Danforth Brown, Sr. of Wellsburg, Brooke Co, VA do make and constitute this my
last will and testament hereby revoking all former wills made by me.
1st I constitute my nephews
William Brown of Oliver and James Colwell of Mason Co. VA my executors of this
my last will and testament with no security other than their own Bonds.
2nd To my nephew Danforth
Brown Jr. of John I give and bequeath my interest in the Worrell farm in Brooke
County VA and my half of the fraction of lot opposite lot no. 14 together with
the appurtenances (situate in Wellsburg, VA). Also my half of the coal lot and
coal privileges purchased from the executors of J. Jacob, dec'd.
Also the amount of a bond and $1000 which he now owes me and my interest
in whatever stock and farming implements may be on said Worrell farm.
3rd To my sisters Betsy Wylie
and Katy Colwell I give and devise the farm in Lawrence Co. containing about 100
acres on which said Betsy now resides and the sum of $500 to each to be paid in
the manner hereafter specified.
4th And to said Betsy Wylie I
relinquish the amount of several notes I now hold on her.
5th My lands on the Ohio
sixteen mile creek in Mason Co. VA I authorize my nephew James Colwell to sell
and convey at public or private sale at any time within 10 years after my
demise, and out of the proceeds thereof to pay the said sums of $500 dollars
each to my sisters Betsy Wylie and Katy Colwell as bequeathed to them in the 3rd
clause of this will. And the residue of the proceeds of said lands mentioned in
this clause, to be equally divided between said James Colwell and my nephews
William Brown of George and George F. Brown of George and William and Oliver
Witherow.
6th To my niece Polly
Witherow I give and devise the half lot in the town of Wellsburg VA adjoining
the property of Mrs. Tomyson(?) also the sum of one hundren dollars.
7th To my nephew Oliver B.
Wylie I give and bequeath the sum of three hundred dollars out of any money
belonging to my estate after the payment of my just debts and funeral expenses
and to my nephew William Witherow the sum of two hundred dollars.
8th To my brother Oliver I
give and devise my half of the farm in Jackson Co. VA purchased of James Mairs
provided said Oliver will relinquish whatever amounts I may owe him in land
trades and I also give him one thousand dollars in money to be paid after debt
and funeral expenses.
9th To my brother Richard I
give and devise the farm I bought of Thomas Kirk in Jackson County VA and
containing about 170 acres.
10th To my brother James and
his son Danforth I give and devise my farm on West Creek in Mason County VA
adjoining lands of Major Brown on the Ohio River and containing about 150 acres
and also to said James the amount due me on his bond of 4 Nov 1845.
11th To my niece Eliza Polsey
I give and bequeath the sum of five hundred dollars to be paid out of any funds
belonging to my estate after payment of debts and funeral expenses.
12th To my niece Louisa W.
Sheppard I give and devise the ground and buildings which is part of lot no 23
in Wellsburg VA and formerly owned by Thomas McCarty.
13th To my niece Caroline R.
McClung I give and bequeath the sum of four hundred dollars to be paid out of
the money coming from her to me on the purchase of the house in which she now
resides in Wheeling VA
14th To my nephew Danforth
Brown Jr. of John I give and bequeath the sum of one thousand dollars in money
in addition to the devices and bequests in the second clause of the Will to be
paid out of any monies of my estate.
15th To Lucy F. Brown widow
of my nephew John D. Brown and her three children I give and devise the house
with the ground belonging in Wellsburg VA situated on part of lot No. 403 and
known as the paper mill office. Also the amount of rent due from Bazell Wells
for Narrows Farm. And also the sum of one hundred dollars in cash.
And to Adam Kuhn Esq. and Danforth Brown Jr. for the separate use of said
Lucy F. Brown and her children Cora, Willie and John the sum of twenty-five
hundred dollars or whatever sum may be realized out of a deed of trust from my
nephew Jno D. Brown dec'd on his interest in the Narrows Farm and said house on
lots no 199 & 200 and buildings and ground part of lot No. 22 Wellsburg VA
and to said Adam Kuhn Esq. and Danforth Brown Jr. (trustee as above) the sum of
eighty dollars or whatever sum of may be necessary to put a new roof on the
McCLung House on Lots 199 & 200.
16th I desire that whatever
other real estate I may own at the time of my demise and not specially devised
or bequeathed may be sold by my executors either at public or private sale at
any time within ten years after my demise and the proceeds after the sum of one
hundred dollars to be reserved by my executors for a suitable marble tomb stone
for my grave I desire to be qequally devided between my brothers James, Oliver,
and Richard and together with all the residue of my personal Estate to be
equally divided between James, Oliver and Richard.
17th If my executors should
be of opinion that it would be the interest of my estate to buy the interest of
my nephew John D. Brown in the property embraced in deed of trust mentioned in
the 15th clause of this will I authorize them to make such purchase, or to offer
my interest in Cain(?) Farm for sale at same time and place that John D. Browns'
interest is sold under said deed. The
devises and bequests to Lucy Brown and her children and for their use in the
15th clause of this will is understood to be on condition that she will
relinquish her right of dower in & to property embraced in the said deed of
trust mentioned in said 15th clause.

