that TYRE SARRETT and Wife, Sus-An-Ah (MILLER) SARRETT are the
Parents of JAMES D. SARRETT. And in the absence of Absolute Proof,
circumstantial evidence, both legally and genealogically, has been
allowed in the following conclusions, and will be conceded that when
any other proof of the opposite is provided, which is logical and

Mrs Fanny (WATERS) HAGGARD married 1st. to
JACKSON HAGGARD,
1816-1843; Son of the Rev. JAMES HAGGARD and Wife MARY (ATCHLEY)
HAGGARD; They were married about 1837, Sevier Co. TN. They had one
son EZEKIEL L. HAGGARD, born to this short union. Two years before
this marriage, on 14 Nov. 1835, Brother-in-law J. McCAMPBELL ATCHLEY,
(Husband of sister LYDIA (HAGGARD) ATCHLEY) sold 50 Acres of land
on "Kellum Creek" to JACKSON HAGGARD (Registered "Deed of Conveyance",
Book F, Page 189, Date 03 Feb. 1836) This same tract was sold to
JAMES D. SARRETT, by Stepson EZEKIEL L. HAGGARD, on 06 Oct. 1859

Six months after his marriage, JAMES D. SARRETT, on May 16, 1842, filed
a "Letter of Indenture", with the Sevier County Court on
that date. He was in debt up to a total of $29.94 The following is
that "Indenture" in its entirety:

This indenture made and entered into this 14th day of May,
in the year of our Lord One Thousand Eight Hundred and Forty Two by
and between BRUSTER & SARRETT and CANNON HENDERSON and McNELLEY
and JAMES McNELLEY all of the County of Sevier, State of Tennessee
of the first part and JAMES D. SARRETT of the County and State aforesaid
of the other part.
Whereas the said JAMES D. SARRETT is indebted to the said
BRUSTER & SARRETT and CANNON HENDERSON and McNELLEY and JAMES
McNELLEY of the first part in the sum of Thirteen Dollars and Fourteen
Cents ($13.14) by note due the 13th. of April 1842, to BRUSTER
& SARRETT, also a note to ROBERT BIRCHFIELD for Seven Dollars
and Fifty Cents ($7.50) Due the 5th. day of May 1842 for which
the firm of BRUSTER & SARRETT is security for the said JAMES D.
SARRETT to the said ROBERT BIRCHFIELD, also a note to CAMMON HENDERSON
and McNELLEY for Five Dollars and Eighty Cents ($5.80), due the First
September 1841, also a note to JAMES McNELLEY for Three Dollars
and Fifty Cents ($3.50) due 15 May 1842, and the said BRUSTER & SARRETT
and CANNON HENDERSON and McNELLEY and JAMES McNELLEY of the
first part, being willing to wait Eighteen (18) Months longer with
the said JAMES D. SARRETT upon having their debts and interest Secured
and the said JAMES D. SARRETT being willing to give then a certain
assurance that their money shall be paid at the expiration of Eighteen
(18) Months from this date.
Therefore this indenture written______ that the said J.
D. SARRETT as well in consideration of securing the said BRUSTER
& SARRETT and CANNON HENDERSON and McNELLEY and JAMES McNELLEY
of the first part in the faithful payment of the debt and interest
aforesaid hath granted Bargained, Sold, Transferred and set over unto
the said BRUSTER & SARRETT and CANNON HENDERSON and McNELLEY
and JAMES McNELLEY of the first part their heirs and assigns...Under
the authority of WILLIAM L. ROGERS as Trustee..the following personal
property to Wit:

Five head of Sheep
One Loom
One Pot with Lid
One Brandin? Calf
Two Bedspreads and Furniture
One Dyper? and delf wear
One Table
One Side Saddle
One half dozen Split Bottom Chairs
To have and to hold the said property unto the said BRUSTER
& SARRETT and CANNON HENDERSON and McNELLEY and JAMES McNELLEY
of the first part, their heirs and assigns to the proper use and behold?
of the said BRUSTER & SARRETT and CANNON HENDERSON and McNELLEY
and JAMES McNELLEY of the first part their heirs and assigns forever.
It trust however and to the interest and purpose....that if said JAMES
D. SARRETT lawful Interest thereon are not with and freely paid off
and discharged before the expiration of Eighteen (18) months from
this date by said JAMES D. SARRETT or some other person for him.
Then and in that case the said WILLIAM L. ROGERS shall in the executing
the trust hereby taken; Advertise the said property as the law directs,
that he will expose to the highest bidder that said property on a
particular day for ready money; and if the money aforesaid be not
still paid on the day designated as aforesaid, there the said WILLIAM
L. ROGERS shall propose to sell the above described property to the
highest bidder for ready money to satisfy the above named notes. Provided
never _______ that of the said money and interest should be paid before
the day of sale herein mentioned....Thru this indenture to be wholly
void and of no effect either in law or __________ whereas the said
JAMES D. SARRETT here unto sets his name and seal...the date above
written.

