Last Will and Testament of Robert Price Deceased.



I(,) Robert Price, of Belmont County(,) Ohio of sound mind and memory do

make and publish this my last will and testiment (sic.) in manner and form

as follows to wit.

Item 1. Whereas I loaned my son John some money to enable him buy a farm,

and hold his notes for the same(,) My will and desire is that he shall have

a note I hold on him for One thousand dollars and one for fifty dollars,

both together(,) with the interest thereon be the same what it may, in lieu

of any lands and tenements

Item 2. I give and bequeath to my son Samuel Price, the Sixty acres of

land I own in section 32 to him and his heirs forever(,) Known as the

Wareham land. Als(o) about ten acres off the half quarter I live on being

in Section 33 beginning in the middle of the road at the Section line

between 32 & 33 and running with said road to the bars that lets in to his

house, thence in a N Easterly direction to the hollow or ravine(,) and then

following the meanderings of the ravine to the col (coal?) bank near the

Section line, to him and to his heirs forever



Item 3. I give unto my son Joseph Price, the piece of land I live on,

being the piece originally entered by me(,) and the piece got of R

Gilbreath. Excepting the piece heretofore bequeathed to my son Samuel(,) to

him and to his heirs forever



Item 4. I give and bequeath to my son Henry H. Price the piece of land he

now lives on. (known as the John Douglas place)



Item 5. I give and bequeath unto my daughter. Rebecca Price, a bed(,)

bedstead(,) and bedding, and my desire is that she shall have her choice of beds



Item 6. My will and desire is that the balance of my property of Every

discription (sic) Excepting such as is bequeathed be sold, and first that my

daughter Rebecca Price be paid five hundred dollars as a legacy, and the

balance to be equally divided among My following children to wit. Robert Y.

Price(,) John W Price(,) Joseph Price(,) Mary Hall(,) Margaret Smith(,)

Rebecca Price(,) Samuel Price(,) and Henry H. Price share and share alike.



Item 7 = My will and desire is that my son Joseph Price shall have all the

pork and other provisions laid up for the family, free of cost(,) and my

desire is that it be not taken into the appraisement (sic.).



Item 8. My Will and desire is that the wheat now on hand be not appraised

or accounted for in my estate, but that Samuel(,) Joseph(,) and Henry all

use out of it as we are now using and always have been using. (said wheat

never having been divided (sic)



Item 9. My will and desire is that my daughter(,) Rebecca Price(,) shall

have a home on those lands I have hereto bequeathed to my sons wherever she

may desire(,) free of all costs while she may remain single

Item 10 I do hereby appoint my son Samuel Price Executor of this my last

will and testament. In Witnes (sic) whereof I have hereunto set my hand &

seal this 19th day of January 1869.

Testimony in the Matter of the Will of Robert Price Decd.

The State of Ohio Belmont County ss.(?)

On this 18th day of April AD 1871, personally appeared Benjamin Mackall(,)

one of the subscribing witnesses to a paper writing this day presented to

said Court purporting to be the last will and testament of Robert Price

Late(,) of said County deceased(,) and being duly sworn in open Court says

that he saw the testator Robert Price sign the said paper writing as and for

his last will and testament, that he subscribed the same as witness thereto

in the presence of the Testator and at his request, that the testator at the

time of signing was of sound Mind and Memory(,) (older than) twenty-one

years of age(,) and not under any restraint. And he further says that

George Young Bowen(,) the other subscribing witness to said paper writing is

deceased, and at the time (unreadable) of said writing by the said Robert

Price as his last will and testament the said George Young Bowen was present

with this affiant and that this affiant saw the said George Young Bowen sign

said paper writing at the request of the testator as a witness thereto. And

that said George Young Bowen and this affiant signed said writing as

witnesses there to in presence of the testator and of each other and that

the signature of the said George Young Bowen to said paper is genuine.

Taken reduced to writing and subscribed in open Court at my office in St.

Clairsville Ohio this 18th day of April AD 1871

Estate of Robert Price

Deceased April 18th 1871. Will Provided. This day comes Samuel Price

and produced in Court the last will and testament of Robert Price deceased

late of Warren Township(,) Belmont County(,) Ohio. And at the same time

come Benjamin Mackall one of the subscribing witnesses to said Will and

being sworn in open Court testified to the due execution of said Will. And

at the same time testified that George Young Bowen the other subscribing

witness to said Will was deceased(,) but that he was present and saw said

George Young Bowen sign said Will as witness thereto at the request of the

testator and that his signature thereto is genuine. which testimony was

reduced to writing and by said witness subscribed and filed with said Will

and it appearing to the Court that said Will was duly executed and attested.

And that the testator at the time of signing was of sound mind and memory,

(older than) twenty one years of age(,) and not under any restraint(,) It

is ordered that said will be filed and recorded as the last will and

testament of Robert Price deceased. The said Samuel Price the Executor

named in said Will appeared and accepted said trust and filed his

application as required by law. Ordered that letters testamentary issue to

him upon his giving bond in the sum of five Thousand dollars conditioned

according to law. And it is further ordered that Benj Mackall.(,) B.F.

Bowen(,) and Wm P Reed (jr.?) and they are hereby appointed to make an

Inventory and appraisement. of the personal estate of said decedent. Bond

filed with St. Clair(,) Kelly(,) and R.E. Chambers surities. Bond approved

and letters issued