The Last Will and Testament
of James Brown, deceased: September 5th 1885
This day application was
made in due form of law for the Probate of the Last Will and Testament of Jame
Brown, late of Richland County, Ohio, deceased, whereupon it is ordered that
notices issue from this Court to the next of kin of said decedent, resident
within the Sate of Ohio, acquainting them of the filing pending, prayer and
peace and time of hearing is hereby set for the 29th day of Sptember AD. 1885 at
Eleven o'clock AM. And it is further
ordered that said Danforth Brown serve said notices or cause the same to be
served upon the aforesaid next of Kin, and that he make proof of each service to
this Court on or before said day of Hearing.
In the name of the
Benevolent Father of All, I, James Brown of Plymouth Township, Richland County,
Ohio, being of sound mind and memory, yet impressed with the uncertainty of
life, and the necessity in my case by reason of the death of my daughter Mary
Ann Brown and Caroline Brown, requiring a few changes in the arrangement of my
affairs do hereby make and publish this as my last will and testament, hereby
revoking all former wills by me made.
Item first.
I give and bequeath unto my three daughters Sarah Brown, Harriet B. Coe
and Martha J. Agerter and to their chilren in case of the death of any or all of
them, in fee simple, the farm on which I now reside being one hundred and twenty
acres in Plymouth Township Richland County Ohio, to their own use and behalf and
that of their children and their heirs and assigns forever.
Item second.
I hereby direct that my interest in the farm of one hundred and fifty-one
acres on West Creek, Mason County State of West Virgina, owned in common by
myself and my son Danforth Brown, to be appraised by three judicious
disinterested persons having the legal qualifications to so appraise by the laws
of that State, and if the said Danforth Brown shall elect to take the said
interest in said farm and shall account for said two thirds valuation to my
executor (himself) or admininstrator, within two years from the date of such
appraisement, then and in that case, I do hereby give and bequeath to him my
said entire interest in said farm, and if he shall not so elect to take the
same, then in that case my said interest in said farm shall be sold, according
to law and the proceeds of such sale shall be divided between my heirs and
legatees hereinafter named. And if
so taken by him this will, duly recorded in said Mason County shall be, and it
shall operate as a full, and clear conveyance of my said interest in said land
to him, and to his heirs and assigns forever.
Item third.
I give and bequeath to my son Oliver Brown, in addition to what he is now
indebted to me at this date, and two hundred and fifty dollars advanced to him
by my son Danforth Brown, the further sum of one thousand dollars believing that
sum to be fully equal, if not above, any of my other heirs have received or
shall hereafter receive by virtue of the provisions of this my last Will and
Testament, but at all events I believe it to be exactly right.
This sum to be paid to him as soon as funds come into the hands of my
executor or administrator as circumstances may permit him to pay it having
reference to other bequests (heretofore) by me made.
Item fourth.
I hereby give and bequeath to my son Danforth Brown the sum of two
hundred and fifty dollars with interest, the said sum being what he has
heretofore advanced to my son Oliver Brown after his recent return from the
State of Iowa. And in addition to
this sum, one thousand dollars in addition to the two thousand dollars advanced
to him since I made a former will.
Item fifth.
I give and bequeath unto my grandson Wm. B. Dickey five hundred dollars.
Item sixth.
I give and bequeath to my Granddaughter Mrs. Sarah C. Smith five hundred
dollars.
Item seventh.
I give and bequeath to my granddaughter Mrs. Mary Hackendern also five
hundred dollars.
Item eighth.
I give and bequeath to Matilda Trux and Lucy Trux, daughters of James B.
Trux each thirty dollars.
Item ninth.
I also give and bequeath to each one of all the organized congregations
in Shelby for the use of the same as their trustees may direct the sum of two
dollars to each.
Item tenth.
I also give and bequeath to my daughter Sarah Brown, in view of past and
future services and kindess to me shone (sic), and yet to be shown, as well as
to provide against any immediate wants and necessities after my death the sum of
three hundred dollars to be first paid out of my estate as may be needed.
And also I give and bequath to her my household and kitchen furniture,
cooking utensils, carpets, books, pictures, beds and bedding for her own sole
use and behoof.
Item Eleventh. After all
these bequests shall have been paid, and assets disposed of money collected, and
any shall remained disposed of, it is my will that the said sum shall be equally
divided between all my children, or if any be dead, the children of such shall
draw the share due to their parents equally divided between them.
Item Twelfth.
I hereby nominate and appoint my son Danforth Brown who I request and
direct shall not be required to give security on his bond as the Executor of
this my last Will and Testament, with full powers to sell any of my real estate
and to execute deeds therefor which I may die seized of, and to do all other
things necessary to settle up my estate.
Item Thirteenth.
I hereby further direct and order that in case any of my above named
heirs or legatees should be dissatisfied with my directions and bequests herein
given and should seek to disturb this my last Will and Testament by litigation
or to bring suits against my Executor or adminstrator for alleged services,
having made an equal distribution of my estate, all things considered, It is my
will in that case that any and all such shall by that act bar themselves from
any benefits whatever under this my last Will and Testament or from any interest
in my estate.