In the [REF:#22] 1850 Census, F. G. 614, for Sevier County (12th. East
Sub-Division), Tennessee, we know JAMES D. SARRETT already owned
property in Sevier Co. (Need to research Deed Records..prs), because
we find JAMES D. SARRETT (32yrs) and Wife Fanny (WATERS) HAGGARD (38yrs)
SARRETT, Owning a farm ($250 Real Estate value) adjoining JOHN
& MARTHA LEWALLEN (F.G. 613) on one side and JAMES HAGGARD, 21yrs.
(Son of Atchley Haggard) & wife MATILDA R. (ATCHLEY), 22yrs. HAGGARD
on the other side farm. Adjoining that farm was (F.G. 616) was ATCHLEY
HAGGARD, age 44yrs. (Brother of the late Jackson Haggard, 1st husband
of "Fannie" (Waters) Haggard Sarrett) and his 2nd. wife SARAH
(MORRIS) HAGGARD, age 26 yrs.
You will note that "Fanny" (Waters) Haggard Sarrett
was listed as "Can NOT Read or Write", which she remained so her entire life. ...prs

the 1850 Census for Sevier Co., TN., with only 2 of her children
living in the household. They were living next door [FG 814] the
"Clerk & Master" Mitchel W. McCOWAN and Wife Teressa A. (LANNING)
McCOWAN; and [FG 816] Dr. J.M. HAMMER and wife Eliza C. (THOMAS)
HAMMER; Her Brother-in-law SAMUEL, 9 SARRETT with family was living
at FG 661; All were listed as White Race, no mention of Native-American "Indian" race.;

We know Son JAMES D. SARRETT already owned property in Sevier County,
by the 1850 Census Record. It is believed that he owned the property,
which belonged to his wife's first husband JACKSON HAGGARD, bought
from Mc ATCHLEY, on 14 Nov. 1835. Records show (Sevier Co., TN
Surveyor Book, 2, Page 75) He "Entered #1959" 150 acres,
of land lying on the waters of Kellums Creek prior to 16th of
Dec. 1851; Surveyed on 24th of Feb. 1852, by JOHN MULLENDORE, THE
Chain Carriers were his Father-in-law EZEKIEL WATERS and adjoining
neighbor JOHN LEWALLING. This 150 acre Land Grant #2863, was Recorded
in Vol. 29th. Page 568, on 24th Feb. 1852. The boundary description
of this Grant, list that JAMES D. SARRETT owned at lest two additional
tracts of land. Line 5 list "to a small Pine on the line of JAMES
D. SARRETT" this would be South of the Grant Property, going
East 90 Poles, then North 63 Poles to a Black Oak.
This GRANT needs additional research. Their should be a claim or (the
Petition) that James D. Sarrett, file to get official authorization (a
Warrant) to have the tract surveyed to produce a legal description
(the Plat) so the Government can grant title to this specific piece
of land (the first-title Deed) or Grant. This could be for serving
in the Mexican War, Congress, in 1847 authorized 160 acres for soldiers
serving one year or more, 40 acres for serving less than a year. The
Acts of Congress of 1850 - 1855, were not to encourage enlistments,
but to reward former service. The act of 1850 extended bounty land
to officers and enlisted men who had NOT previously received land
and who served in ANY war since 1790, including the Indian Wars. The

