Transcript of Indenture & Deed located at Oneida County Court House for Peter Bork

This indenture made the first day of June A. D. 1839 between Cornelius Van Rensselaer of the county of Renssealaer & Maria Louisa, his wife, by Heman C. Whelpley, their attorney of the first part, and PETER BORK of the town of Lee, county of Oneida & state aforesaid of the second part, witnesseth that whereas by a certain indenture made the first day of October A. D. 1811, between George Clinton, Esq. of the state of New York by James Sherman, his attorney of the first part, and Thomas Gadd of Western in the county of Oneida & state aforesaid of the second part the said George Clinton did for the consideration therein expressed, demise, bargain, sell, alien, release and confirm unto the said Thomas Gadd, his heirs and assigns, forever all that certain piece or parcel of land situate in the county of Oneida aforesaid being part of lot number 17 of the tract commonly called Fonda's Patent which said premises are described in said indenture by meters and bounds and said to contain one hundred & sixteen acres of land be the same more or less and of which the premises hereinafter described proved a part. To have and to hold the said piece or parcel of land to the said Thomas Gadd, his heirs and assigns forever, yielding and paying therefore yearly and every year from and after the first day of May A D. 1809 unto the said party of the first part, his heirs and assigns, the yearly rent of twenty nine bushels of good, merchantable, clean winter wheat in and upon the first day of May in each and every year to be delivered in the City of Albany,

And whereas the said George Clinton, the grantor in said indenture mentioned, has since died and on the divison of his estate the above demised & described premises fell to the share of Cornelia T. Ganet, daughter of the said George Clinton & wife of Edmund C. Genet of Greenbush, Rensellaer county.

And whereas the said Cornelia T. Genet is since deceased and on the division of her estate which the inherited from her father, the said George Clinton, deceased, the above demised premises fell to the share of her daughter, Maria Louise Genet now the wife of Cornelius Van Rensselaer, who thereupon became legally entitled to the reversionary interest in the above described premises and to receive the rents reserved in and by the said indenture and to the performance of all the covenants contained in said lease to be performed by the said party of the second part, his heirs and assigns.

And whereas the said Thomas Gadd has assigned the said lease and the land & premises therein demised have in separate parcels become the property of different individuals of whom Peter Bork, the grantee herein after named, is one.

Now in consideration of the said premises and of the sum of ninety-nine dollars and sixty cents to us in hand paid by the said Peter Bork, the receipt whereof is hereby acknowledged, the said parties of the first part for their heirs and assigns hath remised, released, discharged and quit-claimed and by there presents doth remise, release, discharge and quit-claim unto the said Peter Bork, his heirs and assigns forever. all and singular the rent and rents reserved and made payable in and by the above described indenture to the said George Clinton his heirs & assigns for out of, or on account of, the following described part of said demised premises, viz.,

Beginning at a point on the westerly line of said lot No. 17, and in the centre of the road leading westerly from Joseph A. Clark's tavern, thence along said west line North 1"degrees 30 minutes West 21 chains 90 links to a stake;

Thence easterly along a line parallel to said road of 9 chains 12 links to the centre of the canal turnpike road;

Thence along the centre of the canal turnpike road 1degree 30 minutes east 21 chains 90 links to the centre of the road first above mentioned;

& Thence westerly along the center of said road 9 chains 17 links to the place of beginning containing 19 & 98/100 acres of land.

And also all & singular the reservations, conditions, covenants & provisions in the above described indenture contained & on the part of the said Thomas Gadd, his heirs and assigns, or any or either of them to be performed, fulfilled and kept.

And also all the estate, right, title, interest, claim & demand whatsoever at law or in equity of the parties of the first part, their heirs & assigns of in and to the above described & hereby demisedpremises.

And the said parties of the first part hereby covenant to and with the said Peter Bork, his heirs & assigns, that the parties of the first part hath not done, suffered or permitted any thing to encumber the premises hereby converyed.

To have and to hold the land & premises above described and hereby released and conveyed to the said Peter Bork, his heirs & assigns to and for the sole and only proper use, benefit and behoof of the said Peter Bork his heirs & assigns forever.
