias Ruffner of the County of Kanawha State of Virginia do ordain this my last will and testament.

1st I will my soul to God to dispose of as in his infinite goodness he knows best .

2nd I will my body to my friends to be buried in a decent manner near my grand children.

3rd I give to my son Isaac the lot go ground on which he now lives as laid off by Lewis Ruffner.

4th I give to my son Silas the lot of ground next above the said Isaac’s as laid off by the same Lewis .

5th I leave all the ground from the upper line to my son Silas lot to my upper line and running back to a line running up with his back line to my upper line for the purpose of manufacturing salt.

6th I give to my son John all the remaining land above Isaac’s lot and lying between the turnpike road and Silas’ lot and the lot designed for use of the Salt works.

7th I give to my three sons, Isaac, Silas and Benjamin Franklin my two salt furnaces with the well and all other apperterinan on and with this condition they pay the sum of four thousand dollars to each of my children, Susan, John, and Jonas and that they pay to each annually after my decease the one fourth of the said legacy of four thousand dollars each and is case they shall be unable to pay the said in annual payments they shall share the period of give years to complete the payments provided they pay interest on the instalments as they become due and are anticipated.

8th I give my dwelling house, orchard, and garden to my son Benjamin Franklin after the decease of my beloved wife Mary reserving to my daughter Susan the room she now occupies during her single life.

9th I give fourthly to my three sons Isaac, Silas & _____ Franklin all the remainder of real estate after they shall have discharged my just debts to be held for the soul benefit of them and their heirs.

10th I appoint my son Isaac and my nephew Lewis Ruffner my executors of this my last will and testament who are hereby requested to receive the legacy of money hereby given to my son John and to pay to him annually the net proceeds of said …. Full power to make such …. Of said fund and they …best they requested to invest given to my …… hereby given to my son John ……

11th I … sons Isaac, Silas and Ben Franklin to … my dear wife Mary one hundred dollars during her natural life.

Witness my … & seal this 30th day of July in the year of our Lord 1834.

At a court held for Kanawha County the 10th day of November, 1834.

This last Will and Testament of Tobias Ruffner, decd was this day presented in Court and proved by the Oaths of Andrew Donnally & Lewis Ruffner wittnesses thereto and ordered to be recorded.
