I Samuel Wallace of the County of Sumner State of Tennessee being of sound mind and disposing memory do therefore make ordain publish and declare this to be my last Will and Testament.

First; I direct all my lawful debts to be paid

Second; I direct that my Executor to carry out and d? and perform all that I have expressed in deed and bequest to Chaney Bracken.

Third; I direct that William Bracken and Abram Wallace both Colored who have been faithful in their attentions and services and nurseing(sic) to & of me shall have the use and possession for three years (pg 223) from the 1st. day of January 1882 of all of the Allen Tract bounded West by the Louisville & Nashville R Rd track East by the Creek South by the lands of Stone North by my old homestead and to have the use of the land between 55 & 60 acres free of any charge. My Executor pay taxes out of my Estate, I direct further that William Brackeer & Abram Wallace shall have choice of land to rent any where on my place as much as they can cultivate well at one 50/100 Dollars per acre, and to have this choice & priviledge(sic) for three years from January 1, 1882. My Executor will execute this.

Fourth; I direct that the remainder of my estate both real and personal be divided among my heirs according to the laws of the State of Tennessee now in force, none preferred none discriminated against.

Fifth; I desire and direct that no portion of my estate shall be subject to any supervision of or liability to any Court whatever.

Sixth; I hereby appoint my long tried and faithful friend James Alexander my Executor to take charge of my Entire Estate and execute this my last will and testament and to do so without any bond or any liability for errors and defects, either to my heirs, or to any Court, relying upon his integrity and judement(sic) entirely.

In witness whereof I have hereunto subscribed my name and affixed my seal this the 21st of July 1881.

The above written instrument was subscribed by the said Samuel Wallace in our presence and acknowledged by him to each of us, and he at the same time published and declared the above instrument so subscribed to be his last Will and testament and we at the testator request and in his presence have signed our names as witnesses hereto and written (pg 224) opposite our names our respective residence this July 21st 1881

Sumner County Court November Term 1881.
The last Will and Testament of Samuel Wallace, deceased, was this day produced in open Court for probate and was duly proven by the oaths of James A. Wemyss and Thos. M. Woodson subscribing witnesses thereto which is received by the Court and ordered to be recorded and James Alexander the Executor named in the Will appeared in open Court and accepted the execution of the same, no bond and security being required under the will he was duly qualified.

NOTE: The Chaney Bracken could be Chainy Bracin* 58(B) widow, Robert 15 (B) her son listed as brother to William (136). she is listed as widow and Domestic Sevt. also the mother of William Wallace (B) with his family also in the household of Samuel Wallace age 81. The Abram Wallace(B) is also listed on the same page (136) of the 1880 census but different household with his family. per J. Price
