      "Franklin paused last Tuesday morning to pay tribute to Patrick Maley, its last resident survivor of John Kell Post, G. A. R. Fifty years ago John Kell Post, Grand Army of the Republic, was a vital factor in the affairs of Franklin. Strong men at the head of families marched under its flag and were active in the business and civic affairs of the community. For several years Patrick Maley was the sole survivor of the Post living in Franklin. The only other remaining member is John Winters, who now makes his home in Florida.
      " Born in Ireland, July 25, 1841, Patrick Maley came to America with his father when a lad of 11 years. He was less than 20 years of age when he enlisted in the Union Army at Xenia, Ohio. He was a member of Colonel Fifer's regiment [sic? - Col. J. Warren Keifer was the commander of the 110th Ohio Volunteer Infantry] and served during the entire four years of the Civil War. "

      "James Marlatt, son of William H. Marlatt, died at his father's farm, east of Lebanon, last Thursday night about 11 o'clock, after an illness of about ten days. He had been living on this farm and managing it for his father for some time past, and while engaged in farming duties he was overcome by the heat, this resulting in the fever that caused his death.

      • The parents of James Marlatt (1846-1885) were married ca. 28 Mar 1840
      • James Marlatt (1846-1885) did have a sister named Mary but her middle name was Eliza and she was married to Thomas Starry on 16 Feb 1865.
      • Warren County, Ohio Estate Records for James Marlatt who died 23 Jul 1885 indicate that he had a wife Jennie and son John.
      • It appears that there was another James H. Marlatt who enlisted for 1 year as a 21 year old Private in Co G, 183rd OVI on 14 Oct 1864 and was mustered out with company on 17 Jul 1865 at Salisbury, North Carolina.

      James T. McAllister, age 22, enlisted at Cincinnati, Ohio on 16 Nov 1863 as a seaman in the US Navy for one year. He served on the receiving ship, USS Grampus at Cairo to 19 Nov 1863, then on the receiving ship USS Clara Dolsen from 20 Nov to 1 Dec 1864 and finally on the gunboat USS Carondelet from 2 Dec 1863 until his discharge at Mound City, Illinois on 15 Nov 1864. He was a boatman on the river prior to his enlistment.
      James T. McAllister was born 19 Nov 1841 in New Richmond, Clermont County, Ohio to James & Sarah McAllister who were married in 1842. His father died in 1889. James worked for his uncle, Robert McAllister before and after the war. He moved to Cincinnati in 1884/5, Delhi, Ohio in 1902, Mason, Ohio in 1910 and Dayton, Ohio in 1913. He married Emma Rose in Clermont County on 30 May 1865. In 1915 he listed their children as Mrs. Rose Gerard born 19 Mar 1867, Mrs. Carrie Watkins, born 15 May 1870 and Mrs. May Agricola born 14 Mar 1874/1875. Emma died 5 Aug 1909. James worked as a teamster in Cincinnati and later in Dayton where he died on 19 Jul 1924.
      He filed his original claim under the general laws on 29 Nov 1889 (Application #15474) alleging as a basis for his pension claim scurvy and results including skin and stomach affection, malarial poisoning, chronic diarrhea, piles, rheumatism and resulting heart disease. The claim was sent to the Special Examination Division and rejected 18 Nov 1895 as he was not able to prove that they were contracted while in the service and in the line of duty.
      On 11 Aug 1890 he filed his claim under the act of 27Jun 1890, which claim was allowed (Certificate #8674) for chronic diarrhea, malarial poisoning and dis. of gums, results of scurvy, at $12 per month beginning 11 Aug 1890.
      James McAllister, age 53, of Cincinnati gave a deposition on 12 Nov. 1894. When he re-filed under the Act of 1907, he was living in Mason, Warren County with Frank Watkins & Wm. A. Gerard (his sons-in-law) witnessing his claim. A 1922 medical report for James, aged 80, indicated that he had numerous maladies and under the care of his daughter, Rose Gerard. He was last paid $72 to July 4, 1924 when he was dropped from the rolls due to his death on 19 Jul 1924 in Dayton, Ohio.
      Through the years many papers were added to this large pension file as he refiled under a variety of new pension acts that were passed.. Numerous depositions were provided by neighbors, shipmates, physicians and family members including his mother Sarah (age 73 in 1895) and a brother-in-law Andrew Rose.

