In the name of the Benevolent Father of All-Amen-
I, EMMA AIKEN being of sound and disposing mind and memory but mindful
of the uncertainty of life and desiring to make such disposition of my
estate as seems best to me do make publish, declare this my last will
and
testament.
Item First
I will and direct that all just debts against me at my decease, and
that my funeral expenses be paid.
Item Second
I give and bequeath to my mother ELLEN COSBEY all my household goods,
including silverware and clothing etc.
Item Third
I give devise and bequeath to my beloved husband THOMAS ELMER AIKEN
his heirs and assigns forever, all my undivided interest in the
remainder
estate of the 205 acre farm, given devised and bequeathed to me in Item
Sixth of the last will and testament of SAMUEL M. COSBEY deceased said
will and testament being recorded in Volume 59 page 540 Probate Records
of Hamilton County, Ohio or, it is my intention to give devise and
bequeath
to my husband THOMAS ELMER AIKEN, his heirs and assigns forever all my
right title and interest in the 205 acre farm on which my mother ELLEN
COSBEY now resides and in which she has a life interest.
Item Fourth
I do hereby authorize and empower my executor to sell the following
described real estate, which I now hold and own in fee simple:
Situate in Section 14, Town 4, Range 1, Miami Purchase Hamilton County
Ohio and described and bounded as follows to wit Beginning
in the center of the Plainfield Turnpike at the corner of land owned by
NATHANIEL DENMAN Thence north 69 3/4 degrees East 4.83 chains
thence
north 5 degrees 21’ West 9-88 chains to the line of HENRY HOLMES thence
north 87 degrees 21’ West 4.70 chains to another corner of DENMAN’s
land,
thence South 5 degrees 21’ East 11-70 chains to the place beginning
containing
5 acres of land being the same property conveyed to WILLIAM MALSBARY
deceased
by SAML M COSBEY by deed dated July 30th 1851 Recorded in Deed Book 169
page 295 Ham Co. Ohio Records of deeds.
I do authorize and empower my executor to sell the above described real estate on such terms of credit as may seem to him to be best, and to give to the purchaser a deed for the same. Out of the proceeds of the said sail of said above described premises I will and direct that all liens on said real estate be paid, that all debts of the estate be paid, and that the remainder of the proceeds after the payment of liens and debts if any be divided between my beloved husband THOMAS ELMER AIKEN and my mother ELLEN COSBEY. My husband THOMAS ELMER AIKEN to have one-third of said proceeds and my mother ELLEN COSBEY two thirds.
Item Fifth
All personal property not otherwise herein bequeathed and devised I
give one-third to my husband THOMAS ELMER AIKEN and two thirds to my
mother
ELLEN COSBEY.
Item Sixth
I do hereby appoint THOMAS ELMER AIKEN sole executor of this will and
direct that he shall not be required to give bond on qualifying as such
executor.

that a paper writing, purporting to be the Last Will and
Testament of
Emma Aiken late of said County, deceased, has been filed in the office
of the Probate Court of said County; and that the same will be offered
for probate and record before the Judge of the Probate Court, at the
Court
House in Cincinnati, in said County, on the 20 day of Sept. A.D. 1899,
at 9 o’clock A.M. In Witness Whereof, I Howard Ferris, Judge of
the
said Court, have hereunto set my hand and affixed the Seal of the said
Court, at Cincinnati, this 14th day of Sept A.D. 1899.
