January the Eighteenth in the year of our Lord, one thousand Eight hundred and twenty Eight, in the name of God, Amen. I, William Hinton of Belmont County, State of Ohio, being sound in body and mind and having my right understanding considering the Certainty of death and the uncertainty of the time hereof and being desirous to settle my Worldly affairs and whereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last will and testament in manner and form following. That is to say first and Principally I commit my soul into the hands of ALMIGHTY God and my body to the Earth to be decently buried at the Discretion of my Executrix herein after mentioned and first I bequeath to my wife Rachel the thirds of my real estate as long as she remains my widow. Then I bequeath unto my son, Josiah, all my land where I now live containing fifty acres to be his and his heirs for Ever in fee Simple. I do make my wife, Rachel my sole Executrix of all my real and moveable property till Josiah becomes of age and then not to be sold without the consent of both as she still remains my executrix. I will and bequeath to my three daughters, Lydia, Vina and Mary Each a bed and bedding and to each a cow and they to have a home at my house as long as they see proper. And lastly I do hereby constitute and appoint my dear wife Rachel my executrix of this my last will and testament; revoking and annulling all former wills by me heretofore made ratifying and confirming this my last will and no other to be my will and testament. In testimony whereof, I William Hinton have to this will consisting of one half sheet of paper set my hand and seal at the bottom of this half-sheet.

The foregoing will of William Hinton being brought into court, William Mitchell one of the subscribing witnesses thereto being called came into court and being sworn in open court deposeth and saith that he saw the testator subscribe said will, that witness subscribed the same as a witness in the presence of the Said testator that the said testator when he subscribed the said will was of sound mind and memory, of full age and not under any restraints.

At the same time and place came Nathan F. Mitchell another of the subscribing witnesses to said will and being duly sworn in open court deposeth and saith that he saw the testator subscribe said will, that witness subscribed the same as a witness in the presence of the testator, that the said testator when he subscribed the said will was of sound mind and memory, of full age and not under any restraint.

I hereby certify that the foregoing testimony was in open court on the 17th day of September A.D. 1828 and was by this court ordered to be recorded.