      On 2 May 1864 he enlisted as a private in Company C, 146th Ohio Infantry Regiment at Butlerville.
      On 7 Sep 1864 he was mustered out of that same unit at Camp Dennison.
      On 3 Sep 1869 he married Adeline Phillips in Warren County. They had a total of 5 children & farmed in Harlan Township until at least 1900 after which they moved to Blanchester.
      On 12 Oct 1921 he died at the National Millitary Home in Jefferson Township in Montgomery County.
      On 15 Oct 1921 he was buried in Blanchester IOOF Cemetery."

      "April 23, 1861, he enlisted in Company F, 12th O. V. I. under Capt. Williams, for the three-months' service. In September of the same year, he enlisted in Company A, 69th O. V. I., in which he served two years, when he veteraned at Chattanooga and served till the close of the war, being mustered out at Louisville, Ky. He passed through the battles of Stone River, Jonesboro, Mission Ridge, Chickamauga, Atlanta, Bentonville and a host of lesser engagements. At Stone River, he was wounded in the leg and taken prisoner and put in the Libby pens for two and a half months before being exchanged, when he was sent to Annapolis, Md.; thence to Columbus, Ohio, thence home, and, when he recovered from his wounds, went back to his regiment. In 1864, he was again captured, at Rome, Ga., while on a foraging expedition. His captors were bushwhackers, and they soon paroled him, and he, with three others, captured the leader of the same party."

      CHARLES EWAN MERRITT
      Charles Ewan Merritt, actively and prominently identified with the legal profession for more that forty years, and who also risked his life in defense of his country, serving for three years during the Civil War, was a native of Waynesville, Warren county, Ohio, born November 22, 1842, son of Absalom E. and Esther P. (Kindle) Merritt, grandson of Charles and Keziah (Ewan) Merritt, and a descendant of an old New Jersey family. He died at his home, January 14, 1912.
      Charles E. Merritt attended the public schools of Waynesville, subsequently pursuing a course at the Ohio Wesleyan University, Delaware, Ohio, from which he graduated in 1868.
      In August, 1862, when only nineteen years of age, he enlisted his services in the Union Army, becoming a private in Company H, Seventy-ninth Regiment, Ohio Infantry, and served with same until June, 1865, participating in all its engagements, and was in the historic march of Sherman from "Atlanta to the Sea." He served for three years under the command of General Harrison, later president. At the close of the war he was serving as regimental quartermaster, having attained that rank as a result of his bravery and courage. He was present at the Grand Review in Washington, D. C., May 22-23, 1865, and was honorably discharged with his regiment in June of that year.
      In 1868 Mr. Merritt took up his residence in Mount Holly, New Jersey, and pursued a course of study in law with his uncle, Ewan Merritt, remaining with him for three years, and in June, 1871, after a successful examination, was admitted as an attorney at the New Jersey bar, and in November, 1874, was admitted as a counsellor. After his admission as an attorney he went to Cincinnati, Ohio, and opened a law office, where he practiced for two years being compelled to leave on account of ill health. About that time the death of his uncle occurred and he returned to Mount Holly to continue the well-established Merritt practice, remaining in the one location on Main street from that time until his death. He enjoyed a large and lucrative patronage, the result of his thorough knowledge of the law and his accuracy in applying it to the cases in which he was interested. As a lawyer he was a safe and valued counsellor, and his advice, frequently sought, was carefully considered This characteristic was not confined to his legal life, for he was always ready to give advice and lend a helping hand without regarding the pecuniary return that might be expected to follow. He served in the capacity of county solicitor. At the death of Charles H. Folwell Sr., Mr. Merritt became the editor of the Mirror, and for four years he conducted the editorial page in a manner that was highly beneficial to the paper, and to the principles which it advocated. This position he was compelled to relinquish because of the growth of his legal practice, which engaged all of his time.
      At the time of his death he was president of the Farmers' Trust Company, being elected to that office when the trust company replaced the Farmers' National Bank. He had been a director in the latter institution from January, 1888, and its president since January, 1901. He was formerly president of the Burlington County Lyceum of History and Natural Science, treasurer of the Fair Association of Burlington County, director of the Mount Holly Insurance Company, director and solicitor of the Burlington County Safe Deposit & Trust Company of Moorestown, director and solicitor of the Moorestown Safe Deposit & Trust Company, and trustee of St. Mary's Hall, Burlington, New Jersey. He was treasurer of the diocese of the Protestant Episcopal Church, having served in that capacity since 1877. He was a member of St. Andrew's Episcopal Church, of which he was warden and superintendent of the Sunday school, and an adherent of the principles of the Republican party. He was a member of General A. E. Shiras Post, No. 26, Grand Army of the Republic, and from February, 1880 until July, 1881, was captain of Company F, Seventh Regiment of the National Guard of New Jersey. He was a member of the Benevolent and Protective Order of Elks, and Phi Kappa Psi and Phi Beta Kappa fraternities.
      Mr. Merritt married (first), June 20, 1877, Blanche Rosalie, born April 24, 1846, daughter of Charles and Edith Harker. She died January 20, 1884. He married (second), June 1, 1887, Mary Josephine, born December 18, 1861, daughter of John H. and Elizabeth C. Curtis; she died September 7, 1894. Children of second marriage: Mary Gwendolen, Eleanor Harding, Charles Ewan Jr., Margaret Curtis. He married (third), July 6, 1899, Florence, daughter of Thomas and Mary (Budd) Michie.

