AGREEMENT

Between SALLY A. SMITH

CYRUS  W. SCOTT & Wife

MILTON R. WOOD & Wife

and

HIRAM NICHOLS

 

Articles of agreement made and entered into the 8th day of December in the year of our Lord 1863, between SALLY ANN SMITH of Springfield and CYRUS W. SCOTT & HARRIET J. &  his wife of Conneaut Township, all of Erie county and state of Pennsylvania, & MILTON R. WOOD and LUCINDA M., his wife, of Vernon County, state of Wisconsin, of the one part and HIRIAM NICHOLS of Girard Township in the county of Erie and state of Pennsylvania, of the other part.

The said SALLY ANN SMITH, CYRUS W. SCOTT & wife, and MILTON R. WOOD and wife, for the consideration hereinafter mentioned for themselves, their heirs, executors, administrators, do covenant, promise, grant & agree to with the said HIRAM NICHOLS, his heirs & assigns by these presents, that they the said SALLY A. SMITH, CYRUS W. SCOTT & wife, & MILTON R. WOOD & wife, shall & will, on or before the first day of January 1871, at the proper certs and charges of the said parties first named, their heirs and, assigns by good and lawful deed or deeds, will and sufficiently grant, convey, and assure unto the said HIRAM NICHOLS, his heirs and assigns, in fee simple clear of all encumbrances, all that messuare or piece of land situate in Springfield aforesaid and bounded and described as follows, to wit:

Beginning at the southwest corner of the tract at the northwest corner of land owned and occupied by JOSEPH WELDON thence by the west line of the tract, north to the middle of the Center Road (so called) thence following the center of said road in a northeastwardly direction to the north line of the original lot of which the land hereby conveyed or intended so to be is a part and the south line of lands of HARRY MALLORY, thence east by lands of said MALLORY to the northeast corner of lands hereby conveyed, thence south by lands of ORRIN NYE 68 rods & 5/10s of a rod to a corner. Thence west by land of ANDREW MALLORY, THOMAS IVORY, and JOSEPH WELDON 167 rods to the place of the beginning containing 58 acres of land more or less. In consideration where the said HIRAM NICHOLS for himself his heirs and assigns, executors & administrators doth covenant promise and agree to and with the said SALLY A. SMITH, CYRUS W. SCOTT and HARRIET J. his wife, & MILTON R. WOOD and LUCINDA M. his wife  their heirs and assigns by these present that he the said HIRAM NICHOLS, his heirs, executors, & administrators, or some of them, shall and will, well & truly pay or cause to be paid unto the said first named parties, their executors, and administrators or assigns the sum of $2,100

In a manner following, to wit:

$300 on the 1st day of July 1864

$100 on the 1st day of January 1865

$300 on the 1st day of January 1866

$300 on the 1st day of January 1867

$300 on the 1st day of January 1868

$300 on the 1st day of January 1869

$300 on the 1st day of January 1870

$200 on the 1st day of January 1871, the balance with annual interest payable on the 1st day of January each year on the whole unpaid sum or sums to be computed from the 1st day of January 1864 and the payment of the said several sums of money is declared to be a condition precedent to the execution of the deed or deeds of conveyance aforesaid by the said SALLY A. SMITH, CYRUS W. SCOTT & wife, & MILTON R. WOOD & wife.

And for the true performance of all & every, the covenants & agreements aforesaid each of the said parties bindeth themselves, their heirs, executors, and administrators in the penal sum of $5,000 firmly by these presents.

 In witness whereof the said parties to these presents have hereunto set their hands & seals, dated the day & year first above written.

$133.33 received June 29, 1866 on the within article for which I have given a seperate receipt. SALLY ANN ANDERSON

$266.67 received July 8, 1864 to apply on the within article for which I have given a seperate receipt. C. W. SCOTT

$300 received May 10, 1865 on within article.

$236.55 received Feb. 22, 1871 on the within agreement, being amount in full. C. W. SCOTT

 

For value received, I hereby assign all my right title interest & claim on the within agreement to NATHAN MERSHON, his heirs & assigns, West Springfield on March 24th, 1865. HIRAM NICHOLS
