ORDER TO ESTABLISH SCHOOL DISTRICT NO. SEVENTEEN.

May 12, 1902

The petition of Thirty-three taxpaying voters, came on to be heard for the laying out and establishment of a special and Independent School District, not to exceed thirty-six square miles, be and the same is hereby granted, the metes and bound of said District to be as follows, to-wit:

Beginning at a point where Mud Creek empties into Red river, running up Mud Creek to the North-east corner of the John Dukes Survey; thence with the North line of the said John Dukes Survey, to the North-west corner of the said John Dukes Survey; Thence north to the S.E. corner of the Reason Grooms Survey; Thence W. to the South-west corner of the Francis Godley Survey; Thence West to the West line of the R. C. Harris Survey; Thence W. and N. so as to take in Pete Hunter, Tom Williams and Shack Boyd just N. of where Allen Jones lives; Thence North-west from Allen Jones to the Bank of old Red River; Thence down the meandering of said River to the place of beginning; and it appearing to the court that the law has been complied with.  It is therefore ordered, adjudged and decreed by the Court that said petition be and the same is hereby granted, and that said proposed District be created and constituted and Independent School District in Bowie County, Texas, and furthermore that said District shall be known and designated as Independent School District Number Seventeen (17).

 

 

TREES ON COURT HOUSE SQUARE.

February 16, 1903

This day came on to be heard the petition of O. B. Pirkey and other citizens and qualified voters for Bowie County, for an order of the Commissioners’ Court of said County to rescind, annul, and cancel and hold for naught the order heretofore made by said Court granting permission to the Commissioner of Precinct No. Two to have cut down the beautiful Oak trees standing the South-west corner of the Court House square.

It is therefore ordered by the Court that said be and the same is hereby granted, and that the order heretofore made by this Court as above referred to be and the same is hereby revoked, annulled, cancelled and held for naught and of no force and effect.

 

 

PETITION FOR ESTABLISHING SCHOOL DISTRICT 19.

May 11, 1903

The petition of thirteen tax-paying voters and freeholders, came on to be heard for the laying out and establishment of a special and independent School District, not to exceed thirty-six square miles be and the same is hereby granted, the metes and bounds of said District to be as follows:  Commencing on the State line at the North Corporate Limit of the City of Texarkana, running thence North of said State line to the site of the old Hard Wood Mill at the foot of the Bluff; Thence due West to the Summerhill Road; Thence South along the line of said road to the North corporate line of Texarkana, Thence East along the North corporate Limits of said City to beginning; and it appearing to the Court that the law has been complied with.

It is therefore ordered, adjudged and decreed by the Court that said petition be and the same is hereby granted, and that said proposed District be created and constituted and Independent School District in Bowie County, Texas, and furthermore that said District shall be known and designated as Independent School District Number 19.

 

 

W. Y. KNIGHT, APPLICATION TO ERECT TELEPHONE LINE.

May 11th, 1903

This day came on to be heard the application of W. Y. Knight to erect and maintain a Telephone line in Bowie County, Texas, along a certain public road which leads from Spring Hill in Said County to Avery in Red River County, along so much of said road as is situated in Bowie County.  It is therefore ordered by the Court that said application be granted in the terms of his application with a privilege of using said right-of-way of said public road to erect and maintain a Telephone line so as not to injure and impair the travel of said public road to the detriment of the public travel along said public highway.

 

 

JUDGMENT ON SCHOOL DISTRICT NO. 17.  CHANGING LINE.

June 1, 1903

It appearing to the Court that all the patrons of Liberty Hill School residing in the following described territory, beginning at the W.B. Line of the Jas. Cowley H.R. Survey on Mud Creek; Thence up said creek with its meanders and with the South prong of said Mud creek to the E.B. line of the Geo. Vaughan tract of land in the Jno. Tisdale League Survey; Thence North with said E.B. line to the North prong of said Mud Creek; Thence up said North prong to Cold branch and up said branch to the S.B.line of said School District No.17 as it now is and with the S.B.line of said District to the place of beginning.  Desired that said above described territory be included in said School District No. 17, and it appearing to the Court that there was no objections of and by the parties affected by the change aforesaid by the evidence of Messrs. W. J. Johns and J. T. Wheeler.  It is therefore ordered and adjudged by the Court, all the members being present, that the lines of District No. 17 be changed in accordance with the above described field notes.

