Benjamin Graves Will

I Benjamin Graves of the county of Wilson and state of
Tennessee, being of
sound mind, do make and publish this my last will and hereby
revoke all
others made by me heretofor. 1st. It is my will that all of my
just debts
(which I may be oweing at the time of my death) be paid out of
the money I
may have at the time of my death; and if I should not have a
sufficiency of
money on hand at the time of my death to pay all my just debts
and burial
expenses, then it is my will that a sufficiency of the crop on
hand at the
time of death be sold to provide for the above ___; 2nd. I give
to my
beloved wife Mildred Graves all my crops and stock and all the
money, notes
and accounts, household and kitchen furniture and all my
perishable property
not mentioned above, and the use of my farm and all my negroes. (after
complying with the first item in this will) as long as she may
live single;
but if she should marry again, then it is my will that all my
perishable
property be sold and the proceeds divided as herein provided for;
3rd. It
is my will that any negroes be sold as well as any perishable
property in the
event of my wife marring after my death; 4th. It is my will that
the
proceeds of the sale of all my property be equally divided amoung
all my
children and my wife, except my daughter Ann Jones, and my two
grandchildren
Fountain Hester and Savannah Richard Hester, who are provided for
as follows.
(to wit) 1st. It is my will and I do direct that my daughter Ann
Jones shall
have the interest accruing from her portion of my estate, (which
shall be
equal with that of any other children) yearly during her natural
life and at
her death the principle to be equally divided amoungest the heirs
of her body
that may be living; 2nd. It is my will my two grandsons Fountain
Hester and
Savannah Richard have one share of estate equally divided between
them. 3rd.
Should the stock ____ at anytime beyond the desire of my wife she
is hereby
authorized to sell such as she may not desire to keep and divide
the proceeds
equally as above provided for; 6th. Should my wife not marry
again, then it
is my will that all my land, negroes and property of every
description be
sold and the proceeds divided amoung all my children as above
provided for.

14 day of
March in the year of our Lord one thousand eight hundred and
fifty-six.
