WILL OF  THORNTON FRY

As a court held for Kanawha County at the Court House thereof on the 8th day of December 1823.

The last Will and testament of Thornton Fry Dec was this day presented in Court and proved by the oaths of James H. Fry, one of the subscribing witnesses thereto and probate thereof is granted thereof to the said James H. Fry and Joseph T. Fry therein mentioned as Exor as to the personality. And the said will is continued for further proof as to the Realty.

And at a Court held for Kanawha County at the Court House thereof on Monday the 12th January 1824. The last Will and testament of Thornton Fry deceased was this day again produced in Court and fully proved by the oath of Samuel Shrewsbury, one of the subscribing witnesses thereto and ordered to be recorded. Whereupon probate of the said will is fully granted to James H. Fry and Joseph L. Fry the Executors therein named.

I Thornton Fry of Kanawha County Being of sound and disposing memory, do make this my last will and testament.

First, I desire that all my just debts be paid off as speedily as practicable; and to that and besides my personal estate, which will be at the control of my executors, I authorize and empower them to dispose of such parts of my land, as may be necessary to discharge the same; first using the fund which may produced by the sale of that part which has been conveyed in Trust to pay a debt to William R. Cox.

2nd, All my estate both real and personal and whether legal or equitable, after the satisfaction of my debts, I devise and bequeath to my beloved wife Eliza for and during her natural life; to be used and enjoyed by her for the support and maintenance of herself and our children and after her death I devise and bequeath the same to my said children, their heirs, executors, and administrators.

But should my said wife hereafter marry then my will and desire are that my estate real and personal shall descend and be distributed in the same manner, as though I had intestate; my said wife taking that portion of my real and personal estate in the same manner and to be same extent. That she would have done if I had, made no will; and my said children to residue, them their heirs, executors and administrators.

3rd I constitute and appoint my nephews Joseph L. Fry and James H. Fry Executors of this my last will and testament.

4th I constitute and appoint my said nephew Joseph L. Fry the guardian to my said children; of the boys until the age of twenty-one and of my daughter Cornelia until the age of eighteen or marriage in case that should happen before the said age.

5th I hereby revoke all other wills by me made

This Inventory and appraisement of the Estate of Thornton Fry Decd amounting to the sum of $3,287.00 was this day produced in Court and ordered to be recorded.