In the 1850 Census, Sevier Co., Tenn. (F.G. 699) WILLINGTON
McMAHOM, b. 1817, Tenn. was a Farmer, on a $2,000 farm living with
his wife CATHERINE (HAMMER) McMAHOM, their two children at this time
was Daughter JULAN McMAHOM, age 6, b. 1844 and Son ISAAC McMAHOM,
age 1, b. 1849. There also was a SARAH HAMMER, age 74, b. 1776, in
Tenn. Mother of Mrs. CATHERINE (HAMMER) McMAHONE. No record found
of K. SANNING in the 1850 Census.
JAMES D. SARRETT - ACCIDENT
JAMES D. SARRETT, had a accident while cutting down a tree, which
fell on him in January of 1860 and injured his right leg. He was maimed
and used crutches for the remainder of his life. The following is
an Affidavit from the family Physician Doctor J. M. HAMMER, which
was submitted in Fanny (WATERS) HAGGARD, SARRETT, ATCHLEY "Mothers
Pension Application" at the time of filling for her son WILLIAM
J. SARRETT, death benefit in 1882 (See below 69 ) . The Doctor and
his wife E. C. (THOMAS) HAMMER, along with two children SAMUEL and
J. M., Jr. HAMMER, can be found in the 1850 Census (F.G. 816) Sevier
Co., TN.....prs
Dr. J. M. HAMMER, personally before me D. H. EMEST,
County Court Clerk and made oath in due form that he was the family
physician of the JAMES D. SARRETT to near the close of the rebellion,
when he (James D. Sarrett) left for the Northern States and never
saw the said JAMES D. SARRETT again. That in January 1860 he, the
said JAMES D. SARRETT sent for him, he found him badly hurt from
the falling of a tree..."Crippled so that I thought he would never
be able to make a hand again by manual labor. He was well acquainted
with him, and the family, and continued his family Physician till
January 1864, when he went North and never saw him no more."
In the 3rd. Settlement Statement, 04 July 1867, of JAMES D. SARRETT,
dec'd. The Stepson EZEKIEL L. SARRETT, Admin. paid a $32.00 Note
to Dr. J. M. HAMMER, was this for services of the "Tree Accident"
of Jan. 1860 ?
In the 23 1860, F.G. 717, Census for Sevier County, (Civil District
#7, Sevierville Area), Tennessee. Post Office "Camons Store",
we find the "Crippled" JAMES D. (41yrs) SARRETT and FRANCES
"Fannie" (WATERS) HAGGARD SARRETT, (48yrs) was living on the
farm with adjoining farms of THOS. & ADELIA STOPAL (F.G. 716) and
PRESTON & ELIZABETH TOWN (F.G. 718). JAMES D. SARRETT had did very
well in this 1860 Census, with the help of his sons, his farm value
had increase to $1,000 and his personal value to $1,185. Fanny (WATERS)
HAGGARD SARRETT, was still listed unable to Read or Write, but now
she listed her birthplace as "Kentucky" instead as Tenn. as
in the 1850 Census. Oldest Stepson EZEKIEL L. HAGGARD, age 22 yrs.
was not listed with his Step-father and Mother, Had married in 1856
and was living in Civil District No. 10 (Boyd's Creek Area, F. G.
244). Son WILLIAM J. SARRETT, was 17 yrs. and working the farm for
his father. oldest daughter NANCY A. SARRETT, was 17 yrs., attending
school, and was listed as a "Spinster", My Great-Grandfather
SAMUEL H. SARRETT was 14 years of age, Attending School, and getting
into mischief. Daughter ELIZABETH JANE SARRETT, was 11 yrs, Attending
School, and playing with baby FRANCES DORIS "Dellia" SARRETT,
who was 9 years of age "Attending School".

DEATH OF JAMES D. SARRETT - Andersonville Stockade, GA.
The death of my Great-Great-Grandfather JAMES D. SARRETT who was
born on 13 Feb. 1819, Crippled by a falling tree in 1860, had joined
the Tennessee National Guard. At the age 45 years, on or near the
25th. of Feb. 1864, was captured by Rebel (Confederate) forces,
taken from his home and sent to the most feared Confederate Prison
Stockade, located at Andersonville, Sumter County, Georgia, where
6 months later, he died on the 04 Sep. 1864; The Hospital Records
show cause of death to be Dysentery [REF: #87] He has a Burial marker
of number 7923 located in the National Cemetery of Andersonville, off
of Highway 19, 60 miles South of Macon, Georgia.
Mr. DANIA W. PAYNE, who was born about 1839, and living in the Boyds
Creek area. Was 53 years of age on 04 March of 1891, when he prepared
an Affidavit for Fanny (WATERS) HAGGARD SARRETT ATCHLEY Civil
War Pension Application in which he wrote:
"I was in Andersonville prison when JAMES D. SARRETT,
was brought in there some time in the summer of 1864. I think in May
or June. I new Mr. SARRETT before the War. His son SAMUEL SERATT
was in prison with me, when his father was brought in, he (JAMES D.
SERATT) remained in same prison until he died the latter part of same
summer. I saw him after he died. He was NOT a soldier and was not
connected with the Army in any way, to my knowledge. Was taken to
prison for his loyalty to the Government".