      "Daniel Webster Mills (February 25, 1838 – December 16, 1904) was a U.S. Representative from Illinois.
      Born near Waynesville, Ohio, Mills attended the common schools of Rayesville and the Waynesville High School. He moved to Corwin, Ohio, in 1859 and engaged in the mercantile, grain-shipping, and pork-packing businesses. During the Civil War served in the Union Army as captain of Company D, One Hundred and Eightieth Regiment, Ohio Volunteers, until the close of the war. He moved to Chicago, Illinois. He engaged in lake shipping 1866-1869, and later in the real estate business. He served as warden of the Cook County Hospital 1877-1881. He served as an aldermen on the Chicago city council from 1889-1893.
      Mills was elected as a Republican to the Fifty-fifth Congress (March 4, 1897 – March 3, 1899). He was an unsuccessful candidate for reelection in 1898 to the Fifty-sixth Congress. He resumed the real estate business. He died in Chicago, Illinois, on December 16, 1904. He was interred in Graceland Cemetery."

      "No doubt a number of our older citizens remember D. W. Mills, better known as Web Mills, who was born and raised at Lytle and continued a resident of Wayne township until about the year 1866, and was well known. He did not marry until after moving to Chicago, but remained a gay society man, always drove a fine team and was very obliging and generous in taking parties of young people to social or public gatherings. He followed merchandising for a time in what is now the Kilbon store at Corwin. A few days ago, the Gazette received from C. M. Cartwright a clipping from a late Chicago paper which reads as follows:
      “Daniel W. Mills, former congressman, alderman and prominent real estate agent died December 16 at his home, 1510 Washington boulevard from a complication of diseases. An operation was performed Wednesday, but the strength of the patient was so impaired that he succumbed.
      For many years Mr. Mills was identified with political and other public affairs in Chicago. He was born in Waynesville, Ohio, in 1838, a descendant of a member of the Quaker band that settled in America with William Penn in 1682. He served in the civil war and at the end of the struggle retired with the rank of captain in Company D, One Hundred and Eighth Ohio Volunteers. Coming to Chicago in 1866, he became a manufacturer of candies, and later entered the lake shipping trad. He became a fixture in politics, and from 1877 to 1881 served as warden of the Cook County Hospital. He was elected alderman of the old Twelfth ward for two terms, and in 1896 was sent to Congress from the old fourth district. For many years, he was engaged in the realty business. Mr. Mills was a member of several fraternal societies and of the Menoken, Lincoln and Hamilton clubs. The funeral was in charge of Columbia Posts, G. A. R., and the honorary pall bearers were members of the Masonic fraternity, in which Mr. Mills was a 32° member.""

