Fauquier County, Virginia Deed Book 39 pg 481; 9 June 1840. Elizabeth D. Fitzhugh to Thomas Fitzhugh This Indenture made and entered into this ninth day of June 1840 between Elizabeth D. Fitzhugh of the county of Caroline in the Commonwealth of Virginia of the one part and Thomas Fitzhugh of the County of Fauquier and commonwealth aforesaid of the other part, witnesseth that the said Elizabeth D. Fitzhugh for and in consideration of the sum of seven hundred and forty dollars to her in hand paid by the said Thomas Fitzhugh at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged she the said Elizabeth D. Fitzhugh hath granted, bargained and sold and by these presents doth grant bargain and ell unto the said Thomas Fitzhugh a certain tract or parcel of land situate, lying and being on Cedar run in the said County of Fauquier being the tract of land allotted to the said Elizabeth D. Fitzhugh by the Commissioners appointed by the County Court of Fauquier to divide the land of her father the late doctor William D. Fitzhugh among his children, which tract of land is described in the platt returned to the County Court of Fauquier by the aid Commissioners as Beginning at A a large elm on the south west branch of Cedar Run corner to Charles J. Stover and Stephen McCormich thence down the Run south 52( 50" East to red J a stake in the meadow thence running North 50( East 11 poles to red I in the line of the whole tract of the said William D. Fitzhugh's land thence to O a dead white oak at the bend of the road, thence South 50( W 118 1/4 poles to the beginning, containing thirty-seven acres be the same more or less. To have and to hold the tract of land described as aforesaid together with all its appurtenances unto him the said Thomas Fitzhugh his heirs and assigns forever. And the said Elizabeth D. Fitzhugh doth hereby covenant & agree to and with the said Thomas Fitzhugh that she the said Elizabeth D. Fitzhugh and her heirs the tract of land aforesaid together with all its rights, members and appurtenances will warrant and forever depend to him the said Thomas Fitzhugh and his heirs against the claims and demands of her the said Elizabeth D. Fitzhugh and against the claim and demand of all and every other person or persons whatsoever. In witness whereof the said Elizabeth D.
