In the name of God Amen. I, Burrill Driver of Sumner County, Tennessee, being of sound mind and disposing memory do make and publish this as my last will and testament, hereby revoking and making void any and all other wills heretofore at any time, made by me.

Item 1. I desire all my just debts to be paid by Executor as soon as practicable after my death.

Item 2. I give and bequeath to Willie Lovell, a son of Martha Lovell of Nashville Tennessee, the sum of Two Hundred Dollars.

Item 3. I give and bequeath to Maggie Lovell a daughter of Martha Lovell of Nashville Tennessee the sum of One Hundred Dollars, to her sole and separate use, free from the debts, contracts and control of any husband she may have.

Item 4. I give and bequeath to Lizzie Lovell a daughter of Martha Lovell of Nashville Tennessee, the sum of Five Hundred Dollars to her sole and separate use, free from the debts, contracts and control of any husband she may have.

Item 5. I give and bequeath to Josie Bailiff, a daughter of Mary Bailiff of DeKalb County Tennessee the sum of Five Hundred Dollars, to her sole and separate use, free from the debts, contracts and control of any husband she may have.

Item 6. I give and devise to my nephew, Burrill Driver, of DeKalb County Tennessee, my farm on Carter's branch in Macon County Tennessee, Known as the Jo. Carter farm, containing eighty acres, more or less.

Item 7. I give and bequeath to Martha Lovell of Nashville Tenn. all of my deceased wife Elizabeth 's bed-quilts and one bed and bed clothing for same, and I also give and bequeath to the said Martha Lovell the sum of Three Hundred Dollars, provided she survives me, but if she should die before I do, then said bequest of three hundred dollars shall be void and of no effect and said three hundred dollars will pass under the 8th item of this will to Maggie Reynolds.

Item 8. All the rest and residue of my estate, real and [pg 104] personal, of every kind and description, I give, bequeath and devise to Maggie Reynolds, a daughter of Authur Reynolds of Mississippi to her sole and separate use.

I appoint Thomas H. King Senior of Gallatin Tennessee the executor of my last will and testament. All interlineations were made before signing. Witness my hand at Gallatin this the 31st day of May 1895.

Witnessed by us in the presence of and at the request of the testator and after his name was signed to the foregoing instrument.

Sumner County Court July Term July 30th 1895.
A paper writing purporting to be the last Will and testament of Burrill Driver dec'd, was this day produced in open Court for probate, when the same was duly proven by the oath of R. E. House and W. Witherspoon the subscribing witnesses thereto, when said paper writing was ordered filed and recorded as said last Will and Testament of Burrill Driver deceased.