Since the start of the War, in 1861 no body was left to run the some
200 acre Kellum Creek farm, and at the time of JAMES D. SARRETT'S
death the sons had not returned from the War. The Widowed Fanny
(WATERS) HAGGARD SARRETT, was 52 years old.
Step-son EZEKIEL L. HAGGARD, had just been Paroled at Asheville,
Buncombe, North Carolina on 26th of April 1865. (Confederate troops
"Surrendered" to the Union Federals at the end of the War)
He was 27 years old on 01 May 1865, the date he "Took it upon
him self" and filed the Bond for the Administration and Executor
of JAMES D. SARRETT, dec'd Estate, by placing a $500 Bound with
the Court. Good friend 27 year old WILLIAM F. NICHOLS was his Security.
On the same day 01 May 1965, the County Court appointed neighbors
JAMES MAPLES,
WILLIAM R. ATCHLEY and
JOSHUA ATCHLEY, Sr.
to go out on the property and "Layoff and set apart"
a years support to the Widow Fanny (WATERS) HAGGARD
SARRETT and family.
On 09th May 1865, EZEKIEL L. HAGGARD, Admin., submitted a "List
of Personal Property" of the JAMES D. SARRETT, dec'd. which
consisted of $29.45 "cash on hand" and some 25 items, 2 cows,
farm machinery misc tools, and kitchen ware. This "Inventory"
was auction off on 26th May 1865, and the Estate collected $116.70.
Its interesting to note that Fanny (WATERS) HAGGARD SARRETT, bought
back her own Milk Cow, Sugar Holders, Clock, Spinning Wheel, both
one horse plows and a Grind Stone, all for $9.75.

On 02 October 1865, the Court appointed Fanny (WATERS) HAGGARD
SARRETT, Guardian to the Minor Heirs of JAMES D. SARRETT, dec'd.
Who gave Bond in the sum of One Thousand Dollars ($1,000), with Son
EZEKIEL L. HAGGARD, age 27 and WILLIAM F. NICHOLS, age 27 as Security.
Which Bond was approved by the Court and she duly qualified. No "Heirs"
were listed in this Minutes, but the Children at the 02 Oct. 1865
date where:

On 01st of Nov. 1865, EZEKIEL L. HAGGARD came and filed this Petition,
for the sale of the two (2) undivided interest in the lands of which
the said JAMES D. SARRETT, died seized and passed. The Court asked
the Clerk & Masters Mr. M. A. RAWLINGS, to check out this Petition
to see the following and report back to the Court.:
[1st What is the value of the two (2) undivided interest
in Lands mentioned in the Petition, in this cause
[2nd Whether said Lands can be Petitioned among the
Heirs without manifest injury to the Farm.
[3rd Whether it will not be to the interest of all
concerned, to have the two (2) undivided interest sold, and the proceeds
applied to the rest of said Minors, and that he respond to the next
turn of the Court.
Their is a record in the possession of the personal collection of
my 2nd Cousin Marie (Matthews) Ottinger of a Deed of Trust,
dated 20 Nov. 1865 of Fanny (WATERS) HAGGARD SARRETT to son
SAMUEL H. SARRETT, for two 50 acre Tracts of land for $500, of the
Sarrett's Kellum Creek property (First & Second Tracts), although
this was never filed or recorded.
Note: On November 14, 1865, son SAMUEL H. SARRETT married
MARTHA A. (ATCHLEY) SARRETT, 6 days later his Mother Fanny (WATERS)
HAGGARD SARRETT, prepared this Deed of Trust of 100 acres for $500.
Although no record has been found that this instrument was ever Registered
at the County Recorders Office.

