Fauquier County Deed Book 34, pages 342-342, 17 October 1834 Thomas Fitzhugh to Henry Fitzhugh This Indenture made the 17th day of October in the year 1834 between Thomas Fitzhugh of the County of Fauquier and state of Virginia of the one part and Henry Fitzhugh of the said County and state of the other part witnesseth, that for and in consideration of the sum of one dollar in hand to him paid at or before the ensealing and delivering of these present the receipt whereof is hereby acknowledged the said Thomas Fitzhugh hath bargained and sold and by theses present, doth bargain and sell unto the said Henry Fitzhugh his heirs and assigns, a certain tract or parcel of land lying and being in the state and County aforesaid and bounded as follows viz: Beginning at a large elm on the south branch of Cedar run a few years above the ford corner to Doc. William D. Fitzhugh, Stephen McCormick's purchase of William Stewart and Whiting Diggs's purchase of Cole Fitzhugh and the Pageland tract and running thence down the run S 52 3/4 E 47 6/10 poles to a point on the south bank of said run 30 links above a bunch of sycamore Bushes and in a line of Whiting Diggs's purchase of Cole Fitzhugh, thence south 71 West 37 poles to a small white oak on the south side of a drain a few years west of Rogues road thence n 69 1/2 W 132 poles to three hicories and white oak on the North west side of the road leading from Henry Fitzhugh's mill to Warrenton in Chichesters line thence with Chichester's line N 37 E 36 poles to a point on Cedar run a little below the mill dam, thence with the meanders of said run S 61.5 E 16 poles, S 45 E 14 poles, S 56 E 24 poles, S 44 E 12 poles, S 62 E 18 poles, S 50 E 11 poles, to the beginning containing twenty six acres and one rood and thirty three poles together all and singular the appurtenances and the reversion and reversions, remainder and remainders, yearly and other rents, issues and profits thereof and of every part and parcel thereof to have and to hold the said tract of land with the tenements hereditaments and all and singular other the premises herein before mentioned or intended to be bargained and sold and every part and parcel thereof with every of their rights, members and appurtenances unto the said Henry Fitzhugh his heirs and assigns forever. And the said Thomas Fitzhugh for himself and his heirs the said tract of land with all and singular the premises and appurtenances before mentioned unto the said Henry Fitzhugh his heirs and assigns free from the claim or claims of him, his heirs and of all and every person or persons whatever shall will and do warrant and forever defend by these present. Fitzhugh Fauquier County SC We William Skinker and Rice Hooe justices of the peace in the County aforesaid in the state of Virginia do hereby certify that Thomas Fitzhugh a party to a certain deed bearing date on the 17th day of October 1834 and hereunto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desire us to certify the said acknowledgment to the Clerk of the County Court of Fauquier in order that the said deed may be recorded.