SHELBY INDEPENDENT NEWS, 23
September, 1869
DIED - Thursday, September
16, 1869, Mrs. Jane Brown, wife of James Brown, Esq., in the 77th year of her
age.
Mrs. Brown ranked as one of
our pioneers, having resided here with her husband for many years.
Her native place was Brooke County, West Virginia.
She was respected by all who knew her.
The issue dated September
30, 1869 had the following additional information:
Mrs. Jane Brown was born in
Brooke County, Virginia, April 27, 1793. She
was married to James Brown, Esq., in 1814 and lived happily with her husband
over fifty-five years. She was
brought up in the Catholic faith, and baptised by the first minister of that
denomination in that section of the country; and lived and died in accordance
with her early instructions.
She was the mother of ten
children, seven of whom are yet living, and whom she was more than ordinarily
attached.
She endured the privations
of pioneer life, having removed to Ohio thrity-four years ago.
She lived to see her great grandchildren, and died beloved and respected
by her numerous circle of friends. She
died September 16th, 1869, aged 76 years, 4 months and 19 days.
Her last illness was of five weeks duration, and her extreme suffering
was borne with Christian patience - not a murmur escaping her lips.

Here also a leader -- I may
make it stronger -- the leader of the Cleveland bar some years ago, came Judge
M.R. Dickey, after having served the people of Richland on the common pleas
bench. His has been a very active
life. When a boy on his father's
farm, south of Mansfield, in 1846, his ear caught the bugle blast which sounded
out over the hills and through the valleys of Ohio, that soldiers were needed by
the United States for the war with Mexico, and he enlisted and served out the
period of his enlistment in the 3rd. Ohio, commanded by Samuel F. Curtis.
Two full companies of Richland county men were in that regiment and I am
told that Judge Dickey is one of less than a half dozen survivors of all.
When the Mexican War was over he traveled overland to California,
enduring the hardships of such a journey and the dangers as well.
In the war of the rebellion he commanded the 15th. Ohio, but it is as a
scholar and a lawyer that his fame is very bright here in Cleveland.
As a bible scholar he is probably without an equal outside the lines of
the clergy. It affords a Mansfield
citizen of today pleasure to know that Judge Dickey is so greatly appreciated by
lawyers and laymen in the Forest City.

