Sumner County, Wills Vol. 5, page 162 I, Charles Fulks of 15th District Sumner County Tenn. do hereby make publish and declare this my last Will and Testament. 1st. I direct my Executors here in after named to pay my funeral expenses and all my just debts and liabilities and collect all due ma as soon as can conveniently be done after my death. 2nd. I give and bequeath to my wife Elizabeth Fulks during her natural life my home place of 158 acres, and all my horses, cattle, sheep, hogs, fowls, wagon, buggy and all harness, farming utensils of ever kind and all the produce that may be on my place and should there be any money left she is to have it, also all my house hold and kitchen furniture of every kind. 3rd. I give bequeath and devise to my son Charles E. Fulks the North end of the tract of land known as the Bowling land. Beginning at the North West corner, running South with Turnpike to an East and West cross fence at the end of a pailing fence running East with said cross fence to John Hester's, West line, 50 acres more or less. 4th. I give bequeath and devise to my daughter Nannie M. Luton and her body heirs my home place of 158 acres which she is to have after the death of my wife Elizabeth Fulks. 5th. I give bequeath and devise to my daughter Martha J. Payne, children, the South end of the Bowling place, and that they are to pay what I have paid for them which is a little more than one hundred and twenty dollars and if not paid by them the land must be sold to pay it. 6th. I give bequeath and devise to my grand children Susan Elks, Madora Hale, Laura Oals, Thomas Shepard, the tract of land known as the Samuel Hester land, to be equally divided between them, and that they are to pay three dollars 50 acres more or less. 7th. I give and bequeath to my grand children, James Hale, Charles Hale, Sallie Wilkinson one dollar to each of them. 8th. I hereby nominate constitute and appoint my wife Elizabeth Fulks my Executrix and my son Charles E. Fulks Executor of this my last Will and [pg 163] Testament and that they act as such without giving bond. In witness whereof I here unto subscribe my name and affix my seal. This the 26th day of October 1897. his Charles X Fulks mark Signed, seal, published and declared as and for his last Will and Testament by the above named Testator, in our presence, who have at his request and in his presence and in the prence of each other signed our names as witnesses thereto. Witnesses R. C. Searcy. W. J. Searcy. State of Tennessee Sumner County Court November Term Nov. 18th 1897. A paper writing purporting to be the last Will and Testament of Charles Fulks deceased was this day presented in open Court for probate when the same was duly proven by the oaths of R. C. Searcy and W. J. Searcy subscribing witnesses thereto, when the same was ordered filed and recorded as the last Will and Testament of Charles Fulks deceased. And Mrs. Elizabeth Fulks and Chas E. Fulks thereof without bond, accepted said appointment and were duly qualified and letters testamentary ordered issued to them. A true copy Harris Brown Clk.
