- SCOPE & CONTENT: These Articles of agreement of the Auburn and California Mining and Trading Company were sworn and signed in Cayuga County, New York, on Feb. 28, 1849. The thirty individuals who signed the document were forming a partnership "for the purpose of mutual profit and protection in prosecuting the business of mining and trading in California ..." To that end they agreed "that on or before the 15th day of March 1849 we will collectively proceed by some suitable overland route to the Territory of Upper California, and there, during the continuance of the Company's business there, individually and collectively give our attendance and best exertions and endeavors, under the management and direction of the Directors, to the utmost of our undivided power and skill, for the profit and advantage of the said Company."
In five articles the agreement details the specifics of how the company shall be financed and organized, how long to continue and how to distribute the profits upon dissolution. Terms of participation were also listed requiring each participant to: "Abstain from liquor: "No officer or member of the said Company after its departure for California, and during the continuance of the Company, shall use any intoxicating liquor as a beverage, except under the advice of a physician in good faith, under the penalty of Fifty dollars for each offence ... "
Keep the Sabbath: "Each member shall observe and keep holy the first day of the week, commonly called the Sabbath-day, and shall abstain from all labor or amusement, except on extraordinary occasions as he shall be directed by the Directors of the Company." Refrain from gambling: "No member of this Company shall during his membership thereof play any sort of game of chance, or gamble or bet in any way, for gain, under a penalty of Fifty dollars, in addition to the stake so risked or played for ... "
