This Indenture made the fifth day of August in the year of our Lord
one thousand eight hundred & seventeen between Justus Bennett of Wayne
in the County of Steuben & state of New York of the first part and
Abraham Bennett of the town County and state aforesaid of the Second part
Witnesseth that the said party of the first part for and in consideration
of the sum of Five thousand dollars Lawful Money of the state of New York
to him in hand paid by the said party of the second part, the receipt whereof
is hereby confessed and acknowledged, Hath granted, bargained, sold, remised,
released, aliened & confirmed & by these presents doth grant, bargain,
sell, remise, release, alien & confirm unto the said party of the second
part & to his heirs & assigns forever: All that certain piece or
parcel of land situate in the County of Steuben aforesaid Bounded on the
north by the road that crosses the Outlet of the Little Lake in the town
of Wayne aforesaid, on the east by land of John S. Bennett on the south
by land occupied by James Lee & on the west by lands belonging to Ralph
Swarthout & Justus J. Bennett being part of twelve hundred acres of
land known of the Conet tract in township number five in the first Range
in the County of Steuben containing by Estimation one hundred & fifty
acres of land, be the same more or less, Together with all and singular
the hereditaments & appurtenances thereunto belonging or in any wise
appertaining or belonging or in any wise appertaining & the reversion
and reversions remainder and remainders & rents, issues& profits
thereof and also all the Estate right, title, interest claim or demand
whatsoever, of the said party of the first part Either in law or Equity
of, in & to the above bargained premises with the said hereditaments
and appurtenances, To Have and to Hold the said piece or parcel of land
unto the said party of the second part his heirs & assigns to the sole
& only proper use benefit & behoof of the said party of ____
_____ his heirs & assigns forever: And the said party of the first
part for his heirs Executors & administrators, doth Covenant, grant,
bargain promise and agree to and with the said party of the second part
his heirs & assigns that the above bargained premises in the quiet
& peaceable possession of the said party of the second part his heirs
& assigns against all & every person or persons lawfully claiming
or to claim the whole or any part of the above mentioned & described
premises will forever Warrant & Defend In Witness whereof the said
party of the first part hath hereunto set his hand & seal on the day
& in the year first above written

Steuben County On the nineteenth day of January A.D.
1818 personally appeared before me William Read Esquire one of the Judges
of the Court of Common Pleas in and for the County of the County of Steuben
the within named Justus J. Bennett one of the within named subscriber witnesses
of the within deed, and made oath that he saw the within grantors sign
seal and deliver the same, and that he knew the within named, Justus Bennett
and that signed, sealed, the within instrument for the uses and and purposes
therein Expressed, and the said Justus J. Bennett being known to me I having
examined the same do allow it to be Recorded
