From the Book of Wills, Seneca County, N.Y., Volume A3, pages 45-51; will page 49: Probated April - May, 1830 Will of Elijah Kinne, Ovid, Seneca county, NY, dated 20 March 1815 [Page 49] In the name of God Amen. I Elijah Kinne of the town of Ovid in the County of Seneca being advanced in years, but being of sound mind and memory, Do make ordain publish and declare this as my last will and testament as follows to wit. 1st I give and bequeath my soul to God and my body to the dust, from whence it came. 2nd It is my will that my executors here in after named pay all my debts out of my personal estate. Item [3rd].. I give and devise unto my son Elijah Kinne Junr. all my houses on lot number ninety five in the township of Romulus in the County of Seneca, also all of lot number two of the township of Ovid, which I now live on together with all the buildings thereon to him the said Elijah Kinne his heirs and assigns forever subject to the payment of the legacies here in after mentioned & to be charged on the same. To wit It is my will that the said Elijah Kinne Junr. shall pay to my son Ephriam Kinne his heirs and assigns the sum of one thousand dollars in stock at cash price or in money at his election in one year after my death. Also to pay to my son Isaac Kinne his heirs and assigns the sum of one thousand dollars in stock at cash price or money at his election in two years after my death. Also the said Elisha shall pay to my daughter Lydia Bloomer or to her heirs one thousand dollars in stock at cash price or money as the said Elijah shall elect in three years after my death. Also the said Elijah shall pay to my daughter Hulda Mead's natural children one thousand dollars in stock at cash price or money as the said Elijah shall elect in four years after my death, which sum shall be divided equally (among) between her said children. Also the said Elijah shall pay to my daughter Hannah Denton and in case of her death then to her children the sum of one thousand dollars in stock at cash price or in money as the said Elijah shall elect in five years after my death. And the said Elijah shall pay to the [Page 50] children of my daughter Gerusha Huff one thousand dollars in stock at cash price or money as the said Elijah shall elect in six years after my death which sum shall be divided equally between her said children. And the said Elijah shall also pay to my daughter Louis Burroughs and in case of her death then to her chil- dren one thousand dollars in stock or money as the said Elijah shall elect in seven years after my death. Item 4thly I devise and give unto my son Ephriam Kinne all my land lying in lot number ninety six in the township of Romulus in said County of Seneca Also all my land lying in the Village of Lancast[er], also all my lands lying in the Village of Plymouth which Villages are situated in the township of Romulus, to him the said Ephriam his heirs and assigns forever -- Item [5th] .. I give and bequeath unto my said three sons Elijah, Ephriam and Isaac all my wearing apparel to be divided equally between them. 6th Item - I give and devise unto Elizabeth Ellet for her services and kindness in my family, and give and devise to her four children John, Peggy, Henry and James the lot of land I bought of Stephen Waterman containing about one hundred acres -- Also the lot of land I bought of Peter Hughes, containing about two hundred acres of land. Also the lot of land I bought of [Simon] Gould containing about twenty acres of land. All of the above pieces of land are situated in the township of Rom- ulus. Also a lot of ground with the buildings thereon I bought of James Woodruff lying in the Village of Verona in the town of Ovid containing about three quarters of an acre and eight rods of land all of which I devise to the said Elizabeth Ellet & her four children John, Peggy Henry and James their heirs and assigns forever. 7th Item -- I give and devise unto Amos Denton the use and occupation of the farm I bought of him and which is in his possession at this time for and during the term of his natural life and after his death I give and devise the said farm & premises to Elizabeth Ellet and her four children John, Peggy Henry and James and to her and their heirs and assigns forever. 8th Item - I give and bequeath all my mova- ble and personal estate of any kind & nature whatsoever that shall be left after my debts and funeral expenses are paid the [same] into six equal parts to be divided as follows, to wit: One sixth part I give to my daughter Lydia Bloomer and her heirs. One sixth part I give to Hannah Denton or if she be dead to her children. One sixth part I give to Louis Burroughs or if she be dead then to her children. One sixth part I give to the children of my daughter Huldah Mead who is deceased. One sixth part I give to the chil- dren of my daughter Gerusha Huff. One sixth part I give to Elizabeth [Page 51] Ellet and her heirs. 9th Item I do hereby further ordain and declare that out of the estate heretofore devised to my son Elijah Kinne Junior one years provisions he the said Elijah shall furnish and deliver to the said Elizabeth Ellet immediately after my death for the support of her self and children. 10th item -- It is hereby ordained and declared as my will that any person hereafter to derive any estate by [virtue] of this will, shall be on this condition that if any dispute shall arise between any of the persons herein named res- pecting the division of any part of the goods & estate herein given or devised that then it shall be the duty of my executors to divide the same Justly between the parties according to the intention of this will, which division shall be final and conclusive between them. 11th Item & lastly I do hereby last- ly ordain and declare that I hereby nominate and appoint my said sons Elijah Kinne Junior and Ephriam Kinne executors of this my last will and testament.