The 1865 Deed, above Northwest line of Parcel 2, property
owner AMILLIA JAMES, (Female) age 54; b. 1796, Virginia was living
as "Head of Household" along with ANANISE JAMES (Male),
age 27; b. 1823, Alabama and SUSANNAH JAMES, age 16; b. 1834, Tennessee
was living in the 1850 Census, Sevier Co., TN. (F.G. 628). No record
found in the 1850 Census of the two Witness FARRSITER and KULE...prs
On 04 Dec. 1865, the Court Decreed to accept the Petition of EZEKIEL
L. HAGGARD, Admin. and ordered the Clerk & Masters to advertise and
proceed to sell the two Kellum Creek property, to the highest bidder,
at the Court House door, and that the two tracts of land are worth
$100 each. SAMUEL H. SARRETT was the highest bidder on 28 Dec.
1865, and paid $25.00 deposit which covered the Cost of Sale of $25.60,
leaving a 12 month credit of $175, with WILLIAM R. ATCHLEY as his
Surety. This would mean he paid less, by the action of the Court?
SUMMARY OF SETTLEMENTS:
After the Sale of the Personal Property in May of 1865, the 1st.
Settlement was made on 21 Feb. 1866. The income of $116.70 sale was
brought forward as only $87.60, apparently the Clerk & Master M.
A. RAWLINGS made a mistake of $29.10. With the collection of some
$199.99 of notes received the total Estate was worth $208.59 and after
JAMES D. SARRETT's and other Court Expenses were paid of $161.06
the balance of the Estate was $47.53.
The 2nd. Settlement was on the 01st June 1867, which was a recap
of Sale of the Kellum Creek 100 Acres as listed above.
The 3rd. Settlement, was made on 04 July 1867 the only income into
the Estate was $4.15 on the previous $47.50 balance and after paying
Dr. J. M. HAMMER note of $32.00 and other Court cost the Estate
had an $17.20 balance.
The 4th. Settlement was made on 25th Aug. 1867, with interest $.29
cents on the previous balance. The new Clerk & Master WILSON H.H.
DUGGAN, charged the Estate with a $9.67 Fee for 5% on Money he collected
and other Clerk Cost, left a $7.07, balance in the Estate.
The 5th. Settlement was made on 06th Dec. 1867. The new Clerk &
Master WILSON H.H. DUGGAN, made a mistake and only brought forward
$6.08 instead of the $7.07 balance of 25 Aug. 1867. After paying a
Note from BEN? ATCHLEY of $5.00 and other Clerk Cost, left a $.47
cents, balance in the Estate.
The 6th. and Final Settlement was made on 22 Dec. 1868. No more
notes were collected, and paying JOHN M. RAMBO a $8.33 Note; Son
SAMUEL H. SARRETT, a 22 Aug. 1865 Note of $20.00 which was "Proven"
Note Samuel H. was 19 years old and home from the War 1 month July
1865; paying former Clerk & Masters M. A. RAWLINGS $5.48; and a
$11.05 "Judgment Cost" the BRABSON Brothers the Estate
lacked the sum of $45.64 of paying all the Debts of the Estate.
EZEKIEL L. HAGGARD, Admin. asked the Court that each heir pay their
proportional part.

of East Tennessee). On 21 Jan. 1866, sister NANCY A. SARRETT, sold
her "Undivided interest" for $28. to brother 5th. Owner SAMUEL
H. SARRETT (Registered "Deed Book O", Page 213 and noted
in Book 2, Page 38 on 06 Sep. 1878) 13 years after the purchase date.
No record found when SAMUEL H. SARRETT, disposed this 250
Acres of the "Kellum Creek" property. We do know that he bought
214 acres of the "Millican Creek" property for $4,500 on 16
Feb. 1878, from NOAH ATCHLEY and wife SUSANNAH ATCHLEY
On 21 Jan. 1866, their is a Deed of Trust of "All undivided
Interest" from his 22 year old sister NANCY A. SARRETT to 20
year old brother SAMUEL H. SARRETT, for the same 250 acres.

In the 24 1870 Census, for Sevier County, believed to be the Kellum
Creek property, we only find the 2nd. time Widow Fanny (WATERS)
HAGGARD SARRETT, age 62 yrs. as "Head of Household", (Living
in the "Small House") No Real Estate value listed and only
$300 personal value. She listed her birthplace as "Kentucky".
She still could NOT "Read or Write". Her Son SAMUEL H. SARRETT,
was farming on the "Big House" farm (F.G. 110) and JAMES MAPLES
and wife THURSA (MAPLES) MAPLES, (Dau of Thomas Maples & Lydia (Atchley)
Maples) was living on a large ($6,000 value) farm on the other side.
The youngest daughter FRANCES "Dellia" SARRETT, age 20,
b. 1860, Tenn., was living with her and "Keeping House".