      Joseph Milner, born September 1843 in England. He immigrated to the United States in 1858.
      He enlisted on 8/6/1862 at age 18 and on 8/23/1862 he mustered into "A" Co. OH 79th Infantry as a Private. He was Mustered Out on 6/9/1865 at Washington, DC.
      Joseph and Annie Fuller were married following his service in the Civil War, in about 1868. In 1880, Joseph, his wife Annie, and their children Elizabeth, Edwin and Grace were living on Harrison Street in Cincinnati where Joseph was employed as a Mail Agent. In 1900 Annie’s mother, Abbey Fuller, was living with them on Seventh Street in Cincinnati. Joseph was employed as a Railroad Clerk. Joseph applied for a veterans pension on October 1, 1890 & on 23 Jan 1907 [Certificate #926864.] Following his death on May 23, 1924, his wife, Annie, applied for a widow’s pension on June 9, 1924 [Certificate #951596].

      The pension file for Elizabeth (Yearing) Miltenberger, mother of William H. Milternberger contains 75 images. She was granted a pension of $8/mo. on 19 Sep 1864 which increased to $12/month at the time of her death in 1915. In her application, Elizabeth Miltenberger states that she was abandoned by her husband in 1856 and left with 8 minor children and that she was dependent on William and another son to work her rented farm.  All of the children and their birth dates are named.  Numerous affidavits are included in the file, some of which indicate that her husband, Elias had "eloped" with another women and was living in Franklin County, Indiana under an assumed name at the time of his death.  The last papers in the file relate to her daughter, Mrs. Isabella Graham, filing for reimbursement for final expenses associated with her mother's death.
      Elizabeth (Yearing) Miltenberger is buried in Springboro Cemetery.

    • Biography: ORMSBY MCKNIGHT MITCHEL
      ORMSBY MCKNIGHT MITCHEL Mitchel, Ormsby M., major-general, was born in Morganfield, Ky., Aug. 28, 1810. He was graduated at the United States military academy in 1829, served as assistant professor of mathematics at West Point for two years, and was then on garrison duty until Sept. 30, 1832, when he resigned. He was in that year admitted to the bar, practiced two years in Cincinnati, was chief engineer of the Little Miami railroad, 1836-37, and professor of mathematics, astronomy and philosophy at Cincinnati college, 1834-44. He raised almost all the money for the establishment of an observatory at Cincinnati, which was the first of the larger observatories to be built in the United States and in 1843 the corner-stone of the pier for the great telescope was laid by John Quincy Adams. Prof. Mitchel lectured extensively throughout the United States from 1842 to 1848; was adjutant-general of the state of Ohio, 1841-48; chief engineer of the Ohio & Mississippi railroad, 1848-49, and again in 1852-53, and was director of the Dudley observatory at Albany, N. Y., in 1859-61. He invented a number of valuable mechanical devices for use in astronomy, and gained great distinction in his profession. He was commissioned brigadier- general of volunteers, Aug. 9, 1861, and at first reported to Gen. McClellan, who assigned him the command of Gen. William B. Franklin's brigade in the Army of the Potomac; but at the request of the citizens of Cincinnati he was transferred to that city and commanded the Department of the Ohio from Sept. 19 to Nov. 13 1861. He served with the Army of the Ohio during the campaigns of the winter of 1861-62 in Tennessee and northern Alabama, took part in the occupation of Bowling Green, Ky., Nashville, Tenn., the march to Huntsville, Ala., in the action near Bridgeport, Ala., April 30, 1862, and was promoted major-general of volunteers to date from April 11, 1862. He took possession of the railroad from Decatur to Stephenson, by which the control of northern Alabama was secured to the Federal authorities. He was anxious to advance into the heart of the South, but was restrained by his superior officer, Gen. Buell, and in consequence of a dispute with Buell he tendered his resignation to the secretary of war and was transferred to the command of the Department of the South, with headquarters at Hilton Head, S. C., Sept. 17, 1862. He died of yellow fever at Hilton Head, Oct. 30, 1862.

