Regulations as to Retirement of Navigating and Civil Officers


Gazette Notice.-

Admiralty, March 2, 1870.

Her Majesty, by Order in Council the 22nd February 1870, having been graciously pleased to sanction proposals relating to Navigating and Civil Officers, with a view to the benefit of the Naval Service, the Lords Commissioners of the Admiralty give notice of the mode in which such arrangements will be carried out. The Regulations will take effect from the 1st of April 1870.

Officers on Half-pay, to whom option is hereby given of electing to be dealt with under the Regulations hitherto in force or under this Scheme, are to signify in writing, before the 21st of March, to the Secretary of the Admiralty, the election they have made ; stating, moreover, whether they are anxious to be allowed to retire, in order to facilitate the reduction of the Active Lists.

Officers not signifying their intentions before that date will be considered to have elected the New Regulations

The subjoined scale will show the age at which Officers will he compulsorily retired, and also that at which they may optionally retire.

I.-As relates to Navigating Officers.

1. Staff Captains to be retired at the age of 60 � or at any age if they have not served for 7 years. To be retired, irrespective of age, at our discretion, if found physically unfit to serve
Staff Commanders to be retired at the age of 55 or at any age it they have trot served for 5 years.
Navigating Lieutenants to be retired at the age of 45 � or at any age if they have not served for 5 years.
  1. Staff Captains to have the option of retiring at the age of 55 ; and Staff Commanders at the age of 50.
  2. The Active List of Navigating Officers to be reduced to 265:-

All services as Navigating Sub-Lieutenant, and as Acting Navigating Sub-Lieutenant, to be allowed to reckon towards retirement and for increase of full-pay and half-pay, in the proportion specified in the scales for full and half-pay, herein-after set forth, where it is termed "Junior Service."
  4. A number of Navigating Officers, not exceeding in all 3 annually may be promoted from the ranks of Staff Captain, Staff Commander, Navigating Lieutenant or Navigating Sub-Lieutenant, to be Captain, Commander, Lieutenant or Sub-Lieutenant respectively, under such Regulations as We may prescribe.
  5. For the purposes of promotion on the Active List and of rising to rank on being retired, "Sea Service" to mean Service in Her Majesty's Ships at Sea.
  6. Time served while surveying Coasts and Harbours in other than regular Surveying Vessels to count as sea service for all purposes.
  7. Time served in the Coast Guard on shore only to count as two-thirds service for the purpose of retirement.
  8. No Navigating Officer to be entitled to the rates of pay and half-pay exceeding 15s. and 9s. a day respectively day unless he shall have qualified for first-class ships under such Regulations as We may prescribe.
  9. All Navigating Officers who have not qualified for first-class ships to receive when retired the active half-pay pay they have earned by service.

II --.As relates to Inspectors of Machinery and Chief Engineers.

Chief Inspectors of Machinery to be retired at the age of 60 ; or at any age it they have not served for 7 years To be retired irrespective of age, at the discretion of the Admiralty, if found physically unfit to serve
Chief Engineers to be retired at the age of 55 ; or at any age it they have not served for 5 years.
  1. Chief Inspectors and Inspectors of Machinery to have the option of retiring at the age of 55 and Chief Engineers at the age of 50.
  2. The Active List of Inspectors of Machinery and Chief Engineers to be reduced to 180:

  3. All service as Engineer, and Assistant Engineer 1st Class, to be allowed to reckon towards retirement and for increase of full-pay and half-pay, in the proportion specified in the scales for full and half-pay herein after set forth, where it is termed "Junior Service."

III. As relates to Chaplain

  1. To be retired at the age of 60 or at any age if they have not served for 5 years.
  2. To have the option of retiring at the age of 55, and to be retired, irrespective of age, at Our discretion, if found physically unfit to serve.
  3. The Active List of Chaplains, including Chaplains who are also Naval Instructors, to be reduced to 100.
  4. Clergymen, duly qualified under such regulations as We may make, to be allowed to take temporary service in the Navy, and will be appointed as "Acting Chaplains for Temporary Service" on such occasions. While so, employed, to occupy the same position, receive the same rates of pay, enjoy all the same privileges as ordinary Naval Chaplains, and be subject to the same Regulations, but not to be entitled to half-pay or other advantages at the termination of such temporary service.
  5. The regulation under which Chaplains are now allowed to retire on the half-pay earned by service on attaining 15 years' seniority to be abolished.
  6. Chaplains accepting any Living to be at once placed on the Retired List.

IV.-As relates to Naval Instructors.

