This Indenture made the fifth day of August in the year of our Lord
one thousand eight hundred & seventeen Between Justus Bennett of the
town of Wayne County of Steuben & state of New York of the first part
& John S. Bennett of the town county & state aforesaid of the second
part Witnesseth that the said party of the first part, for & in consideration
of the sum of six hundred dollars lawful money of the state of New York
to him in hand paid by the said party of the second part, the receipt whereof
is hereby confessed & acknowledged: Hath granted bargained, sold, remised,
released, aliened & confirmed, And by these presents doth grant, bargain,
sell, remise, release, alien & confirm unto the said party of the second
part and to his heirs & assigns forever All that certain piece or parcel
of land described as follows, to wit, Beginning at a stake in the southeast
corner of a lot of land of twelve hundred acres known & distinguished
by the name of the Conet lot, in township number five in the first Range
in the county of Steuben, and runs thence north one hundred & eighty
rods to a stake, thence west one hundred & eighty rods, thence south
one hundred & eighty Rods, thence east to the place of beginning containing
two hundred acres of land be the same more or less: Together with all &
singular the hereditaments and appurtenances thereunto belonging or in
any wise appertaining and the reversion & reversions, remainder &
remainders, rents, issues & profits thereof: and all the Estate right
title interest claim or demand whatsoever of the said party of the first
part either in Law or Equity, of in and to the above bargained premises
with the said Hereditaments & Appurtenances: To Have and to Hold the
said piece or parcel of land unto the said party of the second part his
heirs and assigns to the sole and only proper use benefit & behoof
of the said party of the second part his heirs and assigns forever: And
the said party of the first part for his heirs executors and administrators
doth Covenant, grant, bargain, promise & agree, to and with the said
party of the second part his heirs and assigns that the above bargained
premises in the quiet & peaceable possession of the said party of the
second part his heirs & assigns against all and every person or persons
lawfully claiming or to claim the whole or any part of the above mentioned
& described premises will forever Warrant & Defend – In Witness
whereof the said party of the first part hath hereunto set his hand &
seal on the day & in the year first above written.

Steuben County: On the first day of November in the year eighteen
hundred & seventeen before me John Dow one of the Judges of the Court
of Common pleas of the said County came Justus J. Bennett who is to me
known who being duly sworn saith that he knows the within named Justus
Bennett to be the same person described in & who executed the within
deed & that he saw the said Justus Bennitt execute the same deed as
his voluntary act & deed & that, he this deponent together with
N. H. Frisbie & Joseph Bennitt subscribed their names as witness to
the said Justus Bennett executing the same & I being satisfied from
the evidence aforesaid that the said Justus Bennett is the same person
described in & who executed the same deed allow it to be Recorded.
