Last Will and Testament of Robert T. King

The "Will" included below was provided in April of 2002, but was not posted to the web site until June 2003. This document is also posted to the Rootsweb Message Boards under the classification of "Will". At some date it is expected that a major topic will be started for Wills, but at this time documents such as this will be listed under the "Everything Else Goes Here" category. Julie has provided the following comments: "Below is a copy of the last will and testament of my great-great-great-grandfather Robert T. KING, filed in Erie County on June 17, 1854. I transcribed the main part of the will, and also plan to transcribe some of the other papers filed as well, such as papers filed by his eldest son Lyman King contesting the will."


"I, Robert T. King of the town of Wayne in the County of Erie and State of Pennsylvania, being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore in the first place recommend my soul to God who gave it, and therefore make, ordain and publish and declare this to be my last will and testament, that is to say First after all my lawful and just debts are paid and discharged, the residue of my estate real and personal I give and bequest and dispose of as follows to wit – To my beloved wife Annis King I give all the household furniture and one half of the personal property after the Debts is first paid out of the whole of said personal property to have and to hold the same and dispose of as she sees fit so to do, and also to have the use of the Homestead Farm during her natural life, known and described as follows, it being in Wayne Township in the County of Erie & State of Pennsylvania namely – it being sixty six acres in Lot No two thousand one hundred and eleven, and also the twenty six acres formally bought of Joshua Lathrop and also the strip of land bought of Amos Green lying in Chautauqua County, NY – To my oldest son Lyman King one dollar, To my oldest daughter Patience Fields one dollar, To Lucy Dutton my second daughter one dollar, To Lydia Hubbert my third daughter one dollar, To my second son Robert King one dollar, To my third son William H. King one dollar, To my fourth daughter Eliza Keetch(sic) one dollar, To James B. King my fourth son that is now living one dollar, To my son Joshua T. King one dollar, To my son Thomas R. King twenty five acres of land in Tract No two thousand one hundred and six on the Tenth Donation Destrict bounded East by the road leading from Columbus to the State line & West by the County line & South by land owned by Kenney Tillotson. To my other three sons Georg(e) King, Hiram King, and Benjamin F. King I give eighty seven acres of land on Lot No two thousand one hundred and ten on the tenth Donation Destrict Bounded East by the Center of the Brokenstraw Creek North by the line of the tract and West by the East line of Martin Kings and by the West line of said tract and South by Stodard Smiths and also ten Acres and three fourths of land in French Creek Township Chautauqua County, NY, deed to my by Doct Mills and wife and also the Homestead Farm that is herein described and the use of given to my wife Annis during her lifetime to have the said Homestead Farm after her death and also to have the said personal property that is not herein before disposed of, to have said personal property as Each one becomes of lawful age. The above described property bequeathed unto and given to the aforesaid George King, Hiram King, & Benjamin King is to be divided equally between the three. Likewise I make constitute and appoint my said wife Annis King to be the Executrise of this my last will and testament hereby revoking all former wills made by me. In Witness whereof I have here unto subscribed my name and affixed my seal the Seventeenth day of June one thousand Eight hundred and Fifty four. (June 17, 1854)

The above written instrument was subscribed by the said Robert T. King in our presence and acknowledged by him to Each of us & he at the same time published and declared the above instrument so subscribed to be his last will and testament and are at the testator’s request and in his presence have signed our names as witnesses hereto and written opposite our names our respective places of residence.