 

 

PROHIBITION ORDER FOR ELECTION IN BOWIE COUNTY.

August 12th, 1903.

On this day came on to be considered the petition of over Two Hundred and Fifty qualified voters of Bowie County, Texas, for an Election to determine whether or not the sale of intoxicating liquors shall be prohibited in said Bowie County, Texas; and it appearing to the Court that said petition is in due form, and has the required number of signers thereto.

It is therefore ordered that an Election be held on Thursday the Twenty-seventh day of August, A. D. 1903, at the regular voting places within and for Bowie County, for the purpose of determining whether or not the sale of intoxicating Liquors shall be prohibited in said Bowie County, Texas, and the Clerk of this Court is hereby ordered to give notice of said Election as required by law.

 

 

TO ESTABLISH SCHOOL DISTRICT NO. 23 AT ANTIOCH SCHOOL HOUSE.

August 10th, 1903

            The petition of J. G. Collom and thirty-seven other freeholders and voters, came on to be heard for the laying out and establishment of a special and independent School District not to exceed thirty-six square miles be and the same is hereby granted, the metes and bounds of said District to be as follows:  Beginning at the centre of the track of the t. C. division of the T. & P. Railway immediately North of the North East corner of the William H. Fore h. R. Survey (marked William H. Fort on map), Thence South to his North-east corner Thence South to the South-east corner of same; Thence W. to S.W. cor. Thence South to N. W. corner of Joe Read, East to n. E. corner; Thence South to S. E. corner of same; Thence W. to S.W. cor of same; Thence South to S.E. corner of the G. W. tiller H. R. Survey; Thence West to the N. W. corner of the Wm. Young Sur., Thence S. to S.W. corner of same, Thence East to N.W. corner of W. D. Shockley Survey, Thence West to the N. W. corner of same; Thence South with the W.B. line of said Shockley Sur. To a stake on the N.B. line of the h. P. White Survey to the S.W. corner of the same on the E.B. line of the John A. Read Survey, Thence North with the E.B. line of said Read and the E.B. line of the Collin M. Akin to a corner of said Collin M. Akin on the S.B. line of the Chas. Collom Survey; Thence West to the Southwest corner of the Chas. Collom Survey; Thence north with the line of Chas. Collom to a corner of same on the S.B. line of the Johnathan Collom Survey; Thence East to the South East corner of said Johnathan Collom Survey, Thence North with his line to the centre of the T. C. Division of the T. & P. Ry. To the centre of the track; Thence East between the rails of said railway to the place of beginning; and it appearing to the Court that the law has been complied with.  It is therefore ordered, adjudged and decreed by the Court that said petition be and the same is hereby granted, and that said proposed territory and district be created and constituted into an Independent School District in Bowie County, Texas, and furthermore that said District shall be known, and designated as Independent School District Number Twenty-three in said Bowie County.

 

 

PETITION ASKING COUNTY TO PURCHASE BLOOD-HOUNDS.

February 9th, 1904.

This day came on to be heard and considered the petition of C. D. Wyse and others praying for an order of this Court be entered authorizing the purchase of a pair of Blood-Hounds for the use and benefit of the County.

It is therefore ordered and adjudged by the Court that said petition be and the same is hereby granted, and that the County Judge of this County be ordered to advertise in the Dallas News a newspaper published in this State, for the purchase of a pair of Blood-Hounds.

 

 

JANITOR’S SALARY

August 11th, 1904

            It is ordered by the Court, that the wages of the janitor, be fixed at the sum of Twenty-five ($25.00) Dollars per Month from this quarter forward, for one year from this date, or during good behavior.

 

          

PUBLIC IMPROVEMENT

August 15th, 1904.

This day came on before the Court the proposition to advertise and get bids for the sinking of an Artesian Well at the County Court House in Boston.  It is ordered by the Court that the County Judge be authorized and he is hereby instructed to advertise for some person or a Well-drilling Company to drill an Artesian Well a the Court House, and the Contract therefore to be made with the Commissioners’ Court.

Court met in regular session, Present & presiding A. S. Watlington County Judge, B. C. Vandeweghe Comm. Precinct No. 1; J. F. Collins Commissioner precinct No. 2; L. E. Harkey, Commissioner precinct No. 3; Geo. H. Welch Commissioner Precinct No. 4, when the following business was

It appearing to the Court, that the water supply for the use of the Court House & jail is very limited, and that several and divers persons & families are using & hauling water from the reservoir at the Jail built by the County for the use of the Court House and jail, and that some of said parties have continued to haul water from said Reservoir and are still hauling water therefrom after having requested to desist from doing so by some of the officers, and it further appearing to the Court that the supply is insufficient for any other purpose except to supply the actual water necessary for the Court House and Jail so that the sanitary condition of the jail may be kept in the best condition possible.