BROWN, DANFORTH, farmer; was
born in Brook Co., W. Va., May 7, 1829; his father, James Brown, was born Feb.
19, 1794, and his grandfather, Capt. Oliver Brown, was born in Lexington, Mass.,
and served with distinction in the war of the Revolution; he was personally
acquainted with George Washington ; he was in ten different engagements. His
ancestors were among the first settlers of the Massachusetts colony ; in 1835,
James Brown emigrated from Virginia and settled in Plymouth, where he remained
for some time and then moved to Shelby, where he kept hotel, and was in the drug
business for some time; he was the first partner of the late Thomas Mickey. He
was married to Miss Jane McGuire in 1814; they had ten children, five of whom
are living. The subject of this notice is a man of force of character; he is an
advocate of any measure which will improve the community in any way. He is
Township Trustee, and makes an efficient officer. He was married to Miss Emiline
Cornwall, of Richland Co., Feb. 6, 1856 ; they had four children, three of whom
are living; they are a happy family

BROWN, OLIVER G., farmer and
stock-dealer; P. O. Shelby; was born in Virginia, in 1833; his father, Mr. James
Brown, came with his family to Plymouth in 1835, and from there moved to their
present farm; there were six girls and two sons, three of the girls having died;
when they bought the farm, there was but very little improvement-only a log
house and, perhaps, twenty acres of cleared land, and, by hard work, they have
now as fine a farm as there is in this part of the township;, Mr. Oliver G.
Brown now is living on the old homestead where he was raised. He was married in
1856 to Miss Elizabeth M. Castor, of Plymouth Township ; soon after their
marriage, they moved to Iowa, where they resided for nineteen years; he was
engaged in farming and stock-dealing, buying and shipping. In 1876, they came
back to their old home, where they are now living; they have five children now
living, two sons at Salina, Karl., and one daughter married, and now lives at
East Woolf, Russell Co., Kan., and two at home. Mr. James Brown was at one time
in business at Shelby; was in the hotel business for about two years, when he
went into business as a partner of Mr. Mickey ; about the year 1843, he moved
back to the old farm, where he has since lived; Mrs. Brown died Sept. 16, 1869.
Mr, Brown and his family are highly respected citizens, and are well known

FREDERICK AGERTER
Among the former business
men of Lima, who for years was prominently connected with the city's machine
interests, was Frederick Agerter, whose portrait accompanies this
sketch. He
was born in Switzerland, March 3, 1833, and died in Lima, September 15, 1883.
Frederick Agerter had not reached his majority when he emigrated to
America in search of better
industrial condition than he found in his
native land.
In 1858 he settled at Sandusky, Ohio, and worked at
various points until the
outbreak of the Civil War. He
enjoyed the
honorable distinction of
being the first man to enlist from Wyandot
County, joining Company C,
15th Reg., Ohio Vol. Inf. After the
close of
his first term of service,
he re-enlisted, in Company D, 81st Reg., Ohio
Vol. Inf.
He remained in the service for 15 months, when he resigned
his commission as 1st
lieutenant, on account of ill health. Upon
his
return from the war, he was
elected county clerk of Wyandot County, and,
by a succeeding election,
served in that office for a period of six
years.
In 1869 Mr. Agerter came to Lima, and with four partners immediately
engaged in the machine
business, the firm being known as Carnes, Agerter
& Company.
They had extensive machine shops and greatly prospered, Mr.
Agerter remaining secretary
and treasurer of the firm for 14 years, or
until the time of his death.
As a business man he was energetic and
capable, and noted for his
thoroughly honest and upright methods. He
began life with good
educational advantages but no capital, and through
energy and perseverance he
accumulated a fortune.
Mr. Agerter married Martha J. Brown, a daughter of James Brown, of
Virginia, her father being a
son of Captain Oliver Brown, of the
Revolutionary War.
They had these children: Rosa
J. (Hill), of Lima;
Sally L. (Mrs. E. E. Stoll),
of Massachusetts; Martha W. (Mrs. H. M.
Jenks), of England; Caroline
J., who resides with her mother in the
beautiful home at No. 890
West Market street, Lima, and Frederick Brown,
who died at the age of 28
years and left one child, Harry M.
In politics Mr. Agerter was a Democrat.
Fraternally he was
identified with the Masons
and the Odd Fellows. He was a men of
sterling character, one who
commanded the respect of all who knew him.
The family belongs to the
Presbyterian Church.

