Notes from transcriber: This is a will I come across at the courthouse years ago, I have some Hill interests & thus photocopied this will from the probate book, I did not make a note of the book #, but will attempt to locate. This will was "restored" following the 1884 courthouse fire, but there appears to be a few discrepancy's in the "restored" record. 1st, initially it indicates that this went through probate on July 22 of 1803 but later it states January 22, 1803. It also mentions that letters of administration were granted to the widow Hill & an Isaac Swearingan (?), but John Hill's wife Elizabeth had died in 1800 & John's will states that sons Philip & Samuel were to be executors. Possibly fatigue on the part of the individual trying to "restore" all of those records?

Additional notes, this John Hill is buried in a cemetery that is actually in Warren Co. near the Clermont Co. border (often confused as being in Clermont Co.) that is known by several names, "Ramsey Cemetery", "Hill-Wagoner Cemetery", "Jones-Paxton Cemetery" & in Ohio Vital Records #1, 1790's-1870's as "Wagoner Estate Cemetery". The Warren Co. Genealogical Society is now aware of the exact location of this cemetery & additional information has been added to the Warren Co. OHGenWeb site including the deed for a "Public Place of Burial".


update 5/28/2015. This will can be found in the "restored" will book 4 page 235. See bottom for additional comments.

It appearing to the Probate Court that on the 22 day of July (sic) A.D. 1803 the last Will and Testament of John Hill deceased was duly admitted to Probate and Recorded by the Judge of Probate in and for the County of Hamilton, and that the Record of such will was afterwards by law transferred to the Probate Court of Hamilton county Sate of Ohio and that the Original Record of such will was destroyed in the burning of the Court House on the 29th day of March A.D. 1884, but that the original will and endorsements thereof and Probate thereof upon the Journal of said Court were preserved. It is now ordered by the Probate Court on its own motion that the Record of said Will be and the same is hereby restored from said Original Will endorsements and Probate as provided by Statue in the words and figures following to wit. The state of Ohio Hamilton County SS. Be it remembered that on the day and year aforesaid the last Will and Testament of John Hill deceased was duly presented to the Judge of Probate for Probate and Record clothed in the words and figures following to wit-. In the name of God Amen I John Hill of the County of Hamilton and State of Ohio Being sick and weak in body but of perfect mind and memory thanks be to God for the same do make this my last Will and Testament as follows - Item. I give and bequeath to my son Benjamin Hill the dwelling House that I now live in with One Hundred acres of land adjoining the same. Item. I give to Joseph Hill's deceased, his children Fifty acres of land adjoining the house where he formerly dwelt. I give and bequeth to my son Philip Hill one hundred acres of land where he now lives. Item I give and bequeath to my son Samuel Hill fifty acres of land where he now lives. Item. I likewise lave to my son Benjamin two horse creatures two cows one calf. Item. I will that the remainder of my stock with all my household furniture (after all my lawful debts are discharged) waggon and farming utensils with all my mechanical Tools to be equally divided amongst the whole of my children make and female. Lastly I appoint and ordain my sons Philip and Samuel Hill whole and sole executors of this my last Will and Testament and do utterly disannul and revoke all other will or wills whatever. In Testimony whereof I have hereunto set my hand and seal this fourth day of January Eighteen Hundred and three.

Signed sealed and delivered in presence of Benjamin Moore, William Wafson (Wasson), Theo. Simonton. Be it remembered that on the 22 day of January Eighteen Hundred and three personally appeared before the subscriber Judge of Probate in and for the county of Hamilton Benj Moore and Thomas (sic) Simonton two of the subscribing witnesses to the will and testament and made solemn oath that they and each of them were present and saw John Hill the within named Testator sign and seal pronounce and declare that to be his last will and Testament that they saw William Wasson sign his name as subscribing witness to be the same in their presence and in the presence of the aforesaid Testator. Sworn the day and year first above written before Oliver Spencer Judge of Probate. Now here to wit - the same day our said Court made an order herein as follows. Court grant Letters of Adm. to the widow Delilah Hill and Isaac S Swearingen on the Estate of John Hill deceased. will rec'd proved and filed this 22 Day* of January 1803. It is further ordered by the court that Said Will and Probate thereof be Rerecorded the same is now done and that said Record have the same force and affect as said Original Record.

the underlined entry above seemed to have something erased and "proved and filed this 22 Day" written over the top.

Probate Journal Entries 1791-1837 (Hamilton Co. Probate website) Volume 1 page 493 - 494 (special court of Common Pleas November 21, 1820) "Court grant letters of admn to the widow Delilah Hill and Isaac S. Swearingen on the estate of John Hill deceased bond to be taken in the sum of $600 Security approved of Patrick Smith & Richard Ayres appraisors. James Matson, Arthur Henrie and Ephraim Collins bond given...."
 

Not only is this journal entry 17 years after the will of John Hill was probated in 1803, the names given, including that of the 1820 John Hill, are associated with Whitewater Twp., Hamilton Co., OH rather that the John Hill who is buried in Warren Co., and which is where his descendants resided for many years. It would seem that after the courthouse fire in 1884, somehow the 2 records for 2 different John Hills were mistaken by the person attempting to re-record the records as that for the same John Hill.