In the 25 1880 Census, we find the 2nd. time widow Fanny (WATERS)
HAGGARD SARRETT, at 68 years, Moved into the "Big House",

Aparently this 3rd marriage did not work out. In Fanny (WATERS) HAGGARD SARRETT
ATCHLEY General Affidavit of 03 March 1891, for Pension, death of her son
WILLIAM J. SARRETT, she states:
"Perhaps about 8 years ago (1883?) I was married again
to WILLIAM ATCHLEY, we lived together about one year, when he
abandoned me. Since his abandonment, he never contributed any thing
to my support".

CIVIL WAR, PENSION for Fanny (WATERS) ATCHLEY
Fanny (WATERS) HAGGARD, SARRETT, ATCHLEY filed and was "Rejected"
from the Act of 1880. When the Congress Act of June 27, 1890, was
issued she filed and received $12.00 per month Commencing Aug. 16,
1890, until her death when WILLIAM D. ATCHLEY, mailed a letter 25
Feb. 1901, to the Federal Pension Commission and she was dropped from
the rolls on March 30, 1901. Her Pension was issued at the Knoxville
Agency, but not until 24 Aug. 1892. The following are the various

granting Pensions to dependent mothers...That she is the mother of
WILLIAM J. SARRETT, who enlisted under the name of Wm. SARRETT,
on the 1st. day of December, A.D. 1862. in Co. "K", 2nd. Tenn.
Infantry Vol. in the war of Rebellion, who was "Killed in line
of Battle, at Stone River Battle of Murfreesboro, Tenn. on the 3rd.
January, 1863....that she was dependent upon said son for support,
the aforesaid JAMES D. SARRETT, who would now be, aged 63 years,
and was disabled by a tree falling on him in the year 1860 and who
was on the 14th. Feb. 1864 Captured and taken by Rebels to prison
at where he died on 04th. Sep. 1864..Applicant remarried on 14 Feb.
1881, to WILLIAM ATCHLEY....that their were surviving at date of
said son's death, his sisters, who were under 16 years of age, as

1860 he, the said JAMES D. SARRETT sent for him, he found him badly
hurt from the falling of a tree...Crippled so that I thought he would
never be able to make a hand again by manual labor. He was well acquainted
with him, and the family, and continued his family Physician till
January 1864, when he went North and never saw him no more.

before me the undersigned authority A. P. LAWSON, 46 years of age,
whom I Certify to be respectable and entitled to credit, who being
duly Sworn State in relation to the Claimant of Fanny ATCHLEY
of Catlettsbrough No. 296380, Mother of WILLIAM J. SARRETT, dec'd.
That he was well acquainted with JAMES D. SARRETT dec'd the father
of said Soldier Wm. J. SARRETT, was his nearest neighbor at the
time he was "Crippled" and the first man at his house after
the accident occurred, he was badly "Crippled" in his right
leg by a tree falling on him. Which rendered him unable to labor as
long as he livid he being a Farmer; said SARRETT was on or about
the 25th day of Feb. 1864. Captured and taken off by Rebels and
put in Prison. Where he died on or about the 4th day of September
1864, at Andersonville, Georgia.
The said JAMES D. SARRETT was a Poor man, made his
living as long as he was able by Farming. He owned some land, but
not sufficient to make a support for him and family. He rented land
from me at different times and to my knowledge he rented every year
from some one or other.
After his death his widow suffered nearly all the property
belonging to him, by law sold to pay his debts, which failed to wait,
and the lands were sold which still left a deficiency of about one
hundred dollars. The mother of the Soldier was consequently dependent
upon the labor of her son for a support, he being a minor and would
have been living at home and she receiving the benefit of his labor.
I further know that the Soldier was in the habit of working
out from house for the benefit of the family, and that I am not interested
in this claim.