  1. To be retired at the age of 60; or at any age if they have not served for 3 years.
  2. To have the option of retiring at the age of 55; and to be retired, irrespective of age, at Our discretion, if found physically unfit to serve.
  3. The Active List of Naval Instructors, including Chaplains who are also Naval Instructors, to be reduced to 75.
  4. The Regulation under which Naval Instructors are now allowed to retire on half-pay, after 15 years' service, to be abolished.

V. As Relates to Medical Officers

1. Inspectors and Deputy Inspectors of Hospitals and Fleets to be retired at the age of 65 ; or at any age if they have not served for 5 years. To be retired irrespective of age, at the discretion of the Admiralty, if found physically unfit to serve
Staff Surgeons to be retired at the age of 60 ; or at any age if they have not served for 5 years.
Surgeons to be retired at the age of 55; or at any age if they have not served for 5 years.
Assistant Surgeons to be retired at the age of 45 ; or at any age if they have not served for 5 years.
  1. Inspectors and Deputy Inspectors of Hospitals and Fleets to have the option of retiring at the age of 60; Staff Surgeons at the age of 55; and Surgeons at the age of 50.

VI. As relates to Paymasters and Assistant Paymasters.

  1. Paymasters to be retired at the age of 60 ; or at any age if they have not served for 5 years.
  2. To have the option of retiring at the age of 55; and to be retired, irrespective of age, at Our discretion, it found physically unfit to serve.
  3. The Active List of Paymasters, including Secretaries, be reduced to 240.

  5. The number of Assistant Paymasters, Clerks, and; Assistant Clerks to be reduced to 260.

  7. All service as Assistant Paymaster to be allowed to reckon towards retirement, and for increase of full-pay and half-pay, in the proportions specified in the scales for full and half-pay, herein-after set forth where it is termed "Junior Service."
  8. No Assistant Paymaster to hold the appointment of Secretary to a Commander-in-Chief, Flag Officer, or Commodore of the First Class.
  9. Officers of the above ranks holding, or who may have held civil employment under the Admiralty, not entitling there to civil superannuation, to be restored to, or retained in their places on the Active List, if in all respects qualified for that List; with all advantages as to pay, half-pay, and retirement provided by Section VII, paragraph 3, of these Regulations.

VII.-Definition of Service for the above Ranks.

  1. Service to mean service on full-pay.
  2. For the purposes of regulating pay, half-pay, promotion, and retirement, there will be no distinction between Sea and harbour Service, except as provided in Section I with reference to Navigating Officers, and in Section V. with reference to Medical Officers.
  3. Civil employment at or under the Admiralty, or service under any other Department which may be declared by Us, with the consent of the Lords Commissioners of Her Majesty's Treasury, to be for this purpose. Naval Service, if it does not count for or towards Civil Superannuation shall count as full service for increase of pay, half-pay, and towards retirement ; but it shall not be deemed service for any other purpose.
  4. Time on half-pay, with the exception of Civil Service at or under the Admiralty, not to count for increase of full or half'-pay, nor for promotion, but to count as one-third of full service for retirement.

VIll.-FULL-PAY.

X.

The Scale of Retired Pay, according to Age and Service, to be as follows for Navigating Officers, Inspectors of Machinery and Chief Engineers, Chaplains, Naval Instructors, Medical Officers and Paymasters.

An addition to be made as specified for each full year of additional sea service, or its equivalent, but the same not to exceed 5 years, and a deduction to be made for each full year wanting to complete the periods specified ; but the same not to exceed 10 years.

  1. An extra �10 per annum to be given to Staff Captains and to Chief Inspectors and Inspectors of Machinery, for each year's service in those ranks, provided that such increase will not bring their retired pay to more than �450 a year, which shall be the maximum retired pay for those ranks.

  5. Officers to be allowed, at their option, to retire either upon the above scale or on the active half-pay of their rank at the time of retirement.
  6. The retired pay of Officers who entered, or who shall hereafter enter Her Majesty's service after he age of 25, and in cases of Chaplains or Chaplains and Naval Instructors after the age of 30, will not depend on their age, but on their service only. The provisions contained in first and fourth columns of the Scale of Retired Pay will not apply to such Officers ; but the retired pay shall in no case exceed the fixed maximum for each rank. Should any such Officer have less than 20 years' service he will be granted on retirement the active half-pay he has earned by service.
  7. After retirement no increase of pay to be allowed to any Officer. The only addition possible to be in the form of Pension.
  8. The power vested in Us to grant lower rates of half-pay in cases of misconduct, to be extended to retired pay.
  9. Power to be reserved to Us to suspend at any time, and with respect to any rank, the provisions of the Order, under which all Officer may, at his option, retire at an age less than that fixed for compulsory retirement in each rank.
  10. Retirement from the Active List not to disqualify any Officer for employment at or under the Admiralty.
  11. All Officers to be allowed, at their own request, and with Our consent, to compound their retired pay under the Rules laid down by the Lords Commissioners of Her Majesty's Treasury for administering Act 32 & 33 Vict. Cap 32.

