We have not, as yet, located additional road orders for the time period between 1833 & 1841.  In 1841 “Certificates” began being issued and these are available at the McMinn Historical Society archives. 

 

     Research on these early roads has revealed that most were built directly between communities and post offices.  The federal government required and funded ‘postal or federal roads’.  These post roads are often called “Old Federal Roads”.   This name is normally referring to roads that the federal government provided money for in order to maintain that particular road….or ‘post roads’. 

 

     The normal practice was for the McMinn County Commissioners to appoint county citizens to maintain a certain section of a particular road.  They would then provide funds to that citizen to do the maintenance.  These people were called ‘Overseers’.  If an Overseer didn’t have ‘hands’ to work the road then the Commission would order ‘bounds of hands’ from someone living near them.  These ‘bounds of hands’ would be people working on their lands, such as slaves.  Most of the people providing ‘hands’ were the well-to-do slave owners.

 

     You will also see a few references to citizens being provided funds to maintain bridges.  These bridges would have been very necessary on the eastern side of the county as the two main streams, the Chestuee and Conasauga, tended to flood large areas of land several times each year.

 

     Some of these roads were already in existence having been built by the Cherokee Indians prior to the 1819 treaty that ceded the land that created Monroe and McMinn Counties.  The “Old Federal” was built in 1804 by the Federal government & Cherokee Nation.  The Unicoi Turnpike in Monroe County to the Carolina’s provided the means for travel between the western and eastern sides of the Appalachians and has been used for hundreds of years.

 

     The Cherokee Agency’s re-location from Kingston, TN to Agency Creek in then Rhea (now Meigs) County then the moved to the Lewis Ross Reservation at Charleston, Bradley Co., TN., saw the creation of roads that allowed mixed blood Cherokee’s living off Nation lands access to the Agency.  The Old Federal Road on the east side of McMinn Co. allowed access to Georgia but require crossing Indian lands.  Special permission was required by the Agent in charge before people were allowed to cross into Indian lands.  So this reveals that some of the roads did exist prior to county formation.

 

     The earliest churches and cemeteries also help reveal where some of the earliest roads actually passed through.  In the southeast, the church was the controlling factor in the lives of early settlers.  The church controlled the behavior of it’s members…or, at least, attempted to.  The land the churches sat on was usually donated by the land owner who was key in beginning that church.  Many left land for the church and/or cemetery in their estates.  It is obvious that early settlers would have built the churches on existing roads so people could get to them.

 

     Between 1819 and 1838 is a period of time in which McMinn County had Cherokee mixed blood families and white families living near one another so it won’t be unusual to see men like Caleb Starr mentioned in these road orders.  Caleb Starr had married Nancy Harlin the granddaughter of Cherokee Beloved Woman, Nancy Ward.  John Walker was a founding father of McMinn County and a grandson of Nancy Ward. 

 

     The “Stock Road” is another interesting piece of regional history.  It was said that it was built by A.N. Armstrong but this isn’t factual. He purchased a ferry in the 1840’s, so ‘history’ has dubbed the Stock Road as Armstrong Road.  This road did lead past the property of William Armstrong and where Bethsalem Church is now.   The Stock Road left the Old Federal Road a “Few miles south of Madisonville”.  It’s design was to circumvent the constant flooding of Chestuee Creek.  Where the Old Federal stayed on the eastern side of the county the Stock Road stayed on the north & west side of Chestuee Creek.  It had ‘Stands’ every 8 miles….as did the Old Federal.  The reason for this was that this distance was considered a maximum distance livestock could be driven in a day’s time.  This road ran southward through McMinn County and was near where the Armory is today on Hwy. 30.  It traveled down the basic path of Piney Grove Road to Luskville and Pinhook farm to cross the Hiwassee River at Patton’s Ferry just down river from the mouth of the Ocoee River and Chestuee Creek.  From there it stayed on the west side of the Ocoee and the Blue Ridge Divide to re-join the Old Federal Road near Fort Morrow (Marr) and McNairs Stand.

 

The “Connection Road” was a road built from Columbus toward the Athens to Tellico Plains Road.  It ran, basically, the path that Wesleyanna Road runs now to proceed up Foreman’s Creek (now Foeman’s Ck) toward James Chestnut’s farm(near the junction of Zion Hill and old Etowah Rod) and Zion Hill church (est. 1826) to intersect with the Athens to Tellico Plains Postal Road.  So, roughly, it was Wesleyanna and Zion Hill Roads.

