ZELA CONKLING deed to WILLIAM TINGLEY

(Note:  This was the first of eight deeds recorded in Hamilton Co., OH, between the children of Abraham and Jemima (Lindsley) Conkling and William Tingley, husband of their daughter Eliza.  Original deeds for the Conkling land can be found on this site.  In 1836, William Tingley began buying the 1/9 undivided shares of inherited land from the brothers and sisters of his wife.  Following this deed are the names of the other seven sellers and pertinent deed information.  The land descriptions are the same.)

Know all Men by these Presents that Zela CONKLING of the County of Clermont and State of Ohio, for and in consideration of the sum of Fifty Dollars lawful money of the United States to him in hand well and truly paid by William TINGLEY.  The Receipt whereof is hereby acknowledged has bargained, sold Conveyed, released and forever Quit Claimed and by these Presents does grant, bargain, sell, convey, release & forever Quit Claim unto the said William TINGLEY his heirs and assigns forever.

            All that certain tract or parcel of land being One undivided Ninth part of Thirty Acres of land lying, being situate in Section No Thirty six in fractional Township No 5, and Range second fractional, Miami Purchase.  And all the Estate right, title, interest claim and demand both in Law and Equity of him the said Zela CONKLING of in and to the said premises, and every part thereof together with all and Singular the privileges and appertenances to the same belonging or in anywise appertaining and the rents, issues and profits thereof.  To have and to hold the premises hereby bargained and sold or meant or intended so to be with the appertenances to the only proper use and behalf of the said William TINGLEY his heirs, executors and administrators does covenant promise and agree to and with the said William TINGLEY his heirs, executors, administrators and assigns.  That he has not done or suffered anything whereby the title of the said premises to the said William TINGLEY is or can be frustrated or annulled.  And further, that he the said Zela CONKLING will Warrant and forever defend the aforesaid premises and every part thereof unto the said William TINGLEY his heirs or assigns against all persons claiming or to claim by from or under him his heirs or assigns.  In Testimony whereof, the said Zela CONKLING together with Sarah wife of the said Zela CONKLING who hereby forever relinquishes all her right and claim of dower in and to the premises has & hereunto set our hands and seals this Ninth day of September A.D. 1839.

The State of Ohio Clermont County SS
Before me one of the Justices of the Peace within and for said County personally appeared Zela CONKLING the above named grantor, together with Sarah CONKLING wife of the said Zela CONKLING and severally acknowledged the above deed of conveyance to be their voluntary act and deed for the use and purposes therein mentioned.  And the said Sarah wife of the said Zela CONKLING being examined separate and apart from her said husband and the contents of the said deed being made known and explained to her, declares that she voluntarily and of her own free will and accord without any fear or coercion of her husband did and now doth acknowledge the signing and sealing thereof.  In testimony whereof I have hereunto set my hand and seal this Ninth day of September in the year of Our Lord one Thousand Eight hundred and Thirty six.  Arthur McNaill, J.P.
