King George County, Virginia Will Book 3, page 206-7 In the name of God amen; I Sarah Fitzhugh of the County of King George in the state of Virginia being of sound and disposing mind and memory do make this my last Will and and (sic) Testament hereby revoking all others hitherto made my me. I give and bequeath to my daughters Lucy B. Fitzhugh Ann E. J. Fitzhugh, Mary C M Fitzhugh, Sophia B. Fitzhugh and Sarah N Fitzhugh all property of whatever kind or nature which I may have at the time of my death or may thereafter be entitled to, but in the following manner. No division of it is to be made as long as any one of them remains unmarried but to be kept together for the support of those who are single. If any of them should marry her claim to a support and her interest in my said property shall be suspended until the death of the last who shall die unmarried and if either of my said daughters should depart this life unmarried before she arrives at the age of twenty one years, it is my will that the portion of the property hereby bequeathed to her shall be equally divided among those of my before mentioned daughters who may survive her. I hereby nominate and appoint my son in law Henry Fitzhugh of Fauquier county executor of this my last will and testament and it is my wish that he will act as guardian to my infant daughters during their minority and I hereby give him full power to allow or change the quality of my property hereby bequeathed to them if in his opinion it can be thereby rendered more productive or the interest of said daughters may require it If my son in law shall refuse to act as executor and guardian as aforesaid I hereby invest with the same power to alter or change my property such person or persons as the court of the said County of King George may appoint in his stead. In witness whereof I have hereunto set my hand and seal this 5th day of August 1820 Signed sealed and Delivered in the presence of Sarah Fitzhugh Wm J Quirenberry Geo Fitzhugh Giles Fitzhugh At a court held for King George County the 7th day of December 1820 The foregoing last will and Testament of Sarah Fitzhugh decd was proved in Court by the oaths of George Fitzhugh and Giles Fitzhugh witnesses thereto and is ordered to be recorded and on motion of Henry Fitzhugh the executor therein named who made oath thereto and together with Augustin Fitzhugh and Edmond Fitzhugh his sureties entered into and acknowledged their bond in the penalty of $12000 conditioned as the law directs; certificate is granted him for obtaining a probate of the said will in due form.
