WILL OF GEORGE GIVEN

In the name of God Amen: I George Given of sound mind and disposing memory but in feeble health do make and ordain this my last Will and Testament hereby revoking all other Wills.

1st my Soul I will to God and my body I desire may be restored to its Mother Earth.

2nd I will and desire that my Wife Margaret Given shall hold use and have all my Estate real, personal and mixed for and during her natural life and believing that she Will not do any thing to render the Will unalterable to those who are to take it according to the subsequent provisions of this Will at her death.

3d To my Grand Children by my son John Given namely Sophia Given and Andrew Jackson Given I give and bequeath each of them the sum of one hundred dollars to be paid out of my Estate soon after the death of my Wife.

4th And after the request to my Grand Children mentioned and set out in the 3 clause of this Will, I do hereby give bequeath and devise all the out? and? residue of my Estate real and personal and mixed to my Seven children now living to wit To William Given, Robert M Given, Adam Given, Elizabeth Young, Mary James, Nancy Given, and Margaret Given to be divided among them Share and Share alike, each taking an equal proportion and interest therein. Subject however to the following exceptions which I do hereby ordain and establish to wit, that my Son William Given shall receive one hundred dollars out of my Estate more than my Sons Robert M and Adam and my daughter Elizabeth Young. & that my daughters Mary James, Nancy Given and Margaret Given shall each receive out of my Estate the sum of Fifty Dollars more than my said Sons Robert M and Adam and my said Daughter Elizabeth Young.

5th To my Grand Son William Given (Son of my said son Adam Given) I give and bequeath the Sum of one Hundred dollars to come out of my Son Adam Givens share as before mentioned.

6th To my Grand Son Lewis James, Son of my Daughter Mary James I also give and bequeath the sum of One Hundred dollars to come out of my Daughter Mary James share as before mentioned.

7th I desire that after the death of my Wife Margaret Given my Son Robert M Given shall take immediately possession of all my estate real and personal and put the same to sale upon such times as he shall see most judicious and adviseable in order to carry out the provisions of this Will and to that end I do hereby appoint and constitute my said Son Robert M Given the Sole Executor of this my last Will and Testament to carry into effect the several provisions thereof.

In Testimony whereof I do hereunto set my hands and affix my seal at Charleston on this the 18th day of July in the year of our Lord 1853.

At a Court held for Kanawha County the 15th March 1858 The last Will & Testament of George Given decd was proved by the oath of James H Fry a Subscribing Witness thereto and is continued for further proof At a Court held aforesaid the 19th April 1858 The last Will and Testament of George Given decd was this day again presented to the Court and fully proved by the oath of Benjamin Slack a Subscribing Witness thereto and thereupon applied to be recorded
