Carter and Lucy Grymes to Thomas Fitzhugh This indenture made this 27th day March in the year of our Lord One thousand eight hundred and Seventeen between Bernard M. Garter and Lucy Grymes his wife of Woodstock in the County of Fauquier of the one part and Thomas Fitzhugh Esq. Of the said county of the other part witnesseth that for and in consideration of the sum of Twenty five Dollars per acre in hand paid by him the said Thomas Fitzhugh to them the said Bernard M. Carter and Lucy Grymes his wife and for other important considerations therein hereunto moving He the said Bernard M. Carter and Lucy G. his wife, have given, granted, bargained and sold auid [?] by these presents do give grant bargain and sell unto the said Thomas Fitzhugh, his heirs and assigns forever all that tract or parcel of Land situate lying and being in the county of Fauquier called and known by the name of the Owl Run Farm and Bounded as follows viz Beginning at a stone on the Bank of Turkey Run, upper course of the Woodstock Farm thence S49 W233 poles to a Red Oak & two hickory saplings course to Col. R. Randolph and George Fitzhugh thence with Randolph S4æ E crossing Owl Run 397 poles to a Red Oak stump and two small wite oak bushes corner to Randolph thence with another of his lines S48æ E123 poles to a Red Oak another of Colo: Randolphís corner thence S52‡ W95 poles to a stake in Owl Run Road about seven or eight steps from an ash tree on the side of the Road thence with the said Road S86º E44 poles thence N84 E41 poles to a Red Oak on the side of said Owl Run Road, Corner to Colo. Randolph thence S19‡ E14 poles to a white oak also Randolphís Corner thence S 31æ W 21‡ poles to two small white Oaks standing in the corner of Colo. Randolphís Fence thence S43‡ E90 poles to a Double Dogwood and Hickory corner to Jacob Weaver, thence N23 E79‡ poles to a small hickory standing the corner and on the inside of Weavers fence in the old Owl Run Road thence N68 W53 poles to a White Oak on the East side of Owl Run near the Horsefren [?] lick thence up owl Run N30 W30 poles thence N10 W30 poles thence N45 W8 poles thence N10 E16 poles [pg 103]to a Red Oak and White Oak on the said Owl Run corner to Chapman thence leaving the run N52‡ E100 poles to two white oaks corner to the Woodstock Farm thence with the lines of that farm N11 E109 poles to a White Oak thence N50 E49 poles to a Spanish Oak thence N27 E98 poles to a stake on the Bank of Turkey Run corner to Woodstock Farm thence with Woodstock up the the several meanders of Turkey Run to the Beginning Containing a survey of William McCoy Deputy of Charles Kerufer nine hundred and thirty nine acres together with all and singular the houses, buildings, ways, water and water courses, rights, priviledges and appurtenances whatsoever to the said tract or parcel of Land belonging and the Reversion and Reversing remainder and remainden, rearly and other reuts [?] issues and profits thereof to have and to hold the said tract or parcel of Land and all and singular others the said premises , herein before mentioned or intended to be mentioned, bargained and sold and every part and parcel thereof with every of their rights numbered and appurtenances unto the said Thomas Fitzhugh his heirs and assigns forever, and the only proper use and behoof of him the said Thomas Fitzhugh and his heirs forever and the said Bernard M. Carter and Lucy Grymes his wife for themselves and their heirs the said Tract or parcel of Land with all and every person and persons whatsoever shall will and do warrant and forever defend by these presents In Witness whereof the said Bernard M. Randolph Henry Fitzhugh John Hall The Commonwealth of Virginia to Robert Randolph and Thomas Lagean Gent Justices of Fauquier County Court Greeting Whereas [pg 104] Bernard M. Carter and Lucy G. Carter have by their certain Indenture of Bargain and sale bearing date of 27th day of March 1817 sold and conveyed unto Thomas Fitzhugh a certain tract of Land called the Owl Run farm containing by late Survey of William McCoy Deputy Surveyor of Charles Kemper nine hundred and thirty eight acres with the appurtenances and whereas the said Lucy G. Carter cannot travel conveniently to the County Court of Fauquier to make acknowledgment of the said Indenture therefore we do give unto you or any two or more of you power to receive the acknowledgment which is hereunto annexed; and we do therefore require and impower you that you do personally go to the said Lucy G. Carter and receive her acknowledgment for the same and examine her prively and apart from her said husband, whether she willingly signed and sealed the said indenture without the persuasions or threats of the said husband and whether she consenteth that the same may be Recorded in our said Court and when you have received her acknowledgment and examine her as aforesaid that you distinctly and openly certify in thereof in our said Court under our seals, sending therewith the said Indenture and this which Witness Daniel Withers Clerk of our said Court at the Courthouse the 26th day of March 1817 and in the 40th year of the Commonwealth Dan Withers Fauquier County Pursuant to the above Commission, we the under written did personally go to Lucy Carter the wife of the above named Bernard M Carter and examined her privily and apart from her said husband whether she executed the therein mentioned Indenture of her own free and voluntary consent, without the persuasion or threats or other undue influence of her said Husband when she declared that she did and ecpressed a desire that the same Indenture might be recorded as her act and Deed, Given under our hands and seals this 27th day of March 1817. Robert Randolph ---------------------- At a Court held for Fauquier County the 28th day of April 1817 This Indenture of Bargain and Sale was produced into said Court and proved to be the act and Deed of the said Bernard M. Carter by the Oaths of Dudley Diggs and Henry Fitzhugh two of the subscribing witnesses thereto and is ordered to be Certified. And in the Office of the County Court of Fauquier this 18 Day of November 1817 The same was produced to me a Deputy Clerk in said Office and further proved by the oath of R. L. Randolph another subscribing witness thereto and I admitted to record Test John AW Smith Dy Clerk Of F. County Court At a Court held for Fauquier County the 24th day of November 1817 This Commission for taking the acknowledgment and privy Examination of Lucy Grymes Carter was produced into Court and being Returned and duly Executed is Ordered to be Recorded.
