In the name of God Amen I Thomas Patton of the County of Sumner and state of Tennessee being weak in body but of sound and perfect mind and memory blessed be Almighty God for the same calling to mind the mortality of my body and knowing that it is appointed for all men once to die I make and ordain this my last will and testament that is to say simpally and first of all I give my soul to God who gave it and my body to be buried in decent and Christian burial at the discretion of my Executors and as touching such worldly estate wherewith it hath pleased God to bless me in this life I give demise and dispose of the same in manner and form following that is to say first of all I will that my just debts be paid all I give and bequeath unto Sarah my wife all my house hold furniture farm and farming interest together with all my horses cows sheep and hogs or as many of them as she Executors shall think not advisable to keep during the time of her widowhood also I will that my wife Sarah shall have the plantation whereon we now live as Surveyed by Joseph Robb to contain one hundred acres during her widowhood then said lot or piece of land to fall to my son John Bailey Patton and then my younger children to live with their mother until they marry and said lot of land that is to say one hundred acres be it more or less to fall to John Bailey at his mothers death or marriage and I further will that if the said John Bailey shall die leaving no issue that the land shall be sold on a audit at the discretion of the executors and the money from thence ausing to be equally divided among my daughters or should one or more of the decease before that time for it to be given to their children then living And also I will and bequeath unto my son William Patton the place whereon he now lives as laid off by Joseph Robb to contain eighty acres be it more or less and no more And those who have married that is to my Elizabeth Ormond, Jane Vinson, Mary Anderson, Sarah Gregory, Lena Oats and Lucretia Higgason to be quite satisfied with what they have received until the death or marriage of their mother then for the money or property that may then in be hand to equally divided among all my daughters should any one or more of them dies inversion to their mothers death or marriage I will that their part shall be kept by some good person whom the executors shall choose until the children shall come of age or to be disposed of for the benefit of the surviving children and I also will the then my younger children that is to say Lucinda Patton and John Bailey Patton to have as much at their mothers death or marriage or when they shall become of age twenty one years as any one of their brothers or sisters with the increase And I hearby make and ordain my trust friends John Hamilton and David Ormond and Jacob Hardy shall Executors of this my last will and testament In witness whereof I have hereunto set my hand and seal this six day of October in the year of our lord one thousand eight hundred and eighteen.

State of Tennessee
Sumner County Court August term 1819

The last will and testament of Thomas Patton dec. was presented in court and duly approved by the oath of John Rutherford a subscribing witness there to and said will having been proved at previous day of this term by the oath of Robert M. Boyers another subscribing witness where upon said will is ordered to be recorded and at the same time John Hamilton and Jacob Hardy two of the executors named in said will appeared in court and qualified as such by taking oath of an executors as prescribed by law and therefore said John Hamilton and Jacob Hardy shall with John Rutherford their security entered into and acknowledged their bond to the Governor in the penalty of five thousand dollars consideration as the law directs David Osman one of the executors named in the last will and testament of Thomas Patton deceased come into court and took the oath of an executor as prescribed by law and therefor the said David Orman with Zachaeus Wilson his security entered with and acknowledged their bond to the Governor in the penalty of two thousand five hundred dollars consideration as the law directs

The transcribed name of the executor "Jacob Hardy shall..." should read JACOB HOUDESHELL who was a next door neighbor to Thomas Patton (some records read Payton) Jacob was my ancestor and the Pattons lived next door and did business and intermarried with the Houdeshell family and the Wilson family.
