Hugh Nicholas Caldwell

Will

 

In the Name of God Amen.

I, H. N. Caldwell of the County of Craig and state of Virginia being of sound mind and disposing memory do make, ordain and publish this my last will and testament.

First:  I desire that my body be given a decent burial and that my debts be paid as soon after my decease as practical and convenient.

Second:  To my beloved daughter Narcissie Caldwell I hereby devise and bequeath Two thirds of my farm or lands that are situated on the South side of Craig’s Creek in Craig, County, Virginia and in addition thereto one bed and one milk cow.

Third:  I will to my beloved daughter Delany Craft the wife of C. G. Craft the sum five dollars in full of her part of my estate.

Fourth:  I will to my beloved daughter Louie Crawford, the wife of Alexander Crawford the sum of five dollars in full of her part of my estate.

Fifth:  I will to my beloved daughter Flora Caldwell all of the residue of my estate of every nature and kind, real personal and mixed.

Sixth:  Should my aforesaid daughter Flora Caldwell survive her said sister Narcissie and should the said Narcissie Caldwell die without issue then the estate hereby devised and bequeathed to the said Narcissie shall pass to and become vested in the said Flora Caldwell.

Seventh:  And should the said Narcissie Caldwell survive her said sister Flora and should the said Flora die without issue, then the estate hereby devised and bequeathed to the said Flora Caldwell shall pass to and be vested in the said Narcissie Caldwell.

Eighth:  At the death of the survivor Flora Caldwell or Narcissie Caldwell as the case may be, without issue then in that event the estate of the survivor that passed under this will shall go to and pass to such of my grandchildren as may then be living as the said survivor may select.

I hereby nominate and appoint Paris V. Jones, Executor of this my last will and testament.

In the Clerks Office of the Circuit Court of Craig County February 26, 1910

If appearing to me A. W. Webb Clerk of the Circuit Court of Craig County that Hugh N. Caldwell resident of said County died in said County on the 22nd day of February 1910 and a writing bearing date on the 5th day of October 1905 and purporting to be the true last will and testament of the said Hugh N. Caldwell deceased having this day been produced before me as clerk aforesaid in said Office and proceed  according to law by the oaths of H. W. Yoder and W. P. Phillips the subscrib9ng witnesses thereto; on the motion of Paris V. Jones the Executor named in said writing by his attorney, it is ordered that the said writing be and same hereby is established, probated and admitted to record as and for the true last will and testament of the said Hugh N. Caldwell, deceased.
