Waller County was created by a special act of the Thirteenth State Legislature passed April 28,1873. It was named after Edwin Waller a co-signer of the Texas Declaration of Independence. It was formed out of lands formally a part of Austin and Grimes Counties. The county seat is in Hempstead, Texas..
