1877 Deed - Steenberg to McKendree

The document below is an 1877 land deed transcribed by Evelyn Baker, who has submitted it for posting to this web site. John & Kathleen Szympruch are the present owners of the old Steenberg farm, located on Steenberg Road in Springfield Township. John serves on the Springfield Township Council. They have lived on the 18.7 rolling acres for over 20 years. They own a unique collection of Steenberg history. John laments, "I put 10 gallons of tar on the roof, but the old barn still leaks". Before me, the subscriber, a Notary Public in and for said County, personally came the above named G. T. STEENBERG & R. A. STEENBERG, his wife, ROBERT E. McKENDREE & ELLA M. McKENDREE, his wife, & E. F. MALLORY, Guardian of said ELLA M. McKENDREE, & severally acknowledged the above Indenture to be their act & deed for the purposes therein mentioned, & did desire that the same might be recorded as such according to law.

The said R. A. STEENBERG & ELLA M. STEENBERG, each being by me examined separate & apart from their said husbands, & the contents of the foregoing indenture being first made fully known to each of them, severally declare that they will voluntarily & of their own free will & accord, seal, & as their & each of their act & deed deliver the same, without any coercion or compulsion of their said husbands.

In testimony whereof I have hereunto set my hand & official seal this

THIS INDENTURE  made the 16th day of April A. D. 1877 between G. T. STEENBERG & R. A. STEENBERG, his wife, of Springfield Township, Erie Co., Pennsylvania, of the one part,

& ROBERT E. McKENDREE & ELLA M. McKENDREE, his wife,

& E. F. MALLORY, Guardian of ELLA M. McKENDREE, of the same place, of the other part.

WHEREAS  the said R. A. STEENBERG, wife of G. T. STEENBERG, & the said ELLA M. McKENDREE, wife of ROBERT E. McKENDREE now stand seized in fee simple, as parteners ( being the children & heirs of JOHN D. GERRED, deceased ) subject to the widows dower, of & in a certain tract of land or farm situated in Spingfield Township, aforesaid & containing about fifty [ 50 ] acres.

NOW THIS INDENTURE  Witnesseth that the parties to this indenture have agreed to make, & by these presents do make a full, just, equal, perfect, & absolute partition & division between them ( the said Mrs. R. A. STEENBERG & ELLA M. McKENDREE, daughters & heirs of JOHN D. GERRED, deceased ) of & in the aforesaid farm or tract of land according to their respective shares & interests therein, in manner following, that is to say.

That the said Mrs. R. A. STEENBERG & her heirs & assigns shall have all that piece or allotment of land, parcel of the said farm, lying & being on the west side of the road running from JOSEPH EAGLEY's On The Lake Place to Captain IVORYs on the Ridge Road & more particulary described & bounded as follows:

Bounded ... by the Middle Road & land of E. F. MALLORY, on the east by the north & south road, on the south by land of ALPHONSO IVORY & WILLIAM MILLER, & on the west by land of JAMES HUBBARD, & containing about twenty [ 20 ] acres of land, be the same more or less, & having erected thereon a barn, etc. And all the rights, liberties, privileges, hereditaments, & appartenances whatsoever, thereunto belonging or in any wise appertaining, & the reversions &

remainders, rents, issues, & profits thereof.

TO HAVE AND TO HOLD  the same unto the said Mrs. R. A. STEENBERG's

heirs & assigns forever, in severally, as her & their full part, share, & dividend, of & in all & singular, the premises.

And the said ELLA M. McKENDREE doth, by these presents, being joined by her said husband, ROBERT E. McKENDREE & her said Guardian, E. F. MALLORY, for herself & her heirs, give, grant, allot, assign, set over, release, & confirm, unto the said Mrs. R. A. STEENBERG & to her heirs & assigns forever, the said described price as allotment of land with the appartenances, to have & to hold to her the said Mrs. R. A. STEENBERG, her heirs & assigns, to the only proper use & behoof [ benefit ] of her the said Mrs. R. A. STEENBERG, her heirs & assigns forever in severally.

And that the said ELLA M. McKENDREE & her heirs shall have that price or allotment of land, residue of said tract, situated on the east side of said road, & more particularly bounded & described as follows -

Bounded on the north by the eight & one fourth [ 8 ¼ ] acres set off to the widow MARY J. GERRED, on the east by land of ORRIN NYE & ANDREW STILLSON, on the south by land of ANDREW MALLORY's heirs, and on the west by the land north & south road & containing about thirty [ 30 ] acres of land be the same more or less & having erected thereon a brick dwelling, orchard, etc.

And all right, liberties, privileges, hereditaments, & appartenances whatsoever thereunto belonging or in any wise appertaining, & the reversions & remainders, rents, issues, & profits thereof, to hold & enjoy the same unto the said ELLA M. McKENDREE, her heirs & assigns forever, in severally as her & their full part, share, & dividend, of & in, all & singular the premises.

And the said R. A. STEENBERG, being joined by her husband G. T. STEENBERG, doth by these presents for herself & her heirs, give, grant, allot, assign, set over, release, & confirm unto the said ELLA M. McKENDREE, & to her heirs & assigns forever, the said last described piece or allotment of land, with the appartenances.

To have & to hold unto her the said ELLA M. McKENDREE, her heirs & assigns, to the only proper use & behoof of the said ELLA M. McKENDREE her heirs & assigns in severally forever.

IN WITNESS WHEREOF the said parties have hereunto set their hands & seals,

                                  the day & year aforesaid.