 

The Athens to Starr’s road was on and near the Old Etowah Road.  There were post offices at Cobb’s at the junction of Cane and Conasauga Creeks and, later, at Wolverton near the Prospect community though none was recorded at Starr’s.  Traces of this old road can still be found just east of Etowah….running parallel to New Mecca Pike  or Hwy 210.  Conasauga Church was formed in 1829 and would have been on or near the Columbus to Tellico Plains Road.

 

The Road from Columbus to Tellico Plains ran up the Conasauga Creek Valley (Foot of the Mountain Road).  Since crossing the Conasauga Creek would be a challenge during the best conditions when it came to horse and wagons the debate is still occurring as to it’s precise path. Although we do know that it would have gone to the Jalapa community (now Brown Hill)

 

Cantrell’s Crossroads at the Williamsburg community just west of Etowah was the intersection of the road from Cobb’s Post office and the Starr’s to Athens road.  The road to Cobb’s from Cantrell’s did not extend beyond Cantrell’s).

 

The exact location of Stinson’s Bridge isn’t precisely known.  Common sense and tentative research has it at the Chestuee Creek crossing east of Athens.  It was likely the junction of the Starr’s Road and the Tellico Plains Road. 

 

Rudd’s Lane likely ran from the Chestuee Creek crossing near Stinson’s Bridge and ran southward to connect with the Stock Road (Piney Grove).

 

     Research has revealed that the earliest post roads were located somewhat near where they are located now-a-days but not exactly.  Differences of a few yards to a few hundred yards exist.

 

 

And whereas he Court now here have duly weighed and deliberately considered the interest and policy of the State of Tennessee in emancipating the said Lawson and whereas the Chairman or Presiding Justice of Our Court have reported upon said petition as prescribed by Act of Assembly.  It is therefore unanimously Ordered adjudged and decreed by the Court that said Lawson be held and deemed free and entitled to all privileges and immunities that other free people of Color in the State of Tennessee are entitled to or enjoy and therefore came Tidence Lane and Solomon Bogort and gave bond approved of by the Court and in accordance with the act of assembly in such cases made and provided.

Ordered by the Court that Robert R. Coldwell be appointed overseer of the road in room of Roland Lardmore resigned from Elisha Dodson Mill to the four mile tree and have the same bounds of hands the former Overseer had.  2d class.

McDonald be appointed Overseer of the road leading from Firestones to Pattons ferry in the room of Saml Rose resigned from the I jht Mill post to esqr. Cantrells and have the same bounds of hands the former Overseer had. 1st Class.

 

Ordered by the Court that Baker Armstrong be appointed Overseer of the road leadng from Athens to Starr in the room of Johnathan White resigned from Stephenson’s bridge to Gabriel Cantrells and apply to David Cantrell esqr. For a bound of hands.  2 Class.

 

Ordered by the Court that Aron McKeehan be appointed Overseer of the road leading from Athens to Madisonville in the room of Saml Elder, resigned to work the same part of the road and have the same bounds of hands the former Overseer had. 1st Class. 

 

Ordered by the Court that Richard Morgan be appointed Overseer of the road leading from Kelys ferry to Calhoun in the room of Joseph Bullard resigned from the Top of Spring Creek ridge to Calhoun and have the same bounds of hands the former Overseer had.  2d class.

Ordered by the court that James Lee be appointed Overseer of the road leading from John Walkers on Spring Creek to Saml Workmans in room of James Walker new road from the top of Spring Creek ridge to said Workmans and apply to Saml Workman esqr. for a bounds of hands. 2nd Class.

 

Ordered by the Court that Robert Reid be appointed Overseer of the road leading from Athens to  _______ in room of Mark T. Brewer resigned from John Pickenses   ______ and apply to Henry Bradford esqr. For a bounds of hands.  1st Class.

 

Ordered by the court a majorit of the Justices being present that Samuel Hardy be appointed Overseer of the road leading from Athens to the Telico Plains in room of Maravill Coffey resigned from the forks of the road at Samuel Pratons to Middle reek and have the same bound of hands the former overseer had  1st Class.

 

Ordered by the Court that Samuel Wilson be appointed Overseer of the road leading from Athens to Calhous in room of Jessee Dodson resigned from the six mile tree ____ the mile tree and have the same bounds hands the former Overseer had  1st Class

 

Ordered by the Court that Dugal McPhail be appointed Overseer of the road leading from Nathl Smiths to Gillespies ferry roads to begin at Ambler Casses (Casey’s) and work said road to James Dyers and have the same bounds the former Overseer had  2nd Class.

Cate be appointed Overseer of the road leading Athens to Washington in room of Abraham Slack resigns from the Middle of Mouse Creek to Jonathan Evanses old place and apply to Jesse H. Benton esqr. For a bounds of hands the former Overseer had. 1st Class.

