WILL OF JOHN ELDER, White Water Township, Hamilton County, OH and
Franklin Co, PA

In the name of God Amen, I JOHN ELDER of White Water Township, Hamilton County, State of Ohio (although now in Fannet Township, Franklin County, State of Pennsylvania) being sick and weak in body but of sound mind memory and understanding do therefore make and declare this my last will and testament in manner flollowing, viz. I will that all my just debts as shall be by me owing at my death, together with my funeral expenses and all charges touching the proving of or otherwise concerning this my will shall in the first place out of my personal estate and effects be fully paid and satisfied; and from and after payment thereof and subject thereto then my will is that first my sons James & John and my daughter, Mary, be Schooled sufficiently out of my Estate real or personal after which I give and bequeath unto my loving wife Mary Elder the full one third part of my estate real and personal; Then out of the remaining two thirds I will and bequeath to my son DAVID ELDER three hundred Dollars and to my daughter Margaret Elder two hundred Dollars and to my daughter Jane Elder one hundred Dollars after which the residue of said two thirds shall be divided equally among my sons and daughters David, James, John, Margaret, Jane, Elizabeth and Mary.  And I make and ordain my Wife MARY ELDER and my son DAVID ELDER and WILLIAM GAMBLE executors of this my last Will and Testament.  In Witness whereof, I the said JOHN ELDER to this my last will and testament have set my hand and seal this Eleventh Day of December in the year of our Lord one thousand eight hundred and twenty one.   JOHN (his x mark) ELDER seal.  Signed, Sealed and acknowledged by the Testator in the presence of the subscribers as his last will and testament.  JOSEPH ELDER, ROBERT LEEPER.

Franklin County, PA. On the 8th day of March A.D. 1822. Before me, Register for Franklin County personally appeared JOSEPH ELDER who on his solemn oath duly administered doth depose and say that he was personally present and saw JOHN ELDER now dec. make his mark unto and heard him publish the foregoing instrument as and for his last will and testament and at the time of doing thereof he the said JOHN ELDER was of sound and disposing mind memory and understanding according to the best of his knowledge and belief that he also saw ROBERT LEEPER sign as a witness and that his name thereto subscribed as a witness is of his own proper hand writing done at the same time.  JOSEPH ELDER. Sworn and subscribed before Jos Culbertson Regt.

Pensylvania Franklin County, PA on the 30th day of March A.D. 1822 before me, Register for Franklin County personally appeared ROBERT LEEPER one of the witnesses to the foregoing intrument of writing who upon his solomn oath duly administered doth depose and say that he was personally present and saw JOHN ELDER now dec. make his mark unto & heard him publish the said instrument as and for his last will and testiment at the time of doing thereof the said dec. was of sound and disposing mind memory and understanding, according to the bet of his knowledge and belief that he saw JOSEPH ELDER also sign as a witness and that his name thereto subscribed as a wtness is of his own proper hand writing done at the same time.

For I do hereby relinquish my right of Executorship Respecting the will of JOHN ELDER Dec. as it does not answer me to attend to it this from yours respectfully WM GAMBLE

 On the first day of April 1822 DAVID ELDER sworn well and truly to execute this will, file inventory and settle in one year or when thereto lawfully required.