That he was well acquainted with JAMES D. SARRETT dec'd had known
him personally since 1846 up to that time he was taken off to Prison
in 1864. I lived in 1 1/2 miles of him. I know that on or about the
20th day of January, 1860 the said JAMES D. SARRETT was badly
"Crippled" by a tree falling on him and that he remained,
so much so that he was unable to work, he went about on crutches.
I was one of the Commissioners appointed by the County
Court to value the Real Estate of the said JAMES D. SARRETT after
his death, which took place in Andersonville, Georgia, Prison on or
about the 4th day of September 1864.
Said lands and all other property had to be sold to pay
debts, I mean all the lands except the Widows Dower and after exhausting
all means there, was still deficiency of something over one hundred
dollars.
I know that said JAMES D. SARRETT was the father of
the Soldier Wm. J. SARRETT and that the said FRANCS ATCHLEY the
claimant was dependent upon the labor of the Soldier for his support,
that I am not interest in this Claim.

sent a memo on 15 Dec. 1882, to the War Department for verification
of WILLIAM J. SARRETT service, the War Department responded with

Out" Roll of Company dated Dec. 15th 1864. Killed in action
at the Stone River, 3rd Jan. 1863. Never Mustered. Company was in
action there on that date. Name WILLIAM J. SARRETT is not known.
Fanny (WATERS) HAGGARD, SARRETT, ATCHLEY filed a second
time on the 5th. May 1833, basically the same information as her first
one on the 16th. Oct. 1882. She did change her Attorney to M. B. MANCHAN?.
The two witness who watched her sign her mark were A. M. McCOWAN
and W. W. MONTGOMERY both of the 5th. Civil District, of Sevier
Co., TN.

Office REJECTED the Widow Fanny (WATERS) HAGGARD SARRETT ATCHLEY,

"Submitted for rejection on the ground of the neglect,
and apparent inability of the claimant to furnish proof showing dependence,
________, income, means of support, celibacy, and contributions.
This claim has been abandoned (four) years."

It went in front of the "BOARD OF REVIEW" on 16 Nov. 1887.
The "Legal Reviewer" was F. WOOD he had a ready made Stamp
which read:
"Rejected on the ground of Claimants failure after a
reasonable time, and due notification, to furnish the necessary evidence
to establish the claim".
Notification was sent to Claimant on 10 Dec. 1887.
It is the opinion of this writer, although there is no specific
statement from the Pension Examiner, but the fact of Fanny (WATERS)
HAGGARD SARRETT' s marriage to WILLIAM ATCHLEY was the main problem,
she did not qualify. (Celibacy.....prs)
The Pension Act of June 27, 1890, opened another opportunity for Fanny
(WATERS) HAGGARD SARRETT ATCHLEY to file for the Third time. This
time she seemed to have a pretty good lawyer JOHN W. ANDES made
the application simple, to the point, with little or no items of conflict.
(such as the previous two were cluttered with items as William middle

District in the County of Sevier, State of Tennessee, whose Post Office
is Catlettsburg... aged (blank) years a resident of Catlettsburg....being
duly sworn, declared in relation to aforesaid case as follows:
On the 22nd. of Oct. 1841, Claimant was married to JAMES
D. SARRETT in the presence of ELIJA BALARA(BALLARD)and NANCY THOMAS
the marriage ceremony performed by RANDAL HILL, Esq.. WILLIAM J.
SARRETT was born 11 Jan. 1843 and was the lawful son of JAMES D.
SARRETT and myself. Sometime in the fall or winter of 1862 he left
home and joined the Federal Army in Co. "K", 2nd. Reg. Tenn.
Infantry and my information is was killed in Battle at Stone River,
Tenn. I never seen him since. My husband was a Union man living in
Sevier County, Tenn. and sometime during the war perhaps in 1864.
The Rebels arrested him on account of his Union sentiments. They took
him off put him in some Rebel Prison. Where I learned he died. This
leaving me alone to support my family of children. Less I could, perhaps
about 8 years (1883?) ago was married to WILLIAM ATCHLEY, we lived
together about one year when he abandoned me. Since his abandonment
har never contributed anything to my support. I do not own any property,
neither have nor personal. Was living with my son SAMUEL H. SARRETT
he died a few months since, leaving me without any one living legally
having for my support. Being old and in bad health and no one to support
me ask the consideration of something from the Government for the
sacrifice of my son in my ailing years my family all dead, but one
daughter.

D. SERATT. I was in Andersonville prison when JAMES D. SARRETT,
was brought in there some time in the summer of 1864. I think in May
or June. I new Mr. SARRETT before the War. His son SAMUEL SERATT
was in prison with me, when his father was brought in, he JAMES D.
SERATT remained in same prison until he died the latter part of same
summer. I saw him after he died. He was NOT a soldier and was not
connected with the Army in any way, to my knowledge. Was taken to
prison for his loyalty to the Government".