XI Pensions.

  1. Naval and Greenwich Hospital Pensions to be awarded to old, infirm, wounded, and disabled Officers on Retired List of long service, but not to be conferred as a qualification for Retirement. Except as herein stated, the qualification for, and the distribution and amounts of these Pensions to remain as defined by existing Regulations.
  2. The following alteration in the distribution and amounts of Greenwich Hospital Pensions to be made:-
  3. Staff Captains and Captains retired from Staff Captains List 1 Pension of �80.   
    Staff Commanders and Navigating Lieutenants, and Captains retired from Staff Commanders' List. 2 Pensions of �50
    Chief Inspectors and Inspectors of Machinery 1 Pension of �80
    Chief Engineers 7 Pensions of �50
  4. In calculating service for these Pensions the same Rules to apply as for Retirement.
  5. All Officers in receipt of Naval or Greenwich Hospital Pensions not to be allowed to retain them after being promoted.
  6. No Pension, except a Pension for wounds, can be commuted.

XII Temporary Provisions

  1. The following provisions to apply to Navigating Officers, Chief Inspectors and Inspectors of Machinery, Chief Engineers, Chaplains, Naval Instructors, Medical Officers, Paymasters, and Assistant Paymasters, now holding those Ranks on the Active List.
  2. All Officers to whom, under the following clauses, an option is given, must signify to Us in writing, within such time as may be prescribed, in what manner they elect to exercise such option. In the event of their failing to intimate their wishes, it will be assumed that they have elected the new Regulations for Retirement laid down in this scheme.
  3. The new scales of pay and allowances to apply to all Officers unless they request in writing, within such time as may be prescribed, to be paid according to those now in force, in which case they will continue to receive the old rates of pay and allowances during all their future services except present Assistant Paymasters, who, when promoted to the rank of Paymaster, will only be entitled to receive pay according to the new scale.
  4. Officers to whom option is given, and who elect to be dealt with under the old Regulations, will retain their present rights as to half-pay, promotion, and retirement, except so far as they are expressly limited by these Temporary Provisions, but they will have none of the advantages of the new Regulations, except as to pay and allowances in accordance with the preceding clause.
  5. [By Circulars 62 of 1873 21 of 1874, provision is made for allowing Officers to change from old to new Regulations if they would not, under the new Regulations, have been compulsorily retired before the date of application to exchange.]

  6. Officers to whom option is given, and who elect to be dealt with under the " New Regulations," will receive half-pay, and will be promoted and retired in accordance with them, and will retain no rights abolished by them, except so far as is expressly laid down in these Temporary Provisions.
  7. Present Navigating Officers, Chief Inspectors and Inspectors of Machinery, Chief Engineers, Medical Officers, and Paymasters, to be retired under the conditions as to age and non-service within a term of years, which are fixed by the new Regulations; but to be allowed an option of retiring on the scale herein provided or on the terms they now enjoy.
  8. Present Chaplains and Naval Instructors to be allowed, at their option, either the terms of the "New Regulations" as to half-pay and retirement, or the privilege of remaining under the old Regulations ; but in no case to be allowed to remain on the Active List after they have attained the age of 60.
  9. Chief Engineers who entered Her Majesty's service before 27th February 1847 to be allowed to count towards retirement all time served as 1st and 2nd class Engineer.
  10. Until the Assistant Paymaster's List is reduced to 200, Assistant Paymasters of 3 years standing may, with their consent, be retired with the pay of 3s. 6d. per diem an additional 6d. being given for each complete year beyond three served as Assistant Paymaster until the maximum is reached, viz., 6s. per diem.
  11. Until the Active Lists shall have been reduced to the numbers proposed, Officers, of whatever age, may be retired with their consent, and at Our discretion; if they are above 40 years of age, upon the terms of the new Regulations; if they are under 40, upon the half-pay of their rank according to the new Regulations.

All present Rules and Regulations, except in so far as they are expressly altered or limited by these General or Temporary Provisions, shall be deemed to remain in force.