 

Ordered by the Court the majority of the Justices being present that Samuel Anderson be appointed Overseer of the road leading from Lowrys ferry to Collumbus in room of Joseph Copeland resigned from the 15 mile post to ______  and apply to John Hill esqr for a bounds of hands. 1st Class.

 

Ordered by the Court that James Chesnut be appointed Overseer of the road leading from Pattons ferry to Telico in room of Thomas Rains resigned to work the same part of the road and have the same bounds of hands the former Overseer hand  ___ Class

Ordered by the Court a majority of the Justices being present that Elisha Melton be appointed Overseer of the road leading from Athens to Collumbus in room of Henry Farmer resigned from the top of the ridge near Dearmon’s to the center of the bridge on Chestooe (Chestuee) near George Bowmans and have the same bounds of hands the former Overseer had  1st Class.

 

Ordered by the Court that Thomas L. Rhea be appointed Overseer of the road leading from the following road near Pickings bridge to George Longs and apply to James Senter esqr. For a bounds in room of Lewis Pain resigned. 2nd Class.

Ordered by the Court that the report of a Jury of View appointed at the last Session of this Court to view and mark a road of the 2d Class commencing at Old Mr. Masoners leading the nearest and best way to intersect the Spring Creek road & be confirmed.

 

Ordered by the Court that Bing Newton be appointed Overseer of the road leading from old Mr. Masoners intersecting the Spring Creed road near Willis Burks from said Masoners to near Peter Odins and apply to James Billingsley esqr. For hands. 2nd Class.

 

Ordered by the Court that John M. Love be appointed Overseer of the road leading from old Mr. Masoners intersecting the Spring Creek road John Roberts (Note: The word at was left out between Road and John Roberts) from Peter Odins to said Burks and apply to James Billingsley esqr. For hands 2nd Class.

 

Ordered by the Court that the report of a Jury of view appointed at the last Session of this Court to view and turn a part of the road leading from Morgantown to Athens be confirmed.

 

Ordered by the Court that John May Owen May Wm Weaver Wm. Shamblin Sr. John White and Tyler Drake be appointed a Jury of View to view and turn a part of the road leading from Bowrys ferry to Collumbus on the land of M. G. Bradford and report to the next Session of this Court.

 

Ordered by the court that George Thomas be appointed Overseer of the road leading form Jones ___have the following bounds of hands _______  road to wit Squire Kelley Aron Mathews John Beele and Natham Perere Jesse Anderson Richard Richlands ____ Wm Jonagin and John Hoyl.

 

Ordered by the Court that Sperling Camp  Hicks Peter Hambright William Hampton and Michal _____ be appointed a Jury of View an marker a road commencing at the corner of Sterling Camps field on Hiwassee river the most and best way to intersect a road at Jacob Cooks below Searberrys Mill and report to the next Session of this Court.

 

(P-22) Monday 5th Septr 1751

Elijah Walker and John Arnwine who ware appointed executors of and by the last will and testament of Wm. Orr deceased came into Court and entered into bond with Security approved by the Court and took the oath prescribed by law &c

 

Saml Workman and James Grigg Commissioners appointed to settle with John Walker Guardian for Elizabeth Mur0phy returned into Court their report wich is ordered to be registered.

 

Joseph Minze and Ferry Matlock Commissioners appointed to settle with John Neil Guardian for George Bunch returned into Court their report which is ordered to be registered.

 

William H Powell and Doctor W.  L. Powell minor children of Benjamin Powell deceased came into Court and asked to be permitted to chose a Guardian for themselves none having been appointed heretofore and the Court after examination having been made find that Said William H.Powell and Doctor W. L. Powell are _____  more than fourteen ears of age and under the age of twentyone yers there _____ allowed to each of said minors to chose the own Guardians whereupon in open court they each Voluntarily selected and chose George W. Powellof McMinn County and the said George W. Powell came into Court and entered into bond ___ the sum of ____ hundred dollars with John _____  and is _____ guardian to each of said minors _____

Ordered by the Court that Hesekiah c. Cook be appointed overseer of the road leading from Collumbus to Telico Plains from Starrs Bridge to the 3 miles post and apply to David A. Cobbs esqr. For a bounds of hands 2nd Class.

Ordered by the Court that William Price be appointed Overseer of the road leading from Athens to Calhoun in room of Saml Jamison removed from the 3 mile tree to the 6 mile tree and apply to Saml Workman esqr. For a bounds of hands 1st Class.

 

Ordered by the Court that Wm. Bates be excused from serving as a juror at the present session of this Court.

