Abel Whitney Chronology

The information below has been contributed by site visitor Cathy Herpich. During a recently completed trip to Erie, she copied several documents relating to Abel Whitney. She was tracking him as a possible link to her ancestor. As it turned out, this was not the case. Fortunately, for anyone else who might be researching this name, Cathy has transcribed the census information, land records, and estate file information into a chronology of Abel Whitney. Punctuation and spelling has been retained as accurately as possible.

This Indenture made the twenty Second day of March in the year of our lord one thousand eight hundred and Twenty eight Between William Culbertson of the Township of Conneauttee in the County of Erie and State of Pennsylvania Esquire of the first part and Abel Whitney of the Township, County & State aforesaid Gentleman of the Second par. This Indenture Witnesseth that the said party of the first part for and in consideration of the Sum of Ten dollars money of the United States to him in hand paid by the said party of the second part at and before the ensealing and delivery of these presents the receipts and payment whereof I do hereby acknowledge and thereof acquit and forever discharge the Said party of the Second part, this heirs, executors and administrators by these presents that grantee bargained sold aliened enfeoffed released and confirmed and by these presents does grant bargain sell alien enfeoff release and confirm unto the Said A Whitney of the Second part and to his heirs and assigns all that certain piece or parcel of land or tenement described as follows, Viz. Situate [sic] and lying in the Township of Conneauttee aforesaid Being a Village lot No. 1 and on Tract No. 429. Beginning at the South East Corner at a post, thence running nort[?] 15 ˝ degrees East on Erie Street 54 feet to a post. Thence north 74 ˝ degrees West on lot No. 2 one hundred sixty eight feet to a post, thence South on Mill Alley 12 degrees East ninety eight feet to a post. Thence due East on public ground one one[?] hundred and twenty-Six feet to the place of Beginning, one fourth of an acre be the Same more or less and being a part of a larger Tract conveyed by deed from the population Company to John Griffith of the State of New Jersey and John D. Wallace of the City of Philadelphia Esquires and from the said Griffith & Wallace by their attorney infact H. J. Huidehoper[?] to the Said Wm Culbertson Esq Together with all and Singular the buildings improvements rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and also all the Estate right title interest claim and demand whatsoever of him the Said William Culbertson of the first part in law or equity or otherwise howsoever of into or out of the Same to have and to hold the Said Village lot or tenement, with all the privileges hereditaments and premises hereby granted mentioned or intended So to be with the appurtenances unto the Said A Whitney of the Second part his heirs and assigns. To the only proper use benefit and behoof of the Said Whitney of the Second part his heirs and assigns forever and the Said Wm Culbertson of the first part his heirs executors and administrators do hereby covenant promise grant and agree to and with the Said Whitney his heirs and assigns by these presents that he the Said Wm Culbertson of the first part his heirs the above mentioned and described premises hereby granted or mentioned or intended. So to be with the appurtenances unto the Said A Whitney of the Second part against the Said Wm Culbertson and his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim by from or under him the Said Culbertson Shall and will warrant and forever defend these presents. In witness whereof the Said party to these presents have hereunto interchangeably Set their hand and Seal the day and year first above written.

This Indenture made the twenty second day of July in the year of our Lord one thousand eight hundred and thirty. Between William Culbertson Esq. of the Township of Conneauttee in the County of Erie and State of Pennsylvania of the first part and Abel Whitney of the Township, County and State aforesaid Tavern keeper of the second part. This Indenture[?] Witnesseth That the said party of the first part for and in consideration of the sum of Eight Dollars money of the United States to him in hand paid by the said party of the second part at and before the ensealing and delivery of these presents the receipt and payment whereof I do hereby acknowledge and thereof acquit and forever discharge the said party of the second part his heirs executors and administrators by these presents. She the said Margaret being of full age, and by me, separate and apart from her said husband, duly examined, and the contents of the above Indenture fully made known to her, declared that she did voluntarily; and of her own free will and accord, and without any coercion or compulsion on the part of her said husband, sign, seal, execute and deliver the same.

Whereas my late husband Abel Whitney died intestate whereby the right of the administration of the Estate of the said deceased did devolve upon me Marilla Whitney widow and relict of the said deceased. Now know ye that for diverse[?] good causes and considerations me thereunto moving and on account of my ill health and bodily infirmities I have released and hereby do release all my right and title to the administration of the Estate and request that George Gillaspie of the borough of Edinboro in said county may be appointed administrator of said Estate.

Know all men by these presents that whereas Abel Whitney late of the Borough of Edinboro County of Erie and State of Pennsylvania now deceased did in his life time to wit on the twenty third day of August A. D. one thousand eight hundred and thirty nine convey to me by deed duly executed and acknowledged a certain piece and lot of ground situated in the Borough of Edinboro aforesaid and described and bounded as follows Bounded North by Lot of George Gillaspie East by Erie Street, South by the tavern Lot of Aaron Lich and west by an alley Being the same premises in which the said Abel Whitney resided at the time of his death with an agreement that the said property was to be held in trust by me for the use of the said Abel Whitney his heirs and assigns and afterwards a bond or instrument of writing was made and executed by me the said McClenahan to the said Abel Whitney conditioned that the said property be reconveyed to the said Abel Whitney when afterwards requested which said bond or other instrument is since lost or destroyed and the sale of said lot of ground having been decreed by the Orphans Court of the County of Erie on the petition of the said George Gillespie Administrator of the said Abel Whitney deceased for the purposes of paying the debts of the said deceased. Now in consideration of the premises and that the said George Gillespie administrator aforesaid may be able to make a good title to the purchaser of said property at the said Orphans Court sale on the confirmation thereof by the said Court as well as for the further consideration of one dollar to me in hand paid by the said George Gillaspie at and before the ensealing and delivery thereof the receipt is hereby [?] acknowledged I have granted bargained sold released and confirmed and by these presents do grant bargain sell release and confirm unto the said George Gillespie the administrator aforesaid his heirs and assigns all my right title interest and claim whatsoever of in and to the lot and premises herein before described together with all and singular the hereditaments and appurtenances thereunto belonging and the remainders rents issues and profits thereof to have and to hold the premises hereby grant with the appurtenances unto the said George Gillespie his heirs and assigns to the use of the said George Gillespie his heirs and assigns forever. In trust however for the purposes aforesaid In witness whereof I have hereunto set my hand and seal this thirteenth day of January A. D. one thousand eight hundred and fifty one.
