Knowing the certainly of death and the uncertainty of Life and being desirious to provide for those who are near and dear to me on earth, I do constitute this my last Will and testament, revoking all orthers here tofore made.

1st It is my will that after my death that my burial expences and that all my debts that I may owe be paid out of the first money belonging to my estate.

2nd I will that after my death that my wife Sarah Joyner have the full use and accupatition and all profit that may arise from my landed estate to rent out or cullivate as she may think best, without charge or rent being required of her for her support & benefit during her natural life and at her death to revert to my estate again.

3rd I also will that my wife Sarah Joyner have the full use and benefit of all my personal property, that I may die possest of. every description for her use and benefit. I further will that at my death that my personal propert be valved by two disinterested men and at her death for her estate to be return or pay back to my estate the amount of the valuation of the personal property. But she is to have the full use of it during her natural life without charge or interest.

4th I will that after my wife death and all the property that I die possessed of revert back to my estate both real and personal. That it all be sold and the money arising from the sale of the property be equally divided between my four children to wit: Emily Jackson & her children, Amanda Prirce and her children, William M. Joyner and Thomas H. Joyner.

5th I will and appoint Thos H. Joyner and George W. Terry,Sr. as Executors to this my last will to carry out the provisions this 6th day of Oct 1870

The last will and testament of Hugh Joyner deceased, was this day produced in open Court for probate and was duly proven by the oaths of James T. Talley and Geo S. Watson subscribing witnesses thereto, which was received by the Court, and ordered to be recorded. Thereupon Geo. W. Terry and Thos. H. Joyner the executors named in the will appeared in open Court together with W. H. Joyner and W. N. Carter their securities and entered into and acknowledged their Bond to the State of Tennessee in the penal sum of Two thousand dollars, conditioned as the law requires and the aforesaid was duly qualified, and the Clerk of this Court will issue to them letters Testamentary.

NOTE: Hugh Joyner married Peter Bysor's widow, Sally Edmond Saunders.He was b.23 Jan 1805 and d.19 Oct 1885. Burial: Hendersonville Presbyterian Church yard.
