Homestead & Dower Deeds N

I William H. Oliver of the County of Giles and State of Tennessee - For the purpose of making an equal distribution of my real estate amongst my children; to Wit Charlotte Sanora Oliver, Annie Jane Oliver, William Moulton Oliver, John Harvy Oliver and my wife Charlotte Kate Oliver. I knowing the land well; have as I believe made a fair and just devision of the same and have had said lands surveyed by E. H. Abernathy, county surveyor.

The contents of the homestead division assigned as dower to my wife; with remainder to my son John Harvey are one hundred & twenty two (122) acres. Beginning at a large hackberry at the North E. corner of the orchard. Thence S. E. 67 poles to the road & branch. Thence S. 70 � W. 15 poles & 15 links to stake. Thence N. 73 W. 6 poles. Thence S.41 W. 56 poles. Thence S. 77 W. 30 poles. Thence S. 75 poles to Abernathy Corner. Thence with Abernathy line North 36 poles to a spring. Thence north 65 W. 68 poles to Worleys corner. Thence with Worleys line N. 2 E. 112 poles to hickory; a corner of lot no. 2. Thence with lot no 2 S. 79 E. 140 poles to a creek. Thence S. 3 El 30 poles & 10 links to oak. Thence S. 72 E. 10 poles to the beginning.

The above described lot or division of said lands I desire to dispose of as follows - to Wit. My wife Charlotte Kate to possess and enjoy it - as dower during her life or widowhood and at her death or marriage the same with the oppurtinances there to; to descend to my youngest son John Harvy and his heirs forever. Now in the event that my son John H. should die leaving no bodily heirs the above described land after my wife has enjoyed the same as stated above. Shall inure to the benefit of other 3 children as mentioned above, their heirs and assigns forever.

The above described division lot no. 2 I give and devise with its oppurtinance to my daughter Charlotte Sanora oliver, her heirs and assigns forever. Provided that if the said Charlotte S. Oliver should die leaving no linial heirs of her body then the above described land alloted to her shall inure to the benefit of my other children hertofore mentioned and their heirs and assigns forever.

Division lot No 1 containing one hundred and twenty seven acres (127) acres beginning at a set rock in the west boundry line of Pisgah Church tract; on the North margin of the road. Abergurty north East corner. Running thence N 2 � E. 10 poles to a rock the N. W. corner of the Church tract. Thence N 89 � E. 32 poles to the road. Thence N. 12 E. 10 poles & 20 links to a rock. The above described division lot No. 1, I give and devise with its apurtinences to my daughter Annie Jane Oliver, her heirs and assigns forever. Provided that if the said Annie Jane Oliver should die leaving no single heirs of her body then the above described land Lot No. 1 should inure to the benefit of my other children heretofore mentioned above.

James M. Marks Place. Wm M. Oliver Lot No. 4

James M. Marks place lying in the 8th Civil District containing 145 \60 acres. Beginning at a W. birch on A. C. W. Whites West boundry line. Thence S 1 W. with Whites line 102 poles to a dogwood in Bradley�s line - thence with Bradley�s line S. 69 W. 10 poles to a set rock with elm pointer. Brunson Corner - thence with Breuson line N. 88 3/4 W. 176 poles 7 links to R. H. Johnson East boundry line - thence with Johnsons line N. 1 E. 119 poles & 15 links to the road. H. McDonalds corner Thence unto McDonalds line and the road N. 67 � E. 18 poles - thence N 52 � E. 15 poles and 13 links to John McNary, cal. corner thence with McNay line S/ 73 E/ 50 to the creek - thense up the creek with the following bearings and distances N. 85 E. 11 poles - N. 32 � E. 23 poles 15 links, S. 41 1/4 E. 18 poles 20 links - N 43 3/4 E. 27 poles 15 links to Madray�s corner - thence leaving the creek with Madray�s line S. 78 E. 14 poles, 20 links Whites corner - thence with Whites line S 3/4 W 42 poles - thence S 86 E. 41 poles & 11 links to the beginning containing by survey 145-\69 acres. The above described James M. Marks place Lot No. 4 I give and devise with its apurtenance to my son William Moulton Oliver, his heirs and assigns forever provided that the said William M. Oliver shall pay out of the rents or proceeds of said described lands five hundred dollars to be used and applied as I may hearafter direct. The above sum of 500 five hundred dollars is required of the said WM. M. Oliver because I think that his land or division exceeds the value of the other lots thus made.

Provide further that should the said William M. Oliver die leaving no leaving no legal heirs of his boddy then this James M. Marks place or devision Lot No. 4 as described above shall inune to my other 3 children heretofore name and thier heirs, it is my object and wish that should any of my children die without any legal heirs of their boddy what I have allotted to him or her shall go to my other children and thier heirs.

 

Mrs C. Kate oliver

Now in addition to what I have given my wife Charlotte Kate Oliver I give the sum of five hundred dollars to be paid out of my personal property as I may hereinafter provide. It is also my will and wish that my wife Charlotte Kate Oliver have the roan horse and buggy.

Household and Kitchen Furniture

It is my will and wish that there be no sale of my household and kitchen furniture. But my wife and my children shall divide them so as to be most advantagous to them all.

It is further my will and wish that in addition to what I have given my daughter Charlotte. S. Oliver that she get one hundred dollars out of my personal estate to be paid as I may herein after provide. Her lot or devision of the real estate as I believe not being equal by that much, it is my will and wish that the ($500.00) five hundred dollars that my son William M. Oliver is to pay back out of the rents and proceeds of the James M. Marks place or division Lot-4 shall go to my wife C.K. Oliver. Now my wife C. K. Oliver shall receive the rents of the said James M. Marks place allotted to my son William M. Oliver annually until the five hundred dollars heretofore allotted to her shall be paid. It is further my will and disires that my executor shall pay to my daughter Charlotte S. Oliver one hundred dollars out of my person estate, which has been mentioned .

Horse & Mules

It is further my will and desire that my horses & mules after my wife has recieved one mule or horse in addition to the one already given her, shall be equally devided among ? my children and my w?. Said stock shall be valued by disinterested persons.

Cattle

It is further my will and desire that my cattle after my wifes share get two cows and calves shall

be equally divided between my children.

Crop

It is further my will and desire that the crop on the home place and the hogs go to the use and benefit of my family for the ensuing year.

As touching my indebtedness. My contract between the present time and my death being now nearly free from indebtedness. I direct the same to be paid by the executors of this will out of any money on hand if I should have any at the time of my death or out of any available notes or accounts or a sale such of my personal property (?for three ?) as they may deem expedient so as not to interfere with the disposition of the lands already herein made. I further desire that my wife C. K. Oliver have the new two horse wagon. And lastly I nominate constitute and appoint my wife Charlotte Kate Oliver and S. W. Butler to execute this will hereby revoking all other wills by me heretoafore made and declaring this and no other to be my last will and testament. In witness where of I have hereunto set - my hand and seal the 26 day of September 1881. One thousand eight and eighty one.

After considering the matter as to my stock. I desire that one my mule named Beck sold and the proceeds be paid to my wife C. K. Oliver ? be liquidated the $500.00 dolars that she is to get also about 7 head of beef cattle to be sold and the proceeds or a hundred dollars to be given to my daughter C.S. Oliver pay the 100 dollars that she was to receive out of my estate.
