This Indenture Made the twenty second day of April in the year of our Lord, one thousand eight hundred and Sixteen Between Justus Bennett of the town of Wayne in the County of Steuben and State of New York & Nancy his wife of the first part and Ralph Swarthout of the town County and State aforesaid of the Second part Witnesseth that the said party of the first part for and in Consideration of eight hundred dollars current money of the United States to them in hand paid by said party of the Second part the receipt whereof is hereby Confessed & acknowledged, have granted, bargained, Sold, remised, aliened and Confirmed and by these presents do grant, bargain, sell, remise, release, alien and confirm, unto the said party of the Second part his heirs and assigns forever: All that piece parcel or lot of land lying and being in the town of Wayne aforesaid and bounded as follows (viz) Beginning at the South west corner of Justus Bennetts fifty acres lot and running from the said corner South eighty seven and a half degrees, East one hundred and seventy six perches to the east bounds of the great lot formerly owned by Roger Conant, Thence South two and a half degrees west ninety perches & twenty three links, thence north eighty seven and a half degrees west one hundred and seventy six perches to a Stake & Stones, thence north two and a half degrees east twenty six perches and ten links to a Stake and Stones thence north eighty seven and a half west seven perches and nine links to a white oak tree blazed for a Corner Standing on the west side of Josiah Bennetts road, thence north ten and a half degrees west eighty four and a half perches to a Stake on the west side of said road, thence north Eighty six and a half degrees East twenty seven perches to a pin oak tree thence twenty perches to the place of beginning: Containing by Estimation one hundred and Eight acres & three fourths of an acre be the same more or less: Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining: and the reversion & reversions remainder & remainders rents, issues and profits thereof: and all the Estate right title, interest, claim or demand whatsoever of the said of the first part either in law or Equity of in and to the above bargained premises with the Said hereditaments and appurtenances – To Have and to hold the said piece parcel or lot of land & premises above mentioned & every part thereunto belonging except as hereafter Excepted unto the said party of the second part his heirs and assigns forever: And the said party of the first part his heirs Executors administrators, doth Covenant, grant bargain promise and agree to & with the said party of the Second part his heirs and assigns against all & every or persons lawfully claiming or to claim the whole or any part of the above mentioned and described premises will forever Warrant and Defend (except as above) the priviledge heretofore bargained to Frederick Bartles for the use of his mill reserved

Steuben County    Be it remembered that on the twenty seventh day of October in the year one thousand Eight hundred and Seventeen personally appeared before me William Helm one of the Judges of the Court of Common pleas in and for said County Justus Bennett the within Grantor to me known who duly acknowledged that he Executed the within deed for the uses and purposes therein mentioned, I having examined the same and finding no material erasures or interlineations except those noted I allow the same to be Recorded.