 

Ordered by the Court that Martin Senter be released from any further Guardianship for the minor children of Isaac W. Fyffe deceased.

 

Ordered by the Court that an order heretofore made authorizing the clerk to issue a certificate to Joseph Bullard agent for Richard and Polly Morgan paupers be recinded and that Certificate Issue to William Potter as agent fo the said Richard & Polly Morgan. Certificate to issue for the time he lived in proportion he having dyed on the 12th May and certificate to issue to Polly for the whole Yr.

 

Ordered by the Court that all persons not having given in their Taxes for 1831 give in the same and pay over the tax to George Bowman collector for said year, whose duty tit shall be to keep a list and account for the same.

 

Ordered by the court a majority of the Justices being present that the following named men be released from the payment of Taxes for the year 1831 To wit, Isaac Henderson 1white pole Maxmillion Rector 1 black pole, Wm. Dodson Esqr 1 white pole James Officer 1 white pole and 104 acres of land, John Miller a white pole Joseph Hisaw 1 Black Pole John Goode 1 Black Pole, and that the Clerk make out and Issue a copy of the same to collecter and that said collector if he has received any of the above Tax that he refund the same to the proper person.

(P-24) Monday 5th Sept. 1831

The Court then proceeded to appoint the following named men Constables for McMinn County To Wit, George W. Kirksey for Childresses Company and James McDaniel for Mulkies Company, who came into Court and entered into bond with Security approved of by the Court and took the necessary oaths of office.

 

Ordered by the Court that the forepart of tomorrow be set a part for County business.

Court met pursuant to adjournment present the worshipful John Miller William Dodson John Arnwine and Saml Workman esqrs. Justices &c

 

Saml Frazure Esqr. Came into Court and took the oath of a practicing attorney at this barr.

 

Ordered by the court a majority of the Justices being present that A. N. Armstrong be appointed overseer of the road leading from Hiwassee up Chestooe Valley in room of George Reid resigned from the river to William Bells and apply to James McCartney esqr. For a bound of hands.

 

Ordered by the court that A. N. Armstrong be released from the payment of Tax on one town lot for the year 1831.

 

Ordered by the Court that John Miller and Joab Hill Commissioneers appointed to settle with the administrator of the estate of William Burch deceased have power after said Settlement takes place to distribute all monies on hands equally amongst the heirs of the estate of Said William Burch deceased, and report.

 

(P-25) Tuesday 6th Sept. 1831

Ordered by the Court that Saml Workman esqr. Be appointed to give Adolphus McClatchey overseer of road a bounds of hands.

 

Application being made for an appropriation to Samuel M. Gautt, Clerk of the Circuit court and others in the bill of cost specified in the case of the State against William and James Hiller of $65.37 cts and the question being taken stands thus Ays 11, Noes 1 Those voted in the affirmative are Jackson Smith, William Lowry, Jessee H. Benton, John Miller, Robert M. Swan, James H. Fyffe, Saml Workman and Uriah Johnson. Those who voted in the negative are Wm. H. Cooke.  It is therefore ordered by the Court that certificate Issue to said Saml M. Guatt for the aforesaid Sum of $65-37 to County trustee to be paid out of any monies in the Treasure not otherwise appropriated.

 

Application being made for an appropriation of fifty dollars for the purpose of building a bridge across Mouse Creek near lanes Old Mill on the leading from Athens to Washington and the question being taken stands thus Eyes 12 Noes One. Those who voted in the affirmative are James McCartney Jessee H. Benton John Miller Jackson Smith John Arnwine William Lowry Daniel Newman Wm. Dotson James H. Fyffe Wm. E. Cooke Uriah Johnson and Aron Haynes.  Those who voted in the negative are Saml Workman. It is therefore ordered by the Court that Certificate issue Abraham Slack Tidence Lane and John Miller -------------appointed by the Court to superintend the building of said bridge for the aforesaid sum of fifty dollars to county Trustee to be paid out of the bridge Tax, to be paid when said bridge is completed, ordered to issue and be numbered.

Ordered by the Court a majority of the Justices being present that Robert M. Swan and Abraham Barb  esquires be appointed to apportion hands between Joseph Smith and Arch McKeener Overseers.

 

Ordered by the  Court that Robert W. McClary and George Bowman be appointed commissioners to settle with William Maples administrator of the estate of Johnathan Allen deceased and report to the next session of this Court.

Ordered by the Court that Turner Clamer be released from the payment “a pole tax for the year1831 also Daniel M. Prather from the payment of a pole Tax for 1831.