      "Col. Morgan entered the United States Army as Captain of Co. F, O. V. I. Oct. 7th, 1861, and was promoted to Major, May 3rd, 1863, and subsequently to Lieutenant Col. on June of the same year.
      He was severely wounded in the battle of Gettysburg, Pa., July 1st, 1863, and afterward made a prisoner by the rebels, while making a raid at the battle of Gainesville, Florida, and confined in prison for seven months.  Col. Morgan was mustered out of the service of the U. S. at Annapolis, Md., March 19, 1865."

      Francis Dunlevy Morris was the son of Jacob Morris (1799-1868) and Jane Burnett Dunlevy (1803-1842). Jane was the daughter of Judge Francis Dunlavy and Mary Burnet Craig. Francis D. Morris and Elizabeth Yeatman Reeder were married by Rev. William MacMillan on 7 Jul 1859 in Butler County, Ohio. They had one child, Francis D. Morris Jr. born 19 Aug 1863 in Butler County.
      Francis Dunlevy Morris was appointed Surgeon in the 35th O.V.I. on 25 Jan 1864 and mustered into service at Cincinnati on 28 Jan 1864.
      Major Joseph L. Budd testified at Lebanon that Surgeon Francis D. Morris contracted chronic diarrhea on 1 Jun 1864 at Kennesaw Georgia and was still suffering from the disease on 25 Aug 1864 at Chattanooga, Tennessee.
      General Van Derver testified on 28 Jan 1865 that "Dr. Morris contracted diarrhea in the line of duty about 1 of June 1864, and being much reduced by diarrhea, erysipelas attacked him of which he died at home Sep. 21, 1864" Dr. Joseph L. McNeeley of Hamilton was the attending physician in Hamilton and gave similar testimony on 14 Nov 1864.
      on 4 Oct 1864, Elizabeth Y. Morris of Hamilton, made a declaration in Butler County Probate court for the purpose of obtaining a widow's pension under the Act of 1862 (Application #70242). She testified that her husband died on 21 Sep 1864 of erysipelas and chronic diarrhea at Hamilton, Ohio, while home on sick leave.
      Elizabeth Y. Morris was awarded a pension of $25 per month commencing 21 Sep 1864 by Certificate #40399 dated 7 Feb 1865. She received an additional $2 per month commencing 25 Jul 1866 for her son Francis D. Morris until he reached the age of 16 on 18 Aug 1879. She was living at 18 Beach Street in Walnut Hills, Cincinnati, when applying for a pension increase on 12 Sep 1873. Her brother-in-law, W. J. Morris attested to her Walnut Hills residence with her child Francis D. Morris. At the time, W. J. Morris was clerk in the Finance Division of the Pension Office in Washington.
      She was last paid $25 to 4 Jun 1895 and dropped from the rolls due to her death on 19 Aug 1895 as reported by Frank D. Morris, Mt. Auburn, Ohio.
      Supporting testimony for her claim was given by Carolline A. Follin, over 30, of Newport, Campbell County, Kentucky; Nathanial S. Reeder, over 25, of Kemper Lane, Walnut Hills. (probably her sister and brother)

      David Mossholder, born in Pennsylvania.
      He enlisted on 2/29/1864 at age 37 and on 3/10/1864 he mustered into "F" Co. IA 16th Infantry as a Private. He was Mustered Out on 7/19/1865 at Louisville, KY.
      In 1870 David and his wife, Rebecca, were living in Brown Twp., Carroll Co., Ohio along with their three children. By 1880 the family had relocated to Salem Twp. At that time the family consisted of David, Rebecca, Earnest aged 18 (born in Illinois), Rosewell, Sarah E., Bert, Otta and Floss. David died on 3/7/1886 in Morrow, Ohio.

