Fauquier County Will Book 18 pg 251-252 29 Mar 1842 I Thomas Fitzhugh of the county of Fauquier being of disposing mind and memory do make and ordain this to be my last will and testament. I give and devise to Henry Fitzhugh, Thomas J. Withers and Berkeley Ward the following slaves to wit: Hannibal & his wife Sally, Old George & his wife Beck (sic), blacksmith Billey, Sucy who calls herself Sucy Gaines and her daughter Sally Battaile, in trust and confidence that they will after my death permit the said slaves to have as much liberty and be as free and the Laws of Virginia will suffer them to be: I also give and bequeath to the above named trustees my negro man Dick to be held in the same manner as the other slaves abovementioned, and I further will and bequeath that my executor or administrator place out of my estate the sum of three thousand dollars at interest on good and sufficient landed security, the interest on which, I wish divided among Hannibal, Sucy, George, Dick and the old woman Matilda as follows, to Hannibal the sum of one hundred dollars, Sucy forty dollars, George ten dollars, Dick ten dollars, Matilda ten dollars and ten dollars to the old woman Milly the mother o f Hannibal to be paid to each of them annually during their lives, I give a bequeath to blacksmith Billey the sum of fifty dollars to be paid him at my death by my ex. or admr. my will and desire is that upon the death of either of the negros above named to whom an annuity is given that the principal sum of the three thousand which was necessary to produce the said annuity, shall be equally divided between my nephew Henry Fitzhugh & Berkeley Ward or their respective representatives. This last will and testament of Thomas Fitzhugh was proved in open court by the oath of Thomas W. Edmonds a subscribing witness thereto and at a Court continued and held for the said county on the 5th day of December 1843. The same was fully proved in open court by the oath of Edward Sanders another subscribing witness thereto and ordered to be recorded. And at a court held for said county on the 25" day of December 1842. Henry Fitzhugh and Berkeley Ward the executors therein named qualified and garis [?] bond and security according to Law.
