Fauquier County Will Book 24 pg 303-304 9 Apr 1852 In the name of God amen I Giles Fitzhugh of Fauquier County make this my last will revoking all others - I will that my slaves shall be free at my death. all the rest of my real and personal estate after the payment of my debts I bequeath to my niece Harriet Ward daughter of my deceased brother Richard. In witness whereof I hereto subscribe my name and affix my seal this ninth day of April 1852. Giles Fitzhugh Fauquier County Court 28" February 1853 This paper writing purporting the last will and testament of Giles Fitzhugh deceased, was this day produced in Court by Berkeley Ward to be proved - and there being no subscribing witnesses thereto Thomas L. Moore and William H. Gaines were sworn and ______ deposed (?), that they were well acquainted with the testator's hand writing and verily believe the said writing and the name thereto subscribed to be wholly written by the said testators own hand. and the said Thomas L Moore further deposed that he saw the said testator write and sign the aforesaid paper - whereupon the said writing is ordered to be recorded as the true last will and testament of the said Giles Fitzhugh, deceased. Berkeley Ward moved the Court to grant administration with the will annexed on the estate of the said Giles Fitzhugh to him which said motion was resisted by Mordicai C. Fitzhugh - and the parties being heard, the Court doth grant to said Ward administration on said estate - and thereupon the said Berkeley Ward gratified (?) and [pg 304] gave (bond) [sic] and security according to law the security having justified Teste: Wm LA Jennings CC
