This indenture made the fifth day of August in the year of our Lord one thousand eight hundred & seventeen Between Justus Bennett of Wayne in the County of Steuben & state of New York of the first part, & James J. Bennett of the town County & state aforesaid of the second part Witnesseth that the said party of the first part for & in consideration of the sum of two thousand dollars lawful money of the state of New York to him in hand paid by the said party of the second part the receipt whereof is hereby confessed & acknowledged, Hath granted, bargained, sold, remised released, aliened & confirmed, and by these presents doth grant, bargain sell, remise release, alien & confirm unto the said party of the second part & to his heirs and assigns forever all that certain piece, parcel or lot of land in the town & County aforesaid being a part of twelve hundred acres known by the Conet tract in township number five in the first range in the County aforesaid & bounded as follows: Beginning at the northwest corner of Justus Bennetts four hundred acres on the Conet tract & running from said corner along the road southerly in the west line of said tract one hundred & six perches to a stake & stones being Justus J. Bennetts northwest corner, thence south eighty six & a half degrees, East sixty seven perches to a stake standing in the edge of a causeway on the road leading over the outlet of the little Lake, thence northerly parallel with the west line of the Conet tract to the outlet of the little Lake, thence up said outlet & along the western shore of the little Lake to a soft maple tree blazed & hacked for a corner being about the corner of a lot of land belonging to the heirs of Jesse Salter deceased, thence north eighty seven & a half degrees west to the place of beginning containing by estimation one hundred acres of land be the same more or less.  Together with all & singular the hereditaments & appurtenances thereunto belonging or in anywise appertaining: And the reversion & reversions, remainder & remainders,  rents & profits thereof & all the Estate, right, title, interest claim or demand whatsoever of the party of the first part, Either in law or Equity of in & to the above bargained premises with the said hereditaments and appurtenances – To Have & to hold the said piece or parcel of Land unto the said party of the second part his heirs & assigns, to the sole & only proper use benefit & behoof of the said party of the second part his heirs & assigns forever. And the said party of the first part for his heirs Executors & administrators, doth covenant, grant, bargain, promise & agree to and with the said party of the second part his heirs and assigns, that the above bargained premises is in the quiet & peaceable possession of the said party of the second part, his heirs and assigns against all & every person or persons lawfully claiming or to claim the whole or any part thereof the above mentioned and described premises will forever Warrant & Defend In Witness whereof the said party of the first part hath hereunto set his hand & seal on the day & in the year first above written.

Steuben County:  On the first day of November in the year of eighteen hundred and seventeen before me John Dow one of the Judges of the Court of Common Pleas of the said county came Justus J. Bennett who is to me known who being duly sworn saith that he knows the within named grantor Justus Bennett to be the same person described in & who executed the within instrument and that he saw the said Justus Bennett execute the same as his voluntary act & deed and that this deponent together with N.H. Frisbee & John S. Bennett subscribed their names as witness to the said Justus Bennett executing the same deed and I being satisfied from the evidence aforesaid that the said Justus Bennitt Bennitt is the same person described in and who executed this amedise allow it to be recorded.
Recorded the 14th Jany. 1818 at 4 o’clock P.M.
