October Term 1837

In the name of God Amen, I, John H. Everett having the peace of God before my eyes and the infirmities of age, Being in my proper mind and sound ______, make this my last will and Testament. After giving my Soul to that God that gave it, after paying all my just debts, I give and bequeath my earthly goods, ______ des________ together with all the land I own to my beloved wife Sarah Everett during her natural life to use and enjoy at her pleasure - I give ______ to my son Thomas E. Everett one hundred acres of land including the house and plantation where I now live, also a tract of land deeded to me by Peter Walker. Beginning an said tract of land on the West boundary line south to include the lower field on the creek and ____ east to the west boundary line of the tract on which I now live. Which he is to have at the death of his mother. Should the above mentioned land be more than His portion he shall pay the other heirs the balance if he wishes to keep the land, if not he may have it all sold and the money equally divided. I also give him all the debts due me. All the balance of my land to be divided at the death of my companion and the money to be divided equally between the rest of my children. The balance of all my property to be sold and the money divided equally between all my children: Charlotte Freeman, Joel D. Everett, Susan H. Curd, Thomas E. Everett and Eliza L. Everett.

Peter Walker to be supported out of the estate as long as my companion lives. Should he be the longest lived, my children shall bear an equal portion in his support during his life.

I appoint my son Thomas E. Everett my executor.

Given under my hand and seal this 13th day of September 1837.