      James L. Mounts enlisted Sept. 15th 1861 as Assistant Surgeon and was mustered into the 31st Ohio Infantry Regiment (3-year service) commanded by Colonel Moses B. Walker on Sept. 27, 1861.
      On July 20, 1862, Dr. Mount was left in charge of about 75 sick from the 31st OVI at Tuscumbia Alabama instructions to bring them to Huntsville as soon as they were able to travel.
      On August 12th, 1862, he was on a train of flat or box cars with convalescents, on the Memphis & Charleston Railroad four miles east of Tuscumbia going to Decatur or Huntsville Ala. The locomotive and two or three first flat cars ran off the track. Dr. Mounts was on a flat car loaded with camp equipage and an ambulance, the sudden stopping of the front of the train ran the ambulance on to him and he jumped off just as the car was about to upset, resulting in the injury to the right knee joint. He was taken back to Tuscumbia, to a private house where he remained about two weeks, got on crutches and attempted to join his command, but rail communication was cut off at Decatur. He returned to Tuscumbia, thence to Corinth. Expecting a battle there, was advised to get away and went home remaining on crutches about two months. Was never in any Hospital during the time except to stay a day or night. Consulted Dr. S. U. Smith Surgeon Genl of Ohio also Dr. Judkins in Cincinnati and Dr. J. T. Cowden at his home in Morrow. O. He returned to the 31st OVI on the day of the Battle of Perryville, Oct. 8, 1862. On account of his knee injury, he resigned his commission following the Battle of Stones River on 11 Jan 1863 at Murfreesboro, Tennessee.
      On May 2, 1864, Dr. Mount reenlisted as a 34-year-old Surgeon in the 144th Ohio Infantry (100-day service) and was mustered out at Camp Dennison on Aug. 31, 1864. After leaving the service, he returned to Morrow Ohio and resumed his practice as a physician & surgeon.
      On April 7, 1888, James L. Mounts, of Morrow, Ohio, appeared before the Clerk of Court in Warren County to make a declaration for an invalid pension based on his service in the 31st and 146th OVI. He was described as being 56 years old, 5 ft. 10 in., dark complexion, dark hair and grey eyes.
      On June 4, 1898, he completed a circular stating that he was married to Martha W. Smith on December 1, 1859 by Joseph M. Gatch at Morrow Ohio. He listed their children as Flora Mounts born February 13, 1861, Louis F. Mounts September 23, 1865, James Leonard Mounts June 8, 1868 and Grace E. Mounts, January 18, 1876.
      On Marth 11th, 1907, James L. Mounts, aged 75 of Morrow, Ohio, appeared before William McDonald, a Notary Public, for the purpose of making a declaration for an invalid pension under the Pension Act of 1907. He indicated that he was born August 19th, 1831 near Morrow in Hamilton Township and was a physician living in Morrow. His affidavit was witnessed by Harley H. Dunn and Alice Hughes.
      Testimony in support of his 1888 application was provided by Col. Moses B. Walker, aged 68, of Kenton, Hardin County, Ohio; Sargent Major Henry S. Byers, aged 46, of Shelbyville, Indiana; Dr. J. L. Williams, aged 68, of Holton, Jackson County, Kansas; Major John W. Free, aged 57 of New Lexington, Perry County, Ohio; Edward F. Fuller, aged 64, of Morrow, Edward R. Grim, aged 49 of Morrow and Ezekiel W. Woodward, aged 59 of Morrow.
      The papers in the pension file do not indicate when he was first awarded a pension. He was last paid $20 to Sept. 4, 1909 and dropped from the rolls on Feb. 11, 1910 because of his death on Oct. 20, 1909.
