Ward "This indenture made this 30th day of December 1858 Between Berkeley Ward of the first part, Henry E. Ward* of the second part and Harriet Ward of the third part, Wheras the said Berkely Ward has this day sold and conveyed to Charles J. Nourse a certain tract of land Containing about four hundred and sixty-nine acres, for the sum of eight thousand five hundred and one dollars and fifty cents, which tract of land was devised to the said Harriet Ward by her Uncle Giles Fitzhugh, and in the convergence of which to the said Nourse the said Harriet Ward united with the distinct understanding that the entire purchase money therefore should be settled upon her for her sole and separate use. Now this indenture witnesseth: that for and in consideration of the premises as well as for and in consideration of the sum of five dollars to the said Berkely Ward in hand paid by the said Henry E. Ward the receipt of which is hereby acknowledged. He the said Berkely Ward hath granted, assigned, transferred and set over - and by these presents[?] doth grant, assign, transfer and set over and convey to the said Henry E Ward all the purchase money aforesaid, and the bonds to secure the same, together with the interest therin, which purchase money is to the extent of three thousand five hundred and one dollar & fifty cents, in cash paid over to the same Henry E Ward and to the extent of five thousand dollars is in the bonds assigned to him the said Henry E Ward, and all of which to the said Henry Ward is to hold in trust for the sole, separate and exclusive use of the said Harriet Ward, and to put the same out at interest and pay the interest to her the said Harriet Ward, annually or to invest it in Rail Road bonds, stocks, or otherwise on the said Harriet Ward shall have power by deed or will to dispose of the said purchase money or any part thereof, or the interest accruing thereon as she may think fit, and to deal with the same in all respects as her separate estate, and the said Henry E Ward binds himself well and truly to execute this trust and make no investment of the said fund without the consent of the said Harriet Ward In witness whereof the said parties have hereto set their hands and seals: B.