 

Ordered by the Court that John Roberts be excused from serving as a Juror at the present session of this Court. The Court proceeded to appoint the following named men constables for McMinn County to wit: Joseph Minge for Jamisons Company. Barnetts Com. Samuel Wilson. Stephensons Co. Levi R. Bowman all of whom came into Court and entered into bond with security approved of by the Court and took the oaths prescribed by law.

 

Ordered by the Court that Jonathan Hugh be appointed Overseer of the road leading from Calhoun to Washington in the room of James Seaborn resigned from Rogers Creek to the County line and have the same bounds of hands as the former Overseer had  2nd Class.

Ordered Ordered by the Court that Allen Mitchell be appointed Overseer of the road leading from Athens to ___________ in the rom of John Miller resigned from the and of the line at Dickersons to George Longs and apply to James Senter eqr for a bounds of hands. 2nd Class.

 

Ordered by the Court that James Crocket be appointed Overseer of the road leading from Athens to the Telico Plains in the room of William Killingsworth resigned from the ford of Chestooe Creek to the Federal road and apply to John Hill esqr. for a bounds of hands. 2nd Class

 

Ordered by the Court that William Trout be appointed Overseer of the road leading from Sweetwater to David Wilsons on the Morganton road from Daniel Lowrys field to said Wilsons in the room of John Grigslew removed and have the same bounds of hands the former overseer had 2nd Class.

 

Ordered by the Court that Isaac Hill be appointed Overseer of the road leading from Athens to Blairs ferry in the room of Elias Preswell resigned from the forks of the road near Shearmans to the 3-1/2 mile tree and apply to Joab Hill esqr. for a bounds of hands  2d Class.

 

Ordered by the Court that Terry Brock be appointed Overseer of the road from Kellys ferry road to Walkers ferry on the Hiwassee river and have the same bounds of hands the former Overseer had 2nd Class.

Ordered by the Court that John H. Dogan be appointed Overseer of the road leading from Collumbus to Lowrys Ferry in the room of the Abner Logan resigned from the six mile tree to the nine mile tree and have the same bounds of hands the former Overseer had.  1st Class

Application being made for an appropriate to Robert Renfro Corinor (coroner) of McMinn County for holding an inquest over the body of an infant child daughter of Mary Kelly of five dollars and the question being taken stands thus Ays 21, Noes none. It is therefore ordered by the Court that certificate issue to Robert Renfro for th aforesaid sum of five dollars to County trustee to be paid out of any money in the treasury not otherwise appropriated.

 

The Court appointed Geo. Colville Jnr a Constable in the bounds of Capt. Smiths Co for the succeeding two years, who came into Court and entered into bonds with securitys approved of by the court and took the necessary oaths of office the Court appointed Joseph McCully a constable for McMinn County in the bounds of Capt. Cox, Daniel Pierce, David Patterson and Little Berry _______ be appointed a Jury of View the old and new road lading up Mouse Creek upon the land of Archibald Eadens  to commence at or near the corner of said Eadens’ land and to satisfy themselves which is the levillist and best road and which of aid roads ought to be established and should they upon such examination believe the old road the best road and that it ought to be the public road, that they then take into consideration what damage the aid Eadens is entitled to out of the County treasury for damages by him sustained and report to the next session of this court.

Sam’l workman Jesse W. Edington and Isaac Hufaker, Commissioners appointed at the last session of this Court to lay off oneyears maintenance to Elizabeth Varnell widow of John Varnell dec’d returned into Court their report to-wit, agreeable to the within orders, We the Commissioners therein named have layd off 3 beef cattle 18 head of hogs 30 bushel of wheat, some bacon and what old corn is on hand and 200 bushall of corn out of the new crop. Ordd by the Court that Ephraim Rose be appointed Overseer of the road leading from Athens to Washington in room of Asa Lawson resigned from Rogers Creek to the 2 mile post and have the ame bounds of hands the former Overseer had  1st Class

Ord’d by the court that a 2nd Class road leading from Harrises and Morrises to Thomas McInturffs to anuled

 

Ira Done came into Court and asked the court to appoint him Guardian for Absolem and M. J. Done (Doan) minor orphans, the Court accordingly appointed the said Ira Done guardian for said minors who came into Court and entered into bond with security approved of by the Court.

 

The execution of lien from Wm Horn to David Horn was this day duly acknowledge in open Court by the maker thereof admitted of record let it be certified for Registration.

 

Ord’d by the Court that the road leading up Rogers Creek be annulled from the stage road to the Rhea County line and that Jonathan Thomas Jno. Grisham James Small, James Wheeler, Tira (Tyra) Lawson and John Hart be appointed a jury of view and alter said road to run the nearest and best way and make a report to the next session of this Court.