I am personally with claimant, FRANCES ATCHLEY for
11 years. He is personally known to her remarriage to WILLIAM ATCHLEY,
some time near 7 or 8 years since. They living together something
near one year when her husband Wm. Atchley abandoned her and his
understanding is said ATCHLEY has never contributed any thing to
her support. Since he abandoned her and further state if she has any
means of support he has no knowledge of it. She lived with her son
who maintained her during his life, but he died something near 12
months ago making no provisions at his death for her support to my
knowledge and if claimant has any property either Real or Personal
I have no knowledge of it. Further testifies he has lived on her sons
Farm for 11 years and to his own knowledge she lives with her children
from house to house. Having no permanent home her only son SAMUEL
H. SARRETT having died leaving her now without any one legally having
for her support.

they were close neighbors prior to the war and am personally acquainted
with Mrs. ATCHLEY and know her to be his lawful mother.

Two years later from the date that Fanny (WATERS) HAGGARD SARRETT
ATCHLEY filed her (3rd.) Pension Application, on 04 August 1892
the Legal Reviewer for the Pension Commission 84 Mr. McDANIAL
recommend:
"Approval for Admission, origin of death of Soldier
and that claimant is with out other means of support or the contributions
of others are not legally bound for her support".
The Pension No. 341,811 85 was Issued on 24 Aug. 1892, Commencing
with 16 Aug. 1890 (the date the 3rd. Application was filed) at the
Rate of $12.00 per Month. This was issued out of the Knoxville Agency.
She received this $12.00 per month up until her death 29 Nov. 1900.
She received $480 per year for the next 10 years ($4,800) for the
death of her son WILLIAM J. SARRETT.
On 25 Feb. 1901, WILLIAM D. ATCHLEY sent a letter to the Pension
Commission to inform them of Fanny (WATERS) HAGGARD SARRETT ATCHLEY
death.
On 04 Nov. 1900 she was dropped from the "Dependent Mother"
Rolls of the United States Pension Agency. The following was issued
on 30 March 30, 1901 informing the Commissioner of Pensions.

and we find the 2nd. time widow and abandoned, $12.00 per month Pensioner
FRANCES (WATERS), HAGGARD, SARRETT, ATCHLEY (89 yrs), as a "Boarder"
with her life long sister and friend NANCY (WATERS) THOMAS (78 yrs).
These two sister were being taken care of by Mr. & Mrs. EVANGOTON
& SENIE CUMMINGS (Spelling?).

DEATH OF "Fannie" (WATERS) HAGGARD\SARRETT\ATCHLEY
FRANCES "Fannie" (WATERS) HAGGARD SARRETT\ATCHLEY, born 14
Feb. 1812, died on 29 Nov. 1900, at the age of 79 Years, 9 Months,
and 15 Days. She is buried in the "Adler Branch" Cemetery,
Sevier Co., TN. She survived 4 husbands, the Civil War, 3 of her
five children (Nancy A. (Sarrett) McCarter and Elizabeth Jane (Sarrett)
Hardin were her two children who were living when she died..prs).
4 of her Grandchildren, and one Great-Grand Child.
After the death of my Great-Great-Great-Grandfather JAMES D. SARRETT
in 1864 she was a widow for 17 some years, when she married WILLIAM
ATCHLEY in 1881, which only lasted a year, (It;s been reported she
kicked him out because he did not want to work, it was a Sin not
to work in the Sarrett household ..prs) then for the next 8 years,
she lived with her son SAMUEL H. SARRETT until his death in 1890,
latter for the next 10 years, she lived among her two daughters and
boarding houses, a total of 35 years of her adult life as a "Widow".
FRANCES (WATERS) HAGGARD SARRETT ATCHLEY
Mrs. Fannie Sarrett, was one of the strong early pioneers,
that has made this country as strong as it is today. Born and matured
to adulthood in her home land of Tennessee. Living the hardships of
being a widow for so many years. She had no convinces, and probably
would not have wanted them because she could not understand them as
in her girlhood days. On the other hand she might have welcomed electric
lights, milking machines, gasoline engines, and of coarse Supermarkets.
The love and regard of her children and appreciation of her neighbors,
testified to the high esteem in which she was held.