It is therefore ordered by the Court, that the sheriff be and he is hereby ordered to employ the services of a good carpenter and have a sufficient top placed over the reservoir or receptacle at the jail in which the water piped from the water works is caught, with a door and lock & key and the Sheriff is hereby ordered to permit no one to use said water for any purposes except for the use of the Court House and Jail and to keep the door to the said reservoir locked at all times.

 

 

RESOLUTION

            This the November Term, 1904 of the Commissioners Court of Bowie County, Texas, expiring our term of offices, and the majority of us having served Bowie County in the capacity of County Commission for four years, and having been presiding over during that time by Hon. A. S. Watlington, serving in the capacity of County Judge, we desire to express our sincere appreciation to him for his courtesies to us both individually and a a Court officer;  Therefore be it resolved that in retiring from office we desire to express our appreciation to him for his untiring labors and efficient service in performing the duties of presiding officer of the said Commissioners’ Court; and it is with unbound pleasure and satisfaction that we feel able to un-reservedly endorse his entire Administration.  We ask that these resolutions be incorporated in the minutes of this Court, and that the Clerk of this Court furnish the Hon. A. S. Watlington with a certified copy of same.

ORDER FOR ABSTRACT BOOKS.

            It appearing to the Commissioners Court that the Assessors Abstract Books belonging to Bowie County are now in possession of certain parties in Texarkana Texas, and that said books are the property of Bowie County, Texas,  It is ordered by the Court that the Sheriff of this County is hereby instructed to call on the parties who now have possession of said books and the Sheriff is instructed to have said books at the Court house, and to make report to the December Term of this Court to be held at Boston on the 19th day of December A. D. 1904.

 

 

COMMITTEE TO PURCHASE CONVICT FARM

October 19th, 1904

            It is ordered by the Court that a Committee of James Martindale, N. J. Rachel, Joe Telford, and Henry Brooks be are hereby appointed to confer with land owners thoughout the County for the purpose of ascertaining the value, location with a view of purchasing not less than 200 acres of land to be used as a County Convict farm and said committee is instructed to report to this Court at a special meeting to be held Jany 3rd 1905.

 

 

ORDER DIRECTING SHERIFF TO WORK CONVICTS.

            It is ordered by the Court that all prisoners who are convicted of misdemeanors and are unable to pay their fines and costs assessed against them, and who fail to have convict bonds made for them be turned over to the Sheriff of Bowie County and by him conveyed to the Co. Jail at Boston, and the Sheriff of this County is further directed, that whenever a sufficient number of such prisoners may be confined in said jail and who are unable to pay their fines and costs the Sheriff is directed to employ a guard or guards, and to purchase such implements as may be necessary and employ such convicts as he may see fit on the County property in and around the County Court House.  We suggest and recommend that such convicts be employed in cleaning off and cleaning out the Bowie County Well and that a ditch from the Jail to the Spring be dug under the supervision and direction of the Sheriff and that when practical and expedient that the force be employed in cutting wood and clearing up the County poor farm.  We respectfully ask of the Co. and Precinct officers who may be entitled to costs in cases where parties have been convicted and are unable to pay their fines and costs or to make bonds, That they make as liberal allowances in favor of the County as is comparable with the exigencies of the occasion and the County Judge is instructed to confer with such Officers and to report their decision to the next term o this Court which meets Jany 3rd 1905.

ORDER AUTHORIZING CO. PHYSICIAN TO QUARANTINE.

            In the Commissioners Court Bowie County, Texas:  Whereas, the prevalence of yellow fever in Louisiana seriously threatens the health of our citizens, Now Therefore in order to prevent the spread of such dangerous and contagious disease among our people we authorize and empower our County Physician, Dr. C. P. Helms to declare quarantine against any place or places and against all such dangerous diseases, to Establish, maintain and supply stations for those held in quarantine, to provide hospitals, tents or pest houses for those sick of contagious and infectious diseases; to furnish provisions, medicine and all other things absolutely essential for the comfort for the well and the convalescence of the sick.