Notes for Elsie Mae Hermle:
Elsie was orphaned by the
common death of her parents on October 17, 1911, one day before her 2nd
birthday. She, her two sisters Laura
and Verona, and brother Robert were then placed in The Cleveland Christian Home
for Children, 11401 Lorain Avenue, Cleveland, Ohio.
Elsie was adopted by Captain George E. Benham and Virginia Case Benham on
February 18, 1912 and her name changed to Virginia Bartlett Benham.
Virginia Case Benham died on
September 14, 1914 and Elsie was again without a mother.
Somewhere between then and 1919 Captain Benham remarried.
On November 8, 1919 Captain Benham went down with his ship the JOHN OWEN
on Lake Superior. Elsie was then
left only with her second adopted mother who was not part of the original
adoption. The story goes that this
mother wanted to return Elsie in the orphanage but the next door neighbors
intervened.
These neighbors were Edwin
Cornwall Brown and Clara Ann Brown (Nee Tatham), who adopted Elsie at age 10 on
December 11, 1919 and changed her name again to VIRGINIA BROWN.
It was by this last name that she was known for the rest of her life.
It was not until after her husband, John William Warnock, died in 1971
that this entire story became known. Edwin
C. Brown was a Mason, being a member of Lakewood Lodge No. 601, entered on
September 30, 1924.

Class of 1935. His pre-dental schooling began in 1927 at Alfred University,
Alfred, New York. Bruce has a
picture of his graduating class. He first set up practice in Ravenna, OH and
then moved to Lakewood, OH after his marriage to Virginia Brown (Elsie Hermle),
also of Lakewood. He practiced there
for all but the last few years of his life, dying in Avon, OH where he had a
house and office combination.

In 1941, the family moved to Bay Village and all grew up there.
"Jack" graduated from Bay High School, Bay Village, OH with the Class
of 1952. He then attended Duke
University in Durham, NC, graduating with the Class of 1956.
His graduate studies were in Washington, DC, where he attended first
Georgetown University and finally American University.
After lenghty studies, he earned his PhD from AU.
His first post-graduate
position was with the US State Department in the Foreign Service.
He then moved to Toronto, Ontario, Canada and began a long teaching
career in Canada. Along the way, he
became a Canadian Citizen and settled down in Sasketchewan.
He has taught at a number of Canadian universities from Ontario to
British Columbia.
Later in his life, he began
to write and has published five books generally used for classroom studies and
writes for a local magazine in Regina.
Bruce has copies of all five of his books in his library and the
Cleveland Public Library has two of them.

Warnock:
Bruce was born at St. Luke's
Hospital, Cleveland, OH while living in Lakewood, OH.
His parents moved to Bay Village, OH from Lakewood in 1941 and he
graduated from Bay High School in 1954. He
then attended The Georgia Institute of Technology in Atlanta, GA and graduated
in 1958 with a Bachelor of Science in Industrial Management.
His first job was with National City Bank, Cleveland, OH, then Eaton
Corporation, Cleveland, OH and finally as Director of Finance for the City of
Bay Village, OH. In November 1992,
he had a heart attack and retired early to live a life of social service.
He spent many hours after
his retirement working with young adults and their families in their quest for
higher education. Georgia Tech, his
college, was the beneficiary of most of his efforts.
The Georgia Tech Alumni Association recognized his efforts in 1995 by
awarding him their Ramblin' Wreck
Volunteer of the Year Award. These
efforts took him back to Atlanta many times where in his college days he
attended North Avenue Presbyterian Church, The Rev. Vernon Broyles, Pastor.
He was a long-time member
and Elder of Bay Presbyterian Church, Bay Village, OH, serving on the Session
from 1994 to 1997. This was
continuing a long family history of affiliation with the Presbyterian Church
dating to 1800 in Ireland. Bruce was
also a commissioner to and member of The Presbytery of the Western Reserve,
Cleveland, OH., and The Synod of the Covenant, Columbus, OH.
On 27 April 2002 he was conferred the degree of Master Mason by the Grand
Lodge of Ohio, continuing the Masonic tradition of many members of this family.
His interest in family
history came to a head in 1978, well after the death of both his parents and
culminated in many trips overseas, the first to his homeland in Dunfanaghy, Co.
Donegal, Ireland. During his
genealogical quests, he came across the history of the WARNOCK
Family written by Calla Loree Stahlmann in 1969 and has added extensively
to its information. Bruce published
his own "Genealogy of William Warnock and Mary Wilson" in August 1997.
His records were duplicated and donated to many libraries, including the
Clarion County Historical Society, Clarion, PA., and The Western Reserve
Historical Society, Cleveland, OH, where they can be seen.

Coe Lake Gazebo in Berea, OH. It was
sunny and bright with a temperature of 75. Cynthia's
father Bruce escorted her to the center of the gazebo and met Terry there for
the ceremony. About 60 guests
attended and afterwards met at the house of Terry’s parents, 167 West Bridge