            We respectfully suggest to our said County Physician the advisability of issuing a proclamation, calling upon all the citizens of the County to clean up around their premises, to drain all stagnant water off of their lots or premises and to spread oil on all water that cannot be drained off.  It is now considered by the highest medical authority that the spread of this dreadful disease is caused solely by the mosquito, and the efforts of all citizens should be directed to the necessity of eradicating the cause of this evil.

 

 

ORDER OF THE COMMISSIONERS COURT OF BOWIE COUNTY, TEXAS, declaring the result of the election held in said County on September 23rd, 1905 in accordance with law to determine whether or not the sale of intoxicating liquors shall be prohibited in said County.

            On this the 5th day of October A. D. 1905 the Commissioner’s Court of Bowie County, and State of Texas, met in Special Session, present and presiding the Hon Sam H. Smelser County Judge of said bowie County and also present James Martindale Commissioner of Precinct No. 1; N. J. Rachel, Commissioner of Precinct No. Two; Joe Telford commissioner of Precinct No. Three and Henry Brooks, Commissioner of Precinct No. 4 for the purpose of opening the polls and counting the votes cast at the election held in and for said County at the regular Voting boxes thereof on the 23rd day of September A. D. 1905 to determine where or not the sale of intoxicating liquors shall be prohibited in Bowie County, Texas, and the said Court having opened the polls and counted the votes at the said Election;  It appears and the Court finds that there were cast in the said election Twenty five hundred and Eighty-five (2585) votes of which number 1164 votes were cast for prohibition and 1421 votes were cast against prohibition.  It is therefore declared by the Court that the result of said vote and election is that a majority of 257 votes were cast at said election were cast against prohibition.  We therefore declare in accordance with said result that the sale of intoxicating liquors in Bowie County is not prohibited.

 

 

RESOLUTION PASSED BY COURT, IN REFERENCE TO DEATH OF MRS. SOPHIA CARMICHAEL

 

WHEREAS It has come to the knowledge of the Commmissioners’ Court of Bowie County, Texas, that Mrs. Sophia Carmichael of this County ahs departed this life, and

            WHEREAS, during her life she rendered valuable and appreciated help to this Court in caring for the poor of the County, assisting and aiding the destitute, and clothing and feeding the friendless and unfortunate and

            WHEREAS In the death of Mrs. Carmichael, the poor, friendless and unfortunate of our County have lost their best Friend, Our County has lost a noble Christian and self-Sacrificing woman, and the City of Texarkana its foremost spirit in charitable work.

            THEREFORE, as a humble testament of our appreciation of our deceased sister, and the work she did while living, we direct that a copy of this be spread upon the minutes of the Commissioners Court of this County, and a copy hereof be forwarded to the husband of the deceased and that the newspapers of the County be requested to publish the same.

Feb 14th, 1906.  It appearing to the Court that the water trough at the jail has become worn and damaged to the extent that it is necessary to build a new one.  It is the order of the Court that N. J. Rachel be empowered, and he is hereby ordered to have a new one made.

 

ORDER OF COURT TO ESTABLISH CONVICT FARM, ADOPTED FEB 15TH, 1905

            It is ordered by the Commissioners Court of Bowie County, That there be established for Bowie County a Convict Farm, on which shall be kept all prisoners convicted of misdemeanors and who are unable to pay their fine and costs assessed against them; or who have been sentenced to a term of imprisonment in the County Jail by the County Court of this County, as a punishment for crime,

            It is further ordered by the Court that such convict farm be under such rules and regulations as may prescribed from time to time by the Commissioners Court.

PETITION FOR DIVISION OF SCHOOL DIST 46 & TO ESTABLISH NO. 11

May 17th, 1907.

            On this day came on to be heard the petition of W. A. Simpson, et al for a division of School District No. 46, and to establish School Dist No. 11, in the North part of same, and that school District No. 46 be known, and described by the metes and bounds as follows:  Beginning at Mud Creek on the W. line of the David Jarrett Survey; Thence N.E. with the meanders of said Creek to the E.line of said David Jarrett Survey; Thence S. with said E.line to S.W. corner of the John Duke Survey; Thence East with the North boundary of Secs No. 42 and 40 to the S.E. corner of Section No. 42; Thence South with the E. boundary line of Section No. 40 to N.E. corner of Section 39; Thence due East across the Jas N. Smith Survey and across the W. D. Ellis Survey to the E. line of the N. D. Ellis Survey, Thence South, West, North, West, North, East and North with the original Survey or boundary of the Daniels School District No. 46 in Bowie Co. to the place of the beginning.

            It is further ordered by the Court, that the North part of District No. 46, which is not included in the field notes above be, and is hereby designated as Wood Stock School District No. 11, and shall form no part of District No. 46, in the future.

          

 

TRUSTEE ELECTION

            Be it remembered that on the 7th day of April, 1906 an election was duly and legally held throughout Bowie County, for the purpose of electing School Trustees, and returns having been made thereof according to law, the Commissioners Court of Bowie County proceeded to open and canvas said returns and doth find and declare that in School Districts No. 41, 30 and 3 there was a tie, therefore no election, and we further find that the following named Trustees were elected in their respective Districts, to-wit:

            It is therefore ordered, adjudged and decreed by the Court that the above named parties be, and are hereby declared duly elected as Trustees of their respective Districts, and that commissions issue to them, upon their taking the Oath of Office, as required by law.

            It appearing to the Court upon the canvas of the returns in School Districts Nos 3, 30 and 41, that there was a tie at said election, hence no one elected to serve as Trustee in said Districts.

            It is therefore ordered, adjudged and decreed by the Court that an election be held on the 9th day of June, 1906, for the purpose of electing Trustees in the following Districts at the places herein named, with managers as follows to-wit:

School District No. 3 at Red Springs School House, managers W. G. Points, W. J. Henry and G. W. Akin

School District No. 30 at Cooley School House, managers T. F. Cowley, J. W. McAnally, J. H. Goodnight

School District No. 41 at Morris School House, managers C. H. Moores, W. W. Ames, W. F. Harvey

            Upon examination the Court finds that there have been no returns for the following districts, to-wit:  Dist Nos 2-5-6-11-13-14-16-19-21-26-27-22-45-47-48-50-53 & 59, therefore no action is taken by the Court, in regards to said Districts, or Trustees therefore.

 

 

May 28th, 1906

            It appearing to the Court that an order made in this Court on May the 16th 1906, made at a former session of this court, upon the petition of W. A. Simpson and others, granting, and ordering a division of School District No. 46, and establishing School District No. 11, was made contrary to law, and should be revoked.  It is therefore the order of the Court that said order be revoked and held for naught, and it is so ordered.

 

ORDER IN REFERENCE TO SURVEY OF CO. LINE

To the Hon Commissioners Court of Red River County, ---GREETING:---

            From time to time for several years complaints have been made to this Court by Citizens of Bowie County, of the inability to locate the boundary lines between the Counties of Red River and Bowie; and so pronounced has become the demand for a re-survey of the County line between said Counties that we do not deem it advisable to longer ignore them.

            Therefore we respectfully ask of the Commissioners Court of Red River county an expression as to the desirability of a re-survey of the said County lines on their part, and respectfully ask that they give us their views in writing, accompanied by any suggestion of any fact pertaining thereto, as they see fit.

            The Clerk of this Court is requested to transmit to the Commissioners Court of Red River County a certified copy of this order.

 

ORDER PERTAINING TO SULPHUR BRIDGE

Aug 15th 1906

            It having been made known to the Commissioners Court of Bowie County, Texas that the people of Morris County, Texas, and the People of the West end of Bowie County, are discussing the advisability of building a bridge across the Sulphur River between Bowie and Morris Counties; and it having been made known to this Court that the County of Morris is willing to co-operate with Bowie in Building same and to bear its just proportion of the expense thereof.  It is the sense of the Commissioners Court of Bowie county, that we favor the building of said bridge, provided satisfactory arrangements can be made with Morris County, and for the purpose of ascertaining the sense of the Morris County people we hereby nominate Constitute and appoint Hon Henry Brooks, Commissioner of Precinct No. Four, a suitable person to confer with our brethren in Morris County represented by their Hon Commissioners Court.

            It shall be the duty of the said Henry Brooks to ascertain

            1st, Whether or not the said Morris County is Willing to co-operate with Bowie in the building of said bridge

            2nd, If so, where, and at what place on Sulphur should said bridge be built, and the probable cost thereof

            3rd, What proportion of the cost thereof is the County of Morris willing to bear

            4th, The Clerk of this Court is instructed to furnish the said Brooks with a copy of this order, and he is instructed to report to this Court not later than Nov 15th, 1906.
